It is obvious proof of the founding or of the refounding of the city sanctuary by the Lagid pharaoh. The temple, a construction dedicated to the sacred, could not indeed be built without a ritual ceremony of foundation and consecration. The king, helped by the goddess Sechat, first determined the orientation of the edifice and then dug a trench marking its perimeter. “Pure” sand was poured, while the “foundation offerings” were placed in the corners. The golden plaque of Heracleion fits all the better into this pharaonic tradition as a similar object has been found in the center of the Aboukir peninsula (“West-Canope”) bearing the dedication of a sacred enclosure (temenos) dedicated to Osiris in the name of the same Ptolemy III and Berenice II (British Museum, no. 1063). 58. En effet, nous ne partageons pas le point de vue de l’Appelante lorsqu’elle prétend que les tribunaux auraient, dans les jugements a quo, considéré comme une condition sine qua non à l’existence de confusion au sens de l’article 6(2) de la Loi, la connexité entre les marchandises, services et entreprises des parties en cause.
59. Les tribunaux, dans les jugements a quo, ont plutôt jaugé toutes les circonstances pertinantes (incluant celles spécifiquement énumérées à l’article 6(5) de la Loi) puis ont conclu qu’ à la lumière de l’ensemble de la preuve, il n’était pas probable que le consommateur moyen pense que les services de restaurants de l’Intimée émanent de l’Appelante.

Contrary to the Appellant, we do not interpret the judgments under appeal as recognizing the existence of a certain connection between the products, services, and companies of the parties to be essential for concluding the existence of a reasonable risk of confusion with a well-known trademark, pursuant to article 6(2) of the Law.
58. Indeed, we do not share the Appellant’s point of view when it claims that the courts, in the judgments under appeal, considered connectedness between the products, services, and companies at issue as a sine qua non condition for the existence of confusion in the sense of article 6(2) of the Law.
59. Rather, the courts, in the judgments under appeal, evaluated all the pertinent circumstances (including those specifically enumerated in article 6(5) of the Law) and then concluded that in light of the evidence as a whole, it was not likely that the average consumer thinks that the restaurant services of the Respondent originate from the Appellant.
