La police s'est rendue mercredi chez Bleuette Dupin, soupçonnée d'héberger deux enfants d'une sans-papiers, en voie d'expulsion, sur laquelle elle avait fait un reportage.
La police a perquisitionné, mercredi 24 août, le domicile d’une journaliste de Radio France Bleue Bourgogne, dans le cadre d’une enquête sur la disparition des enfants d'une ressortissante congolaise qui doit être expulsée.
Bleuette Dupin avait rencontré Barbe Makombo Mbelu pour un reportage diffusé sur Radio Bleue Auxerre le 23 août.
La mère de famille est assignée à résidence dans l'attente d'une reconduite à la frontière. Ses deux aînés de 14 et 15 ans se sont enfuis, "terrorisés à l’idée d’être expulsés vers la RDC où leur père a disparu, où leur mère a subi de graves sévices et est toujours recherchée", selon un communiqué diffusé mercredi par RESF (le Réseau national des militants, collectifs d’établissements, syndicats et associations pour l’information et le soutien aux jeunes scolarisés étrangers sans papiers).
La police est venue interroger Barbe Makombo Mbelu mardi. Elle a "relevé les numéros de téléphone figurant sur son portable et dans son agenda (sans d’ailleurs l’avoir informée du cadre juridique de cette intervention, ni avoir produit de mandat) et, parmi eux, celui de la journaliste… immédiatement soupçonnée d’héberger les enfants", raconte le texte du collectif.
Mobilisation à Radio France
Dès mercredi, une intersyndicale des journalistes de Radio France (CFDT, SNJ, SNJ-CGT, SJA-FO, SUD) s’est constituée. Dans un communiqué, elle dénonce une "pression gravissime, et totalement contraire au principe de la liberté de la presse" et demande "au Président de Radio France d’intervenir au plus haut niveau et d’assister Bleuette Dupin dans les suites éventuelles de cette affaire".
"Jusqu’à ce jour, il arrivait malheureusement que des journalistes soient entendus, voire mis en examen pour refus de révéler leurs sources. Cette fois la justice va plus loin. Elle décrète que le fait de citer une personne, et donc d’établir des contacts avec elle, nous rend complice de ses actes !", s'indigne l'intersyndicale.
L’intersyndicale précise également demander "audience au Ministre de la Justice, et au Président de la République".

On Wednesday 24 August, police searched the home of Bleuette Dupin, a journalist at Radio France Bleu Bourgogne. She was suspected of housing two missing children of a sans-papiers woman due to be deported to the Democratic Republic of Congo on whom she had covered a story.
Bleuette Dupin met Barbe Makombo Mbelu as part of a report aired on Radio Bleue Auxerre on 23 August.
The mother of the family is under house arrest as part of deportation proceedings. Her two eldest children, aged 14 and 15, have run away, ‘terrorised by the idea of being deported to the Democratic Republic of Congo, where their father has disappeared and where their mother has suffered serious physical abuse and is still being hunted,’ according to a press release sent out on Wednesday by the RESF [1].
The police went to question Barbe Makombo Mbelu on Tuesday. They ‘found telephone numbers on her mobile phone and in her diary (without informing her of the legal basis of this action, nor producing a warrant), and among the numbers was that of the journalist... who was immediately suspected of housing the children,’ we were told by the collective.
On Wednesday, unions for journalists at Radio France (CFDT, SNJ, SNJ-CGT, SJA-FO, SUD) joined together to condemn this ‘extremely serious pressure, which is totally contrary to the principle of freedom of the press,’ and criticised the way in which the law ‘decrees that the fact of quoting a person, and therefore establishing contact with him or her, makes us complicit in his or her actions’.

Les réunions de skinheads se multiplient dans la région. Au grand dam des maires qui jurent être mis devant le fait accompli.
Ils étaient «cent cinquante au maximum», selon la gendarmerie, «trois cents à quatre cents» d'après la mairie. Quelques-uns étaient alsaciens, mais la plupart venaient d'Allemagne, particulièrement des Länder du nord et de l'est. Du 30 juillet au 1er août, un rassemblement de skinheads néonazis s'est déroulé à Hipsheim (Bas-Rhin), un village de huit cents habitants posé au milieu des champs de maïs de la plaine d'Alsace, à une quinzaine de kilomètres de Strasbourg. Cette démonstration de force est intervenue entre deux nouvelles profanations de sépultures dans la région : le 28 juillet, au cimetière juif de Saverne, et le 6 août, dans le carré musulman d'un cimetière militaire de Strasbourg, une quarantaine de tombes au total ont été recouvertes de croix gammées.
«Les gendarmes m'ont téléphoné le vendredi matin, raconte le maire, Antoine Rudloff (sans étiquette), ils m'ont dit que des skinheads convergeaient vers Hipsheim et m'ont demandé si la salle était louée pour le week-end.» La salle et le terrain de sport adjacent étaient effectivement réservés. En avril, un Alsacien a signé le contrat de location, précisant qu'il souhaitait organiser «un tournoi de football suivi d'un repas convivial». Quelques matches ont bien eu lieu le samedi après-midi. Ils ont surtout été précédés et suivis de soirées alcoolisées au cours desquelles les participants ont chanté à la gloire du IIIe Reich, hurlé force Sieg Heil ! et pogoté au son d'un groupe de rock allemand qui avait accroché derrière la scène un drapeau sur lequel figuraient l'aigle impérial et le slogan Elsass beim Reich («l'Alsace à l'Empire»).
Dans sa mairie, Antoine Rudloff fulmine. Il désigne les photos des hommes du village tombés au cours des deux guerres mondiales : «Plus jamais ça, on disait ! Enfin, on le dit toujours.» Le maire n'est pas allé à la rencontre des skinheads : «Je ne veux pas discuter avec ces gens-là ! Et ce n'était pas la peine d'envenimer les choses. J'avais peur qu'ils mettent à sac le village.» Les skinheads n'ont pas ravagé Hipsheim et ils ont même rendu les installations dans l'état où ils les avaient trouvées. Officiellement, aucun débordement n'a été signalé. «On a regardé ça de très près (mais sans pénétrer à l'intérieur de la salle, considérée comme un espace privé, ndlr). Il n'y a eu aucun problème de voie publique, aucun problème d'ordre public ni aucun problème d'ordre judiciaire», énumère le capitaine Jean-Pierre Potot, commandant de la compagnie de gendarmerie de Sélestat.
Agression.
RAS, donc. Sauf pour un habitant du village qui dit avoir été agressé. Il s'appelle Jacques (1), a 34 ans et est d'origine étrangère. Selon son récit, il revenait d'une promenade quand deux jeunes, «skins de chez skins» et saouls, l'ont interpellé. «Ils m'ont demandé de quelle nationalité j'étais. J'ai répondu Alsacien.» Plus loin, Jacques remarque un groupe d'où se détachent deux skinheads tatoués, l'un arborant le visage d'Hitler sur le ventre et l'autre un swastika sur le cou. Jacques s'éloigne de quelques mètres mais reçoit une bouteille sur la nuque. A terre, on lui assène encore un coup de bâton sur le bras. Une dispute éclate alors entre les néonazis, lui permettant de partir. Une cicatrice et des hématomes témoignent de l'altercation, mais Jacques refuse de déposer plainte. Parce qu'il ne saurait reconnaître ses agresseurs et «par crainte de représailles».
Le rassemblement d'Hipsheim n'est pas le premier de ce type dans la région. Quatre autres ont été enregistrés dans le Bas-Rhin et le sud de la Moselle ces deux dernières années, réunissant parfois près de 1 000 skinheads. Le scénario est toujours le même. Un Français ou un Allemand réservent une ou plusieurs salles, qui servent à la fois de leurres et de solutions de repli en cas de difficultés. Un prétexte anodin est avancé (des «fiançailles», un «anniversaire» ou un «concours de fléchettes»). Au final, les maires «plumés», selon le mot d'un d'entre eux, se retrouvent démunis face à un concert attirant des centaines de néonazis venus de France, d'Allemagne, de Suisse et de Belgique et encadrés par un service d'ordre qui évite tout débordement. Aucune interpellation n'a eu lieu au cours de ces rassemblements.
«A partir du moment où ils sont là, vous ne pouvez plus rien faire», déplore Edmond Mahler, maire de Ringendorf, où huit cents skinheads se sont réunis en avril 2003 pour fêter l'anniversaire de la naissance d'Hitler. Comme ses collègues, il relève qu'à l'intérieur de la salle, les skinheads peuvent se livrer en toute impunité à l'apologie du nazisme et dénonce un «vide juridique».
Propositions.
Daniel Hoeffel, sénateur UMP du Bas-Rhin et président de l'Association des maires de France (AMF), lui emboîte le pas : «Il y a eu une succession d'événements qui ne nous permettent pas de laisser plus longtemps les maires seuls face à ces problèmes.» La question devrait figurer à l'ordre du jour de la prochaine réunion de bureau de l'AMF.
Reste à formuler des propositions concrètes. Pour l'avocat Raphaël Nisand, président local de la Licra, celles-ci ne peuvent être que liberticides. «La solution, ce serait de créer un délit de réunion néonazie, estime-t-il. Ça s'oppose au principe de la liberté d'expression et de réunion, mais tout l'arsenal antiraciste est fondé sur cela.»

Skinhead gatherings are on the increase in the region, to the great displeasure of mayors who are kicking themselves for being caught out by the events.
There were ‘one hundred and fifty of them at most’, according to the police, and ‘three to four hundred’ in the eyes of the council. Some were from Alsace, but most came from Germany, particularly from the northern and eastern Länder. From July 30 to August 1, a neonazi skinhead rally took place at Hipsheim (Bas-Rhin department), a village of eight hundred inhabitants in the middle of fields of maize on the Alsace plain, around fifteen kilometres from Strasbourg. This display of strength took place between the desecration of two more graves in the region: on July 28, at the Jewish cemetery of Saverne, and on August 6, in the Muslim area of a Strasbourg military cemetery, with a total of around forty graves being covered in swastikas.
‘The police phoned me on Friday morning,’ says the mayor, Antoine Rudloff (independent candidate). ‘They told me that skinheads were converging on Hipsheim and asked me if the hall had been hired for the weekend.’ The hall and the adjacent playing field were indeed reserved. In April, a man from Alsace had signed a contract to hire the hall and grounds, stating that he wanted to organise a football tournament, followed by a convivial dinner.’ A few matches did indeed take place on Saturday afternoon. They were certainly preceded and followed by drunken evenings during which the participants sang in praise of the Third Reich, yelled ‘Sieg Heil!’ profusely and moshed to the sound of a German rock group who had hung up a flag behind the stage, showing the imperial eagle and the slogan ‘Elsass beim Reich’ (‘Alsace for the Reich’).
In his council offices, Antoine Rudloff was seething. He pointed to photos of the men from the village who had died during the two world wars: ‘Never again, we used to say! Well, we still say it.’ The mayor didn’t go to meet the skinheads: ‘I don’t want to have a discussion with those people! And it wasn’t worth making things worse. I was afraid they would ransack the village.’ The skinheads didn’t ravage Hipsheim and they even left the facilities in the condition in which they found them. Officially, no overspill was reported. ‘We were watching very closely (but without entering the hall, which is deemed a private space - Ed.). There were no problems on the roads, no problems with public order, nor any problems with the law,’ notes captain Jean-Pierre Potot, head of the Sélestat gendarmerie police force.
Attack.
Nothing to report, then. Except for a villager who claims to have been attacked. His name is Jacques [1], is 34 years old and of foreign origin. According to his account, he was returning from a walk when two youths, who were ‘proper skinheads’ and drunk, called out to him. ‘They asked me what nationality I was. I replied, saying that I was from Alsace.’ Further on, Jacques noticed a group, with two tattooed skinheads standing out - one sporting Hitler’s face on his stomach and the other with a swastika on his neck. Jacques moved away a few metres but received a bottle to the back of his neck. On the ground, he was then hit on the arm with a stick. An argument then started between the neonazis, allowing him to get away. A scar and bruises bear witness to the altercation, but Jacques is refusing to make a complaint – because he wouldn’t be able to identify his attackers and ‘for fear of reprisals’.
The Hipsheim rally isn’t the first of its kind in the area. Four others have been recorded in the past two years in the Bas-Rhin department and in the south of the Moselle department, sometimes bringing together almost 1,000 skinheads. The scenario is always the same. A Frenchman or a German reserves one or several halls, which act both as a decoy and a withdrawal solution if difficulties arise. A safe pretext is given (an ‘engagement party’, a ‘birthday’ or a ‘darts competition’). Finally, the ‘duped’ mayors – to use one mayor’s words – find themselves helpless in the face of a concert drawing hundreds of neonazis from France, Germany, Switzerland and Belgium, and which is supervised by stewards preventing any overspill from occurring. No arrests were made during these rallies.
‘From the moment they arrive, you can’t do anything,’ complains Edmond Mahler, mayor of Ringendorf, where eight hundred skinheads met in April 2003 to celebrate Hitler’s birthday. Like his colleagues, he notes that inside the hall, the skinheads can justify Nazism with complete impunity, and he denounces this ‘legal loophole’.
Proposals.
Daniel Hoeffel, UMP senator for the Bas-Rhin department and president of the Association des maires de France (AMF) [Association of French Mayors], agrees: ‘There has been a series of events which hasn’t allowed us to let the mayors deal with these problems.’ The matter should be on the agenda at the next AMF meeting.
All that remains is to come up with some concrete proposals. For the lawyer Raphaël Nisand, local chairman of the Licra organisation, these proposals can only go against civil liberties. He believes that ‘the solution would be to make it an offence to hold a neonazi gathering. This conflicts with the principles of freedom of expression and of association, but that’s what the whole of the antiracist mobilisation is founded on.’
