5-B DCMR § 2103
2103 TRUANCY
2103.1 District of Columbia Public Schools (DCPS) elementary and secondary students who have
one unexcused absence from homeroom where attendance has been taken for purposes of the Compulsory
School Attendance Act shall receive appropriate absenteeism protocol interventions initiated
by classroom or homeroom teachers, pursuant to the Act.
2103.2 Half-day schedules for students attending DCPS are governed by the following
requirements:
(a) Half day schedules are permitted for employed students aged seventeen
(17) or older whose hours of employment fall within the regular school day;
(b) Half day schedules are permitted for secondary students attending one of the local colleges
or universities;
(c) In order for a half-day schedule to be approved, the student's employment and work hours or
college schedule must be verified by the local school. Students who are not employed or attending
one of the local colleges or universities will have a full course schedule, as will those whose
employment begins after regular school hours.
2103.3 DCPS students accumulating thirty (30) or more unexcused absences within a full school
year shall only be promoted if they meet an exception set forth in D.C. Official Code §§
38-781.02(c) or 38-781.05.
2103.4 DCPS secondary students with ten (10) unexcused absences in any class shall receive an
initial written notice that they are at risk of receiving a grade of “FA” (failure due to absences)
in that subject upon accumulating more than thirty (30) unexcused absences unless an exception
applies.
2103.5 DCPS secondary students with fifteen (15) unexcused absences in any class shall receive
an additional written warning that they are at risk of receiving a grade of “FA” (failure due to
absences) in that subject upon accumulating more than thirty (30) unexcused absences.
2103.6 DCPS secondary students accumulating more than thirty (30) unexcused absences in a
course within a full school year shall receive a failing final grade in that course with a
resulting loss of course credit.
2103.7 A written appeal may be filed by a parent or student on behalf of any student receiving
a failing grade(s) due to unexcused absences.
2103.8 An appeal filed pursuant to § 2103.7 shall be submitted to the principal of the
District of Columbia Municipal Regulations
school attended or to a designee of the Chancellor within ten (10) school days after receipt of the
failing grade(s).
2103.9 Upon receipt of an appeal filed pursuant to § 2103.7, the principal or Chancellor’s
designee shall appoint an Appeals Panel and shall forward all written appeal requests to the panel
chairperson within three (3) school days.
2103.10 The Appeals Panel referenced in § 2103.9 shall consist of not less than three
(3) members to be selected from the following, one of which shall be from category (a):
(a) A person designated by the principal or Chancellor’s designee, who shall be the panel
chairperson;
(b) A guidance counselor;
(c) A department chairperson;
(d) A teacher, other than the one involved in the matter being appealed;
(e) An attendance staff person; or
(f) A representative from DCPS central office administration.
2103.11 Substitutions of no more than two (2) members of the Appeals Panel described in §
2103.10 may be made when necessary.
2103.12 The Appeals Panel shall hold a hearing within ten (10) school days after its appointment
by the principal or Chancellor’s designee.
2103.13 The student, his or her parent, guardian or duly authorized representative shall appear
at the hearing to represent the student. One of these individuals shall be given the opportunity to
present the student’s case and, upon request, to question the involved teacher and to be duly
informed of the panel’s recommendations.
2103.14 Each appeals panelist, including the chair, shall have an equal vote; however, two
(2) voting members can render a decision.
2103.15 In the case of a tie vote, the initial grade is deemed to be upheld by the Appeals
Panel.
2103.16 The Appeals Panel's recommendation shall be forwarded immediately to the principal or
Chancellor’s designee who shall issue the Panel's decision within ten
(10) school days after the hearing.
2103.17 The student, his or her parent or guardian, or duly authorized representative may

appeal the decision of the Appeals Panel by writing to the Chancellor’s official grade appeal
designee within ten (10) school days after receipt of the decision.
2103.18 When an appeal is filed pursuant to § 2103.17, the Chancellor’s official grade appeal
designee shall review all documentation submitted and issue the final administrative decision in
the matter.
2103.19 The following procedural guidelines shall apply to appeals reviewed pursuant to §
2103.18:
(a) The burden to show why the grade(s) in question should be changed shall be on the student or
his or her parent or guardian;
(b) Strict rules of evidence shall not apply; and
(c) A written determination shall be issued within five (5) school days of the review and
consideration of all submitted evidence.

2103.1 De conformidad con la ley, los maestros guías activarán el protocolo
correspondiente de intervención por absentismo escolar que se les aplicará a aquellos estudiantes
de primaria y secundaria de las Escuelas Públicas del Distrito de Columbia (DCPS, por sus siglas en
inglés) que falten de forma injustificada a un bloque de clases en el que se haya tomado la
asistencia, en cumplimiento con la Ley de Asistencia Escolar Obligatoria.
2103.2 Los horarios estudiantiles de media jornada en las DCPS se regirán por la siguiente
normativa:
(a) se les permitirá tener un horario de media jornada a aquellos estudiantes de diecisiete (17)
años de edad en adelante que trabajen y cuyo horario laboral coincida con la jornada escolar
regular;
(b) se les permitirá tener un horario de media jornada a aquellos estudiantes de secundaria que
asistan a algún instituto universitario o alguna universidad local;
(c) la escuela local debe corroborar que el estudiante tenga un trabajo y su horario laboral o
que esté estudiando y su horario de estudio universitario para poder aprobar el horario de media
jornada. Aquellos estudiantes que no trabajen ni asistan a algún instituto o universidad local
tendrán un horario a tiempo completo, al igual que aquellos cuyos trabajos comiencen después del
horario regular de clases.
2103.3 Aquellos estudiantes de las DCPS que acumulen treinta (30) faltas injustificadas o más
durante todo un año escolar pasarán de grado únicamente si cumplen con la excepción establecida en
el artículo 38-781.02(c) o 38-781.05 del Código Oficial del D.C.
2103.4 Se les enviará una notificación escrita a aquellos estudiantes de secundaria de las DCPS
que tengan diez (10) faltas injustificadas en alguna asignatura, mediante la que se les avisará que
están en riesgo de ser aplazados por inasistencia u obtener la calificación «FA» en dicha
asignatura si acumulan más de treinta (30) faltas injustificadas, a menos que exista una excepción
al respecto.
2103.5 Se les enviará una segunda advertencia escrita a aquellos estudiantes de secundaria de
las DCPS que tengan quince (15) faltas injustificadas en alguna asignatura, mediante la que se les
avisará que están en riesgo de ser aplazados por inasistencia u obtener la calificación «FA» en
dicha asignatura si acumulan más de treinta (30) faltas injustificadas.
2103.6 Aquellos estudiantes de secundaria de las DCPS que acumulen más de treinta (30) faltas
injustificadas en una asignatura durante todo un año escolar reprobarán y

perderán el crédito de esa asignatura.
2103.7 El padre o la madre de algún estudiante que haya aplazado una o varias asignaturas por
inasistencia puede interponer un recurso escrito de apelación, en representación de este.
2103.8 De conformidad con el artículo 2103.7, se consignará ante el director de la escuela
donde asiste estudiante o delegado del jefe del distrito escolar el recurso de apelación
interpuesto, en un periodo de diez (10) días lectivos, luego de haber obtenido la(s)
calificación(es) reprobatoria(s).
2103.9 Tras recibir el recurso de apelación, interpuesto de conformidad con el artículo 2103.7,
el director o delegado del jefe del distrito escolar nombrará a un comité de apelaciones y le
reenviará todas las solicitudes de apelación al presidente del comité, en un periodo de tres (3)
días lectivos.
2103.10 El comité de apelaciones mencionado en el artículo 2103.9 estará conformado por no menos
de (3) miembros que se elegirán de una de las siguientes categorías y uno de los cuales pertenecerá
a la categoría (a):
(a) persona designada por el director o delegado del jefe del distrito escolar, quien ocupará el
cargo de presidente del comité;
(b) orientador;
(c) presidente de algún departamento;
(d) maestro, que no sea el mismo involucrado en el asunto sobre el cual se está apelando;
(e) empleado encargado de la asistencia; o
(f) empleado administrativo de la oficina central de las DCPS.
2103.11 De ser preciso, se podrá substituir a no más de dos (2) miembros del comité de
apelaciones descrito en el artículo 2103.10.
2103.12 El comité de apelaciones sostendrá una audiencia en un periodo de diez (10) días
lectivos después del nombramiento de sus miembros por parte del director o delegado del jefe del
distrito escolar.
2103.13 El estudiante o su padre, madre, tutor o representante debidamente facultado comparecerá
en la audiencia en su representación. A una de estas personas se les dará la oportunidad de
presentar el caso del estudiante y, a petición propia, de interrogar al maestro involucrado en
el caso; además, recibirán toda la información correspondiente a las recomendaciones del comité.

2103.14 Cada miembro del comité, incluso el presidente, tendrá un voto del mismo valor que los
demás; sin embargo, con el voto de dos (2) miembros se puede dar a un veredicto.
2103.15 En caso de que haya un empate en la votación, el comité de apelaciones debería tener en
cuenta el primer resultado obtenido.
2103.16 La recomendación del comité de apelaciones se le enviará inmediatamente al director o
delegado del jefe del distrito escolar, quien emitirá una notificación que contenga el veredicto
del comité, en un periodo de diez (10) días lectivos después de haberse sostenido la audiencia.
2103.17 El estudiante o su padre, madre, tutor o representante debidamente facultado puede
apelar la decisión del comité de apelaciones, mediante un escrito dirigido al delegado oficial del
jefe del distrito escolar para las apelaciones relacionadas con las calificaciones, en un periodo
de diez (10) días lectivos tras la recepción del veredicto.
2103.18 Cuando se interpone un recurso de apelación, de conformidad con el artículo 2103.17, el
delegado oficial del jefe del distrito escolar para las apelaciones relacionadas con las
calificaciones analizará todos los documentos consignados y emitirá un veredicto administrativo
final sobre el asunto.
2103.19 Los lineamientos a continuación serán pertinentes en lo que respecta a las apelaciones
analizadas de conformidad con el artículo 2103.18:
(a) el estudiante o su padre, madre o tutor tienen la responsabilidad de demostrar la razón por
la cual se debe(n) cambiar la(s) calificación(es) en cuestión;
(b) no aplicará ningún tipo de norma probatoria estricta; y
(c) se emitirá una decisión escrita en un periodo de cinco (5) días lectivos después de la
revisión y análisis de todas las pruebas consignadas.
