Union to pursue unfair dismissal case after ex-Treasury aide Sonia Khan was marched out of Downing Street
Boris Johnson and his closest aide, Dominic Cummings, have been facing a backlash over the dismissal of senior advisers as the union representing high-ranking public servants announced that it was pursuing a case for unfair dismissal and sex discrimination against a female adviser who was sacked and marched out of Downing Street by an armed policeman.
Two days after Sajid Javid resigned as chancellor after refusing a demand from Johnson to sack all his special advisers, the FDA (formerly the First Division Association) told the Observer it expected Johnson and Cummings to give evidence under oath to an employment tribunal in a case involving former Treasury aide Sonia Khan.
The announcement of action by the FDA on behalf of Khan was seen as a warning to Johnson of serious legal consequences and further potential actions if Cummings is not reined in.
It came as the cull of aides at the top of government increased on Saturday with the sacking of two more special advisers from the No 10 policy unit, Christopher Brannigan and Elliot Roy.
With a culture of fear spreading in Whitehall, the FDA’s general secretary, Dave Penman, said it was up to the prime minister to explain what had happened to Khan, and it was his responsibility that staff were treated decently.
He said: “At the time of Sonia Khan’s dismissal, in the Cabinet Office only the prime minister had the authority to dismiss her. In the employment tribunal we will expect both the prime minister and Dominic Cummings to give evidence under oath as to the reasons for dismissal, the process they applied and the evidence they used to make that decision. They may also be subject to cross-examination on this evidence.
“Special advisers deserve to be treated fairly and with respect. The prime minister is the minister for the civil service and therefore his actions – and the actions of those to whom he delegates – have implications for the entire service.”
Khan, who was Javid’s media adviser at the time she was sacked, was escorted from No 10 by an armed police officer after Cummings accused her of misleading him over her contact with individuals close to the former chancellor Philip Hammond. She denied any inappropriate contact. Javid was furious to learn about her dismissal after the event.
It is understood that Cummings faced criticism at a weekly meeting of advisers on Friday night, the day after the reshuffle. Lynn Davidson, a former Sun journalist, who advises the defence secretary, Ben Wallace, reportedly told him he had been out of order and had to show more respect to people who were “doing their best in incredibly difficult circumstances”.
At the advisers’ weekly meeting the previous Friday, it is claimed that Cummings humiliated young aides to Theresa Villiers and Andrea Leadsom, asking them deliberately detailed and difficult questions he knew they would struggle to answer. Six days later, Villiers and Leadsom, and with them their two advisers, were sacked in the reshuffle.
Sources said Cummings had yet to file a response to the claims about Khan by the FDA and its lawyers. While the union said it expected Johnson and Cummings to give evidence under oath, it is thought likely that the case will be settled before a hearing, by means of a financial or other settlement. In 2012 a senior civil servant received a payout of £25,000 in a bullying case she took against Cummings and a senior member of Michael Gove’s team when Cummings was a special adviser at the Department for Education. An internal investigation found no grounds for disciplinary action.
At the time of Khan’s dismissal last September, the terms of employment for special advisers made it clear that it was only the prime minister who had the power to sack them. This was then changed after Khan left, giving Cummings ultimate “responsibility for disciplinary matters”.

Boris Johnson et son plus proche collaborateur, Dominic Cummings, ont dû faire face à un contrecoup suite au licenciement de conseillers supérieurs. Le syndicat représentant les hauts fonctionnaires annonce que cet acte fera l’objet d’une poursuite pour licenciement abusif et discrimination sexuelle contre une conseillère qui a été licenciée et fait sortie de la résidence de Downing Street par un policier armé.
Deux jours après la démission du Chancelier de l'Échiquier Sajid Javid qui aurait refusé une demande de Johnson de licencier tous ses conseillers spéciaux, la FDA (anciennement l’Association de la Première Division) a déclaré à l’Observer qu’elle s’attende à ce que Johnson et Cummings témoignent sous serment devant un tribunal administratif du travail dans l’affaire qui implique l’ancienne assistante du Trésor Sonia Khan.
L’annonce d’une action entreprise par la FDA au nom de Khan a été considérée comme une mise en garde de Johnson sur les graves conséquences juridiques et d’autres actions potentielles qui découleraient si on ne freine pas Cummings.
L’intervention de la FDA survient alors que l’élimination des aides au sommet du gouvernement continue avec le licenciement samedi de deux autres conseillers spéciaux de l’unité des politiques de 10 Downing Street, Christopher Brannigan et Elliot Roy.
Face à la dissémination d’un climat de peur à Whitehall, le secrétaire général de la FDA, Dave Penman, a déclaré qu’il incombe au Premier ministre la responsabilité d’expliquer ce qui était arrivé à Khan et de garantir le traitement décent du personnel.

Khan, qui, au moment de son licenciement, était conseillère des médias pour Javid, fut escortée par un policier armé pour sortir du numéro 10 après avoir été accusée par Cummings de l’avoir trompé sur ses rapports avec des personnes proches de l’ancien chancelier Philip Hammond. Elle a démenti d’avoir eu de contacts inappropriés. Javid est devenu furieux lorsqu’il a été mis au courant de l’incident.
Vendredi soir, le lendemain du remaniement, Cummings a dû affronter des critiques lors d’une réunion hebdomadaire des conseillers. Lynn Davidson, une ancienne journaliste du Sun, conseillère du secrétaire à la Défense, Ben Wallace, lui aurait communiqué que sa conduite était inacceptable et qu’il devait montrer plus de respect à l'égard de ces personnes qui « faisaient de leur mieux dans des circonstances extrêmement difficiles ».

Selon des sources fiables, Cummings n’avait pas encore présenté une réponse aux réclamations de FDA et ses avocats sur l’affaire Khan. Même si le syndicat ait annoncé l’attente d’un témoignage sous serment de Johnson et Cummings, il y a une grande probabilité que l’affaire sera réglée avant l’ouverture d’une audience à travers une indemnité ou un remède d’autre nature. En 2012, une haute fonctionnaire a reçu un paiement de 25 000 sterlings dans une affaire d’intimidation intentée contre Cummings et un ancien membre de l’équipe de Michael Gove quand Cummings était conseiller spécial au ministère de l’Éducation. Une enquête interne ne trouva aucun motif justifiant des mesures disciplinaires.
Au moment du congédiement de Khan en septembre dernier, les conditions d’emploi des conseillers spéciaux attribuaient exclusivement et sans équivoque au premier ministre le pouvoir de les licencier. Suite au départ de Khan, cette situation a été changé en octroyant à Cummings la responsabilité suprême sur les questions disciplinaires.

Edhe para se të ndodhte tërmeti i 26 nëntorit kishte filluar të artikulohej ideja e tërheqjes së punëtorëve nga jashtë për të mbushur vakumin e thellë që po lë emigracioni i shtuar i shqiptarëve drejt Perëndimit. Kjo ide u artikulua zyrtarisht nga Kryeministri në një mbledhje të kabinetit qeveritar, si pjesë e masave për rindërtimin e objekteve të banimit të dëmtuara prej tërmetit. Një lëvizje e tillë politike meriton një analizë më të thelluar të pasojave me të cilat ajo shoqërohet, ekonomike e sociale, në afat të shkurtër dhe në afat të gjatë.
Gjatë këtyre tri dekadave të transformimeve demokratike, në Shqipëri kanë ndodhur ndryshime të rëndësishme dhe në strukturën demografike të shoqërisë. Kryesisht për motive ekonomike, por edhe për vetërealizim në një ambient më të përshtatshëm, ku aksesi ndaj oportuniteteve ekonomike që krijon ekonomia e re është shumë më i lehtë dhe më ndihmues e mbështetës, më shumë se 1/3 e forcës së punës së vendit është larguar. Deri në vitin 2010, Banka Botërore raporton se mbi 1.8 milionë shqiptarë jetojnë jashtë vendit dhe ky fenomen i braktisjes ka vazhduar edhe më vonë. Në veçanti pas viteve 2014, emigracioni ka filluar të rritet sërish. Sipas të dhënave nga INSTATi, që prej vitit 2014, mesatarisht 40 mijë qytetarë largohen çdo vit nga vendi. Krahasimet e indikatorëve të emigracionit tregojnë se ky fenomen për Shqipërinë është 4-5 herë më i lartë se mesatarja botërore (Përtej Kufijve – Raporti Analitik për Emigracionin). Dhe çka e bën këtë fenomen tepër shqetësues, është se dëshira për emigracion mbetet shumë e lartë, siç është evidentuar nga numri i pazakontë i aplikimeve për Lotarinë Amerikane, apo radhët nëpër sportelet e ambasadës gjermane.
Mungesa e fuqisë punëtore është bërë e ndjeshme për pothuaj çdo profesion, duke filluar nga mjekët dhe infermierët, nga zanatçinjtë e ndërtimit e deri te punëtorët e krahut. Tregu në tërësi po tkurret, shitjet bien dhe për pasojë bizneset po goditen nga të dyja krahët, si nga ana e ofertës (mungesës së fuqisë punëtore), ashtu dhe nga kërkesa (mungesa e tregut për shitjen e produkteve dhe shërbimeve). Për pasojë, rritja dhe zhvillimi ekonomik janë nën kërcënim. Nëse ky fenomen nuk adresohet me politika të përshtatshme, problemet mund të bëhen më serioze në afat të gjatë. Një nga këto politika mund të ishte dhe stimulimi i emigrantëve të huaj për të punuar në Shqipëri. Po shqyrtojmë shkurt kanalet se si imigrimi e ndikon ekonominë dhe shoqërinë e një vendi dhe mbi çfarë premisash kjo mund të ishte një politikë e përshtatshme.
EFEKTET E IMIGRIMIT MBI RRITJEN DHE ZHVILLIMIN E EKONOMISË
Janë disa kanale, përmes të cilave imigrimie ndikon rritjen dhe zhvillimin ekonomik: oferta e tregut të punës, kapitali njerëzor, sipërmarrja, siguria sociale, shpenzimet publike dhe integrimi social. Këto efekte mund të jenë të ndryshme në kohështrirje të ndryshme – domethënë, nëse në afat të shkurtër mund të jenë pozitive, në afat të gjatë mund të shndërrohen në faktorë me ndikim negativ. Mjafton të sjellim për ilustrim problemet e sotme të vendeve të BE-së me emigrantët e huaj.
Duke u ndalur tek efekti i imigrimit mbi tregun e punës, sigurisht që ardhja e emigrantëve të huaj për t’u punësuar do të shtonte fuqinë punëtore në vend dhe për biznesin do të ishte më e lehtë gjetja e punëtorëve, të cilët sot nuk ofrohen nga tregu vendës. Për më tepër, nëse punëtorët do të vinin me kualifikime të mira dhe aftësi të zhvilluara për punë profesionale, kjo do të kishte një efekt shumë pozitiv edhe në rritjen e produktivitetit të biznesit vendës, duke e bërë ekonominë më konkurruese (kanali i kapitalit njerëzor).
Por, këtu mund të ngrihen disa pyetje. Së pari, a është e mundur që emigrantë të huaj të kualifikuar dhe që kanë produktivitet të lartë të vijnë në Shqipëri, një vend me nivele pagash shumë të ulëta – me një pagë mujore 400- 500 euro dhe ku shpenzimet e jetesës janë shumë të larta? Emigracioni, siç e nënvizuam më sipër, bëhet në emër të një perspektive më të mirë ekonomike, për të ndihmuar familjet në vendin e origjinës apo për të ndërtuar një jetesë në një vend që ofron më shumë. Kjo shpjegon rrjedhën e emigracionit nga vendet e varfra drejt vendeve më të zhvilluara, por nuk para ndeshen raste të emigrimit nga një vend i varfër në një vend tjetër po aq të varfër. Fatkeqësisht, Shqipëria mund të ofrojë më shumë vetëm duke u krahasuar me vendet më të prapambetura të Afrikës së Veriut, ose nga vendet që po përjetojnë destabilitet të brendshëm social, siç janë disa vende nga Lindja e Mesme.
Prej këtej lind pyetja tjetër, se a mundet që ky lloji emigracioni të shërbejë si burim rritjeje dhe zhvillimi edhe në afat të gjatë? Gjykoj se kjo pyetje ka dy përgjigje. Përgjigjja do të ishte pozitive nëse tregu i punës do të jetë shpërblyes dhe do të ndajë përfitimet e rritjes së produktivitetit në një mënyrë të drejtë midis punës dhe kapitalit. Por, nëse sjellja e tregut të punës do të vazhdojë njësoj si deri më sot, duke ruajtur pagat në nivele mbijetese dhe duke mos e ndarë prosperitetin e rritjes së biznesit edhe me asetin kryesor të sipërmarrjes, që janë të punësuarit, kjo do të ishte thjesht një strategji mbijetese për biznesin në afat të shkurtër, por jo një instrument zhvillimi për vendin. Ky problem esencial i ekonomisë politike është përcaktues për ndikimin e politikave migratore. Ky është shpjeguesi kryesor edhe mbi përmasat e larta të emigracionit shqiptar drejt vendeve të zhvilluara. Punëtori shqiptar është ndjerë i përdorur, por jo i vlerësuar, ashtu sikurse në shoqërinë tonë në tërësi, ka munguar vlerësimi për rolin zhvillues të individit. Ndjekja e politikave biznesore të ruajtjes së konkurrueshmërisë duke ruajtur nivele pagash të ulëta, në shumë sektorë të ekonomisë, veçanërisht në manifakturë, ndërtim dhe shërbime, që zënë dhe më shumë se ¾ e punësimit në sektorin privat, ka qenë dritëshkurtër dhe shkaku i asaj që po ndodh sot në tregun e brendshëm të punës. Është e pamundur të gjendet një vend tjetër ku pagat në sektorin privat të jenë vetëm sa 75% e pagës në sektorin publik! E kundërta duhet të ishte e vërtetë – rritjet e pagave në sektorin privat të shërbenin si tërheqës për rritjen e pagave dhe në sektorin public.

Një numër mjaft i madh emigrantësh shqiptarë në Itali, Greqi dhe në vendet e tjera të botës së zhvilluar, janë sot të angazhuar në biznese serioze dhe po u kontribuojnë atyre ekonomive me aftësitë e tyre sipërmarrëse. Literatura në këtë fushë, gjithashtu ka hedhur dritë mbi efektet pozitive të emigracionit në vendin pritës. Kjo e shpjeguar kryesisht me faktin se emigrantët janë idiosinkratikisht më aventureskë dhe se eksperiencat ndërkulturore rrisin aftësitë e tyre sipërmarrëse. Edhe pse kjo qasje teorike ka kritikat e veta, sërish në planin teorik ai mbetet një faktor i rëndësishëm potencial që emigrantët e huaj të ardhur në Shqipëri të angazhohen me bizneset e tyre, duke u ofruar qytetarëve më shumë zgjedhje, por edhe ekspozime kulturore ndaj traditave të vendeve të tjera. Por që ky potencial të mund të realizohet, do të duhej që klima e biznesit në vend të jetë mikpritëse, që shteti të jetë ndihmues dhe jo pengues për interesat e investitorëve. Fatkeqësisht, edhe biznese të krijuara prej kohësh dhe që kanë krijuar një eksperiencë të gjatë pune në vend, ndeshen me aq shumë pengesa dhe burokraci, saqë nuk e bëjnë aspak interesante për hyrës të rinj në treg. Ose, tashmë janë krijuar grupe të rëndësishme interesash në tregje, të ngjashëm me gildet e shekujve të hershëm, të cilët kanë fuqi ndaluese për hyrësit e rinj. Gjendja e konkurrencës në shumë tregje të brendshme është problematike.
Por imigrimi mund të sjellë dhe pasoja negative, kryesisht në kostot buxhetore që mund të nevojiten për integrimin e tyre ekonomik dhe social. Emigrantët do të kenë nevojë për shërbim mjekësor, shërbim arsimor, jetë kulturore dhe do të jenë përfitues të shërbimeve publike, të cilat mund të shtojnë barrën e shpenzimeve publike në këto fusha. Edhe pse përmes punësimit të shtuar të ardhurat buxhetore mund të rriten, fatkeqësisht ka një disproporcionalitetet midis të ardhurave dhe shpenzimeve, ku të ardhurat janë shumë të ulëta, ndërsa nevojat për shpenzime publike janë shumë më të mëdha. Për pasojë, edhe pse në afat të gjatë ky ekuilibër mund të përshtatet, presioni fiskal në afat të shkurtër dhe të mesëm do të jetë i fortë. Dhe së fundmi, problemi kryesor në afat të gjatë do të jetë ai i kohezionit social. Diferencat kulturore e gjuhësore e madje edhe fetare, mund të shndërrohen në një çështje serioze për shoqërinë e ardhshme, njësoj siç është sot problemi themelor i Europës. Në konkluzion, sa më të mira të jenë politikat e integrimit, aq më pozitive do jenë dhe efektet pozitive që mund të gjenerojë ekonomia dhe shoqëria nga imigrimi.

The idea of admitting foreign workers to fill in for the growing Albanian population migrating to the West had already been articulated even before the earthquake of November 26. However, it was the Prime Minister who announced it at a cabinet meeting as part of the measures aimed at rebuilding the earthquake-damaged residential buildings. This policy orientation deserves a more in-depth analysis of its short and long-term economic and social consequences.
During these three decades of democratic transformation, significant changes have occurred in the demographic structure of the Albanian society. More than 1/3 of the country's workforce has left, mostly for economic reasons, in pursuit of success in more propitious environments with easier, better and friendlier access to the opportunities created by the new economy. As of 2010, the World Bank reports that over 1.8 million Albanians live outside their home country and this phenomenon of abandonment is ongoing. In particular, after 2014, immigration has been on the rise again. According to INSTAT data, since 2014, an average of 40,000 citizens leave the country each year. Cross-Comparison of immigration indicators show that Albania outranks four to five times the world average (Beyond Borders - Analytical Report on Immigration). Even more disturbing is the steadiness of an intense desirability to immigrate, as evidenced by the increasing numbers of US Lottery applications or the queues in front of the German Embassy visa desk.
Almost every occupation is plagued by a manpower shortage, from doctors and nurses all the way to construction craftsmen and manual workers. The market as a whole is shrinking, the sales are falling and, as a result, businesses are suffering on both fronts of supply (shortage of labor) and demand (no market for the sale of products and services). Ultimately, these trends jeopardize growth and economic development. The failure to devise appropriate policies will only, in the long run, aggravate the current problems. One of these policies would consist of incentives offered to foreign migrants to come and work in Albania. In the sections below, we will briefly look at how immigration affects a country's economy and society, and under which circumstances the encouragement of immigration might be an appropriate policy.
THE EFFECTS OF IMMIGRATION ON ECONOMIC GROWTH AND DEVELOPMENT
Immigration impacts growth and economic development through several channels be it the labor market supply, human capital, entrepreneurship, social security, public spending or social integration. The nature of this impact may differ across time, it may be positive in the short term, but it may turn into negative in the long term. It suffices to cite as an example, the current immigration problems experienced by the EU countries. When taking on the effect of immigration on the labor market, surely the arrival of foreign workers would increase the supply of labor force in the country and make it easier for businesses to find the manpower of which the local market is running short. Furthermore, in terms of human capital, well-qualified and skilled immigrant workers may make a positive contribution to domestic productivity and economic competitiveness.
These assumptions however raise a number of questions. First, would a highly skilled and productive foreign workforce accept to come to Albania and face a reality where wages are very low (400 to 500 euros monthly) and living expenses are high? It was pointed out in the previous paragraphs that people immigrate in search of a better economic future, to help their families home or to build a better life in a country that offers more. This explains the flow of immigration from poor to developed countries, but seldom we see cases of migration from one poor country to another. Unfortunately, Albania can offer more only when compared to North Africa's most backward countries or those experiencing internal social instability such as some countries in the Middle East.
This consideration begs a second question about the viability of this type of immigration as a source of growth and development in the long run? I believe that the answer to this question may go both ways. We may get a positive outcome if the labor market is rewarding and gives rise to a fair labour/capital sharing of the benefits from increasing productivity. Yet, if the current labor market persists in its trend of maintaining wages at the subsistence level while failing to extend the fruits of business growth to those employed then migration would merely be a makeshift business survival strategy, but not an instrument of development for the country. This essential political economy problem is crucial in determining the impact of the migration policies inasmuch as it explains the massive Albanian emigration to developed countries. The Albanian worker perceives himself as being used, but not valued in a society that generally has never been appreciative of the individual's developmental role. Policies aimed at maintaining competitiveness by keeping wages low in more than ¾ of the private sector employment industries such as manufacturing, construction and services, have been short-sighted. These policy orientations are also responsible for what is happening today in the domestic labor market. You could hardly find a country where salaries in the private sector are a 75 per cent of the salaries in the public sector. The opposite should be true. It is wage increases in the private sector that lead to wage increases in the public sector.
Entrepreneurship is another important channel through which foreign migrants may become a positive factor for the country's economy. A large number of Albanian immigrant business owners in Italy, Greece and other developed world countries are putting into use their entrepreneurial skills to the benefit of these countries’ economies. The literature in this area has also thrown light on the positive effects of immigration on the host country. It largely explains it through claims that immigrants possess the peculiar characteristic of being more adventurous and that intercultural experiences boost their entrepreneurial skills. Although this theoretical approach may attract criticism, it still offers a valid prognosis on the doing-business potential of foreign migrants in Albania as providers of choice and cultural exposure. However, this potential can only be materialized if the country’s business climate is favorable, if the state is helpful and not hostile to investors’ interests. Unfortunately, even well-established businesses with a long transactional experience face so many bureaucratic barriers that new entrepreneurs lose interest in pursuing market access. Moreover, important interest groups like the guilds in previous centuries have already emerged to effectively challenge the market rise of new entrepreneurs. Indeed, the state of competition in many domestic markets remains problematic.
The other side of coin is that immigration may also produce negative effects related to the budgetary costs required for purposes of economic and social integration. As they settle, Immigrants will need medical, educational and cultural services and will have to share in other public services, which can increase the burden of public expenditure in these areas. Although increased employment brings in more revenues, unfortunately, there is still a disproportionate revenue-expenditure gap, where necessities command a level of public expenditure that easily outpaces the revenue intake. Even if this balance may improve through time, short-term and medium -term fiscal constraints will remain strong. Last but not least, the most important long-term problem of immigration will be its impact on social cohesion. Cultural, linguistic and even religious differences may become a critical bone of contention in the Albanian society of the future, just as it has become Europe's fundamental concern nowadays. In conclusion, the positive effects of immigration on the economy and society will depend on the quality and viability of the integration policies.

Translation has been a passion of mine for the last two decades. I have translated literary works from English, French and Italian to Albanian. I also speak Russian and have limited knowledge of German. My first degree is in linguistics. Moreover, in the last 15 years, I have employed the art of translation in social science jumping back from English to French and vice-versa. I have extensive writing experience both in translation as well as in the creation from the scratch of an original text. I am able to tackle, in the languages that I have mastered, the most advanced literature in a number of fields beyond social sciences including the most sophisticated poetry and prose.
