• Se establece una clausula resolutoria (clausula V nueve) pudiendo el vendedor instar la resolución por incumplimiento en cualquiera de los pagos por parte de comprador. Así mismo se establece la resolución sin mayores requerimientos si habiendo sido el comprador requerido para escriturar no compareciere para el otorgamiento de la escritura pública, haciendo suyas la parte vendedora la totalidad de las cantidades percibidas hasta la fecha en concepto de daños y perjuicios. Se establece también la posibilidad de instar la resolución por el comprador, con devolución de las cantidades entregadas con interés, si la vivienda no se hubiese entregado en la fecha prevista y no se optase por admitir la demora.

• A termination clause is set (clause V nine) for the seller to repudiate the agreement in the event that the buyer failed to meet payment obligations. Furthermore, in the event that the buyer did not appear to formalize the deed after being summoned to do so, the seller could terminate the agreement without further summons and will keep all amounts received as damages so far. If the property was not delivered at the deadline and the buyer did not accept the delay, the buyer could repudiate the agreement and be refunded all instalments including any corresponding interest. |
