SENTENCIA
En la Villa de Madrid, a once de Octubre de dos mil doce.
Visto por la Sala Primera del Tribunal Supremo, integrada por los Magistrados al margen indicados, el recurso de casación contra la sentencia dictada en grado de apelación por la Sección Cuarta de la Audiencia Provincial de Vizcaya, como consecuencia de autos de juicio de incapacidad, seguidos ante el Juzgado de Primera Instancia número 14 de Familia de Bilbao, cuyo recurso fue preparado ante la citada Audiencia por la representación procesal don Miguel, la procuradora doña Ana Caro Romero. Es parte el Ministerio Fiscal.
ANTECEDENTES DE HECHO
PRIMERO .- 1.- El Ministerio Fiscal, formuló demanda de juicio verbal sobre incapacidad parcial de don Miguel y alegando los hechos y fundamentos de derecho que consideró de aplicación, terminó suplicando al Juzgado se dictara sentencia por la que se declare la incapacidad parcial de don Miguel .
2.- El procurador don Alberto Arenaza Artabe, en nombre y representación del Instituto Tutelar de Bizkaia, contestó a la demanda y oponiendo los hechos y fundamentos de derecho que consideró de aplicación, terminó suplicando al Juzgado dictase en su día sentencia por la que se declare la incapacidad de don Miguel, si así quedase acreditado en la prueba que se practique en el acto de la vista, estableciéndose los límites y extensiones de la tutela, designando tutor en la misma sentencia de conformidad con lo solicitado en el cuerpo del presente escrito y resolviendo acerca de si procede el internamiento del incapaz, de conformidad con lo que acredite en la prueba que se practique en el acto de la vista.
3.- Previos los trámites procesales correspondientes y práctica de la prueba propuesta por las partes y admitidas la Ilma. Sra. Magistrada-Juez del Juzgado de Primera Instancia número 14 de Bilbao, dictó sentencia con fecha 28 de diciembre de 2009, cuya parte dispositiva es como sigue: FALLO: Que estimando como estimo la demanda interpuesta por el Ministerio Fiscal:
Debo DECLARAR y DECLARO a los efectos procedentes en derecho que D. Miguel, con D.N.I. n° NUM000, nacido el NUM001 de 1.970 en Bilbao (Bizkaia), es PARCIALMENTE INCAPAZ para el control terapéutico de sus enfermedades y el sometimiento al tratamiento, así como para la administración y disposición de sus bienes, a excepción de dinero de bolsillo. Igualmente es incapaz para usar armas y conducir. En tal sentido necesitará la asistencia del curador, sin necesidad de autorización judicial para los siguientes actos:
-Para decidir su permanencia en residencia o su internamiento en un establecimiento de salud mental o de educación o formación especial.
-Para enajenar o gravar bienes inmuebles, establecimientos mercantiles o industriales, objetos preciosos y valores mobiliarios, o celebrar contratos o realizar actos que tengan carácter dispositivo, susceptibles de inscripción.
-Para renunciar derechos, así como transigir o someter a arbitraje cuestiones.
-Para aceptar sin beneficio de inventario cualquier herencia, a para repudiar ésta o las liberalidades.
-Para hacer gastos extraordinarios en los bienes.
-Para entablar demanda, salvo en los asuntos urgentes o de escasa cuantía.
-Para ceder bienes en arrendamiento por tiempo superior a seis años.
-Para dar y tomar dinero a préstamo.
-Para disponer a título gratuito. de bienes o derechos.
-Para ceder a terceros los créditos o adquirir a. título oneroso los créditos de terceros.
-Para proceder a la partición o a la división de la herencia.
Se nombra CURADOR de D. Miguel al INSTITUTO TUTELAR DE BIZKAIA, a quien se hará saber el nombramiento para que, previa citación, comparezca ante este juzgado a fin de aceptar y jurar o prometer el cargo, darle posesión del mismo y proveerle del correspondiente título. Verificado, inscríbase la Curatela en el Registro Civil de Bilbao remitiéndole testimonio de esta resolución en el que conste la aceptación y juramento o promesa del cargo, y hágasele saber que deberá informar anualmente sobre la situación del incapacitado y rendir cuentas anuales de su gestión a fecha 31 de Diciembre de cada anualidad. Dicha rendición consistirá en una relación detallada de los gastos e ingresos acaecidos en el patrimonio del cuatelado relación que habrá de ir acompañada de documentos originales; justificativos de los mismos y se hará entrega en el Juzgado Decano de los de Primera Instancia de esta capital c/:Barroeta Aldamar n° 10 bajo, en la primera quincena del mes de Enero.
Se prohíbe expresamente al curador: a) recibir liberalidades del pupilo o causahabientes mientras no se haya aprobado. definitivamente su gestión; b) representar al pupilo cuando en el mismo acto intervenga en nombre propio o de un tercero y existiera conflicto de intereses, y c) adquirir por título oneroso bienes del sujeto a curatela o transmitirle por su parte bienes por igual título.
Incóense el correspondiente expediente de jurisdicción voluntaria de CONSTITUCION DE CURATELA.
Líbrese el oportuno despacho al Encargado del Registro Civil a la que se acompañara testimonio de la misma, a fin de que proceda a su anotación marginal en la inscripción de nacimiento, debiendo remitir a este Juzgado testimonio del acta de anotación producido.
Todo ello sin expresa imposición de costas.
SEGUNDO .- Interpuesto recurso de apelación por la representación procesal de don Miguel, la Sección Cuarta de la Audiencia Provincial de Bilbao (BIZKAIA), dictó sentencia con fecha dos de noviembre de 2011, cuya parte dispositiva es como sigue: FALLAMOS: Estimando parcialmente el recurso de apelación interpuesto por don Miguel, contra sentencia dictada por el Ilmo. Sr. Magistrado Juez de Primera Instancia nº 14 de los de Bilbao en autos de incapacidad nº 1259/2009 de que el rollo dimana, debemos declarar y declaramos que el recurrente es capaz para a) administrar su pensión y b) ejercicio del derecho de sufragio activo, se confirman los restantes pronunciamientos de la sentencia recurrida, sin dictar particular pronunciamiento en costas.
Devuélvase a la parte recurrente el depósito constituido para recurrir, expidiéndose por el Secretario Judicial el correspondiente mandamiento de devolución.
TERCERO .- 1.- Contra la expresada sentencia preparó y después interpuso recurso de casación la representación procesal de don Miguel con apoyo en los siguientes MOTIVOS: ÚNICO.- Al amparo el art. 477.2.1. de la LEC, al haberse dictado sentencia en segunda instancia por la audiencia Provincial de Vizcaya que afecta a la tutela judicial civil de los derechos fundamentales recogidos en los art 10 derecho al libre desarrollo de la personalidad, 14 derecho a la igualdad y 19 derecho a la libertad de residencia de la Constitución Española, infracción del art. 200 del Código Civil.
Remitidas las actuaciones a la Sala de lo Civil del Tribunal Supremo, por auto de fecha 8 de mayo de 2012 se acordó admitir el recurso interpuesto y dar traslado a la parte para que formalizaran su oposición en el plazo de veinte días.
2.- Admitido el recurso y evacuado el traslado conferido, el Ministerio Fiscal presentó escrito en el que tras afirmar que el recurrente necesita un apoyo, entiende que quizás fuese bueno que esta Sala razonase sobre la institución jurídica del apoyo y aún en el presente caso, sustituya la curatela, que tiene una regulación en el Código Civil que no debe ser deformada (para no distorsionar la seguridad del tráfico Jurídico), por la figura jurídica del apoyo.
3.- No habiéndose solicitado por todas las partes la celebración de vista pública, se señaló para votación y fallo el día 2 de Octubre del 2012, en que tuvo lugar.

FUNDAMENTOS DE DERECHO
PRIMERO.- El Ministerio Fiscal interpuso demanda promoviendo la declaración de incapacidad parcial de d. Miguel, a instancias de los familiares de este último, y propuso la designación de curador para que pudiera asistirle en las cuestiones relativas al control terapéutico de su enfermedad y el sometimiento al tratamiento, así como para la administración y disposición de sus bienes, a excepción de dinero de bolsillo.
La Sentencia de primera instancia estimó íntegramente la demanda. Como consecuencia, declaró la incapacidad parcial de d. Miguel para las cuestiones relativas al control terapéutico de su enfermedad y el sometimiento al tratamiento, así como para la administración y disposición de sus bienes, a excepción de dinero de bolsillo, siendo declarado incapaz para conducir y usar armas. Como curador designó al Instituto Tutelar de Bizkaia.
D. Miguel interpuso recurso de apelación que fue estimado en el único sentido de declarar que es capaz para administrar su pensión y para ejercitar el derecho de sufragio activo. En lo demás confirmó la sentencia de primera instancia. Argumenta la sentencia de apelación que si bien es cierto que los parientes en su día instantes de la incapacidad manifestaron en la correspondiente audiencia que el recurrente vive de forma independiente de sus padres; que dispone de un domicilio propio; que se han estabilizado sus relaciones con la familia y que se advierte una conducta mucho más ordenada y coherente que la que venía observando con anterioridad, también lo es que del informe forense y del análisis de un cabello del propio recurrente se desprende que "d. Miguel sufre trastorno de la personalidad no especificado, trastorno por dependencia al alcohol y trastorno depresivo reactivo, patologías que limitan las capacidades de querer, entender y libre determinación del recurrente. Estima que su capacidad está limitada para el gobierno de su persona, toma de decisiones transcendentales, área de salud y bienes. Del informe se concluye que la incapacidad parcial debe ser mantenida..."
Recurre en casación Miguel.
SEGUNDO.- En el escrito de interposición, tras citar como precepto legal infringido el artículo 200 del Código Civil, se alega la existencia de interés casacional por oposición a la jurisprudencia del Tribunal Supremo, a cuyo fin cita dos Sentencias de esta Sala, a saber, las sentencias de fechas 14 de julio de 2004 y 28 de julio de 1998, la cuales establecen que en materia de incapacidad debe existir siempre un criterio restrictivo y que tal doctrina ha sido vulnerada por la resolución recurrida por cuanto el consumo excesivo de alcohol no puede considerarse como elemento incapacitante, ni siquiera de forma parcial, para impedir al recurrente gobernarse por sí mismo.
Se desestima.
Las causas de incapacidad, dice la sentencia de 29 de abril de 2009, están concebidas en nuestro derecho, a partir de la reforma de 1983, como abiertas, de modo que, a diferencia con lo que ocurría en la antigua redacción del Código civil, no existe una lista, sino que el art. 200 CC establece que "son causas de incapacitación las enfermedades o deficiencias de carácter físico o psíquico que impidan a la persona gobernarse por sí misma". Es evidente que el art. 322 CC establece una presunción de capacidad que se aplica a toda persona mayor de edad, que sólo desaparece cuando se prueba la concurrencia de una enfermedad de carácter persistente que permita concluir que aquella persona no se halla en situación de regir su persona, administrar sus bienes y cumplir con las restantes funciones de una persona media. Así se ha venido considerando por la jurisprudencia de esta Sala en sentencias de 19 mayo 1998, 26 julio 1999, 20 noviembre 2002, 14 julio 2004; como afirma la sentencia de 28 julio 1998,"(...) para que se incapacite a una persona no es sólo suficiente que padezca una enfermedad persistente de carácter físico o psíquico (...) lo que verdaderamente sobresale es la concurrencia del segundo requisito, o sea, que el trastorno tanto sea permanente como que oscile en intensidad, impida gobernarse a la afectada por sí misma".
Pues bien, no se discute que la incapacitación de una persona, total o parcial, debe hacerse siguiendo siempre un criterio restrictivo por las limitaciones de los derechos fundamentales que comporta. Lo que se cuestiona realmente es si ha quedado o no acreditado que exista una enfermedad psíquica incapacitante que impida a quien recurre gobernarse por sí mismo, y ello es algo que resulta de la prueba que ha sido practicada, con la garantía del examen del ahora incapaz y audiencia de los parientes más próximos, de la que infiere que padece trastorno depresivo secundario, trastorno por abuso y dependencia al alcohol y trastorno 4 de la personalidad que limitan las capacidades de querer, entender y libre determinación, de tal forma que su capacidad está limitada para el gobierno de su persona, toma de decisiones transcendentales, área de salud y bienes. Ninguna contradicción se advierte en la valoración que la sentencia hizo de los hechos. Una cosa es la opinión de los familiares que refieren una conducta más ordenada y coherente de la que venía observando, y otra distinta que esta aparente mejoría deje sin contenido el trastorno de la personalidad que resulta de la prueba.
La STS 29 de septiembre de 2009 (Rec núm. 1259/2006 ), de Pleno, en materia de incapacidad y en la interpretación de las normas vigentes a la luz de la Convención sobre los Derechos de las Personas con Discapacidad, firmada en Nueva York el 13 de diciembre de 2006, ratificada por España el 23 de noviembre de 2007, relativa a si, como consecuencia de la entrada en vigor de esta Convención, debe considerarse contraria a la misma la normativa relativa a la incapacitación como medida de protección de las personas incapaces, señala lo siguiente: " la incapacitación, al igual que la minoría de edad, no cambia para nada la titularidad de los derechos fundamentales, aunque sí que determina su forma de ejercicio. De aquí, que deba evitarse una regulación abstracta y rígida de la situación jurídica del discapacitado... Una medida de protección como la incapacitación, independientemente del nombre con el que finalmente el legislador acuerde identificarla, solamente tiene justificación con relación a la protección de la persona". El sistema de protección establecido en el Código Civil sigue por tanto vigente, aunque con la lectura que se propone: «1.° Que se tenga siempre en cuenta que el incapaz sigue siendo titular de sus derechos fundamentales y que la incapacitación es sólo una forma de protección. 2.° La incapacitación no es una medida discriminatoria porque la situación merecedora de la protección tiene características específicas y propias. Estamos hablando de una persona cuyas facultades intelectivas y volitivas no le permiten ejercer sus derechos como persona porque le impiden autogobernarse. Por tanto no se trata de un sistema de protección de la familia, sino única y exclusivamente de la persona afectada.»
Todo ello se cumple en este caso a partir unos hechos que se mantienen inalterables en casación y que resultan determinantes para que se aplique la curatela, reinterpretada a la luz de la citada Convención, desde un modelo de apoyo y de asistencia y el principio del superior interés de la persona con discapacidad, que, manteniendo la personalidad, requiere un complemento de su capacidad, precisamente para proteger su personalidad, en palabras de la propia Convención.
TERCERO.- Consecuencia de lo razonado es la desestimación del recurso y la imposición de las costas a la recurrente, de conformidad con lo establecido en los artículos 394 y 398, ambos de la Ley de Enjuiciamiento Civil .
Por lo expuesto, en nombre del Rey y por la autoridad conferida por el pueblo español.
FALLAMOS
Desestimar el recurso formulado por la procuradora doña Diana Mª Gonzalez Doiz, en la representación que acredita don Miguel, contra la sentencia dictada por la Sección cuarta de la Audiencia Provincial de Bizkaia de 2 de noviembre de 2011, con expresa imposición de las costas causadas a la recurrente.
Líbrese a la mencionada Audiencia la certificación correspondiente, con devolución de los autos y Rollo de apelación en su día remitidos.
Así por esta nuestra sentencia, que se insertará en la COLECCIÓN LEGISLATIVA pasándose al efecto las copias necesarias, lo pronunciamos, mandamos y firmamos Juan Antonio Xiol Rios. JUDGMENT
In the City of Madrid, on October 11th, 2012.
The First Chamber of the Supreme Court, composed of the Judges designated in the margin, heard the appeal against the appeal judgment issued by the Fourth Section of the Provincial Court of Biscay, as a result of the disability trial proceedings before the Court of First Instance, number 14 of Bilbao, the appeal of which was prepared before the aforementioned Hearing by Mr. Miguel’s procedural representation, legal representative Ms. Ana Caro Romero. The Public Prosecutor is present.
FACTS AND PROCEDURAL BACKGROUND
FIRST .- 1.- The Public Prosecutor filed a petition for the oral proceedings regarding the partial disability of Mr. Miguel and, stating the facts and legal grounds that he deemed applicable, ended up pleading with the Court to issue a judgment declaring that Mr. Miguel is partially disabled.
2.- The legal representative, Mr. Alberto Arenaza Artabe, in name and on behalf of the Tutelar Institute of Biscay (Instituto Tutelar de Bizkaia), responded to the petition and, opposing the facts and legal grounds deemed applicable, ended up pleading with the Court to issue a judgment, when applicable, declaring that Mr. Miguel is partially disabled, if it would be attested in the evidence exhibited at the hearing, establishing the limits and extensions of guardianship, designating a guardian in the same judgment as requested in the body of this document, and resolving whether the placement of the disabled person is appropriate, in accordance with what is attested in the evidence exhibited at the hearing.
3.- After the corresponding procedural steps, the gathering of evidence proposed by the parties, and the parties were admitted, the honorable Judge of the Court of First Instance, number 14 of Bilbao, issued judgment on December 28, 2009, whose ruling is as follows: Whereas I uphold the suit filed by the Public Prosecutor:
I DECLARE for all legal intents and purposes that Mr. Miguel, with ID no. NUM000, born on the NUM001 of 1970 in Bilbao (Biscay), is PARTIALLY UNABLE to undergo therapy to control his illnesses and to undergo medical treatment, and is unable to administer and dispose of his assets, with the exception of money on-hand. Likewise, he is unable to use weapons and drive. To that effect, he shall require the assistance of his guardian, without requiring judicial authorization for the following acts:
-To decide his residential permanence or his placement in a mental health facility, education institute, or special training establishment.
-To dispose of, transfer, or encumber immovable assets, commercial or industrial establishments, precious objects, and transferable securities, or to enter into contracts or carry out registrable acts that are operative in nature.
-To waive rights, as well as to compromise, settle, or submit issues to arbitration.
-To accept any inheritance without confirmation, or to renounce said inheritance or liberalities.
-To make extraordinary expenses on assets.
-To file suits, except in urgent cases or those related to small claims.
-To hand over assets under lease for a period of time exceeding six years.
-To give and take out loans.
-To freely dispose of rights and assets.
-To assign credits to third-parties or purchase credits from third-parties.
-To go forth with the allotment or division of estate.
The GUARDIAN of Mr. Miguel is appointed to the TUTELAR INSTITUTE OF BISCAY, to which the appointment shall be made known so that, having been given notice, it may appear before this court in order to accept and swear or promise to undertake the position, receiving its possession and being given the corresponding title. Verified, the Guardianship is to be registered in the Civil Registry of Bilbao, which is to be sent testimony of this resolution comprising the acceptance and oath or promise to undertake the position, and to be informed that it must report on the situation of the disabled person annually and render annual accounts of his management on the date of the 31st of December of each year. Said accountability shall consist of a detailed report of the expenses and earnings befallen on the estate of the disabled person, which must be accompanied by the original documents supporting the facts and must be delivered to the Senior Court of First Instance of this capital, c/:Barroeta Aldamar no. 10, first floor, during the first half of the month of January.
It is expressly prohibited for the guardian to: a) accept donations from the conservatee or assignees without approval, especially his management; b) represent the conservatee when he intervenes on the spot on his own behalf or on behalf of a third-party and there exists a conflict of interest; and c) acquire assets from the person under guardianship for remuneration or transfer assets on his behalf in the same way.
The corresponding file for voluntary jurisdiction of the CONSTITUTION OF GUARDIANSHIP (Constitución de Curatela) is to be initiated.
Notice is to be sent to the Registrar of the Civil Registry, accompanied by the corresponding testimony, in order to amend the marginal annotation in the birth certificate. Testimony of the act of producing the annotation must be sent back to this Court.
All this without an express award of costs.
SECOND .- The appeal having been filed by the procedural representation of Mr. Miguel, the Fourth Section of the Provincial Court of Bilbao (BISCAY) issued judgment on the date of November, 2, 2011, whose ruling is as follows: WE RULE: That in partly granting the appeal filed by Mr. Miguel, against the judgment issued by the Honorable Judge of the Court of First Instance, no. 14 of Bilbao, in the disability proceedings no. 1259/2009, which give rise to this higher proceeding, we hereby declare that the appellant is capable of a) managing his pension and b) exercising the right to vote, the remaining decisions of the contested judgment are upheld, without issuing a specific ruling on costs.
The deposit provided for appeal is to be returned to the appellant and the corresponding reimbursement order is to be expedited by the Court Clerk.
THIRD .- 1.- The procedural representation of Mr. Miguel prepared and filed a cassation appeal against the aforementioned judgment with support in the following MOTIVE: Under Article 477.2.1 of the Spanish Code of Civil Procedure (Ley de Enjuiciamiento Civil), the Provincial Court of Biscay, having issued judgment in the second instance, violated Article 200 of the Civil Code by affecting the civil and legal protection of the fundamental rights included in Article 10, the right to free development of personality, Article 14, the right to equality, and Article 19, the right to freedom of residence, of the Spanish Constitution.
The interventions having been submitted to the Civil Chamber of the Supreme Court, by a ruling on the date of May 8, 2012, it was agreed to admit the filed appeal and serve notice to the party so they may draw up their opposition within a period of twenty days.
2.- The appeal having been admitted and the record being made available as ordered, the Public Prosecutor lodged a statement in which, after affirming that the appellant needs support, he sees that perhaps it was wise that this Chamber consider the legal institution of support and, even in this case, replace guardianship, which has a regulation in the Civil Code that is not to be distorted (in order to avoid distorting the security of legal affairs) by the legal figure of support.
3.- The public hearing, not having been requested by all parties to be held, was scheduled for voting and the decision on October 2, 2012, during which it took place.
The Honorable Judge, Mr. José Seijas Quintana, has been the Reporting Judge.
LEGAL GROUNDS
FIRST.- The Public Prosecutor filed a petition supporting the partial disability of Mr. Miguel to be declared, at the request of his family members, and proposed the designation of a guardian that could assist him in matters related to the therapeutic control of his illness and submission to medical treatment, as well as the administration and disposition of his assets, with the exception of money on-hand.
The Ruling of the Court of First Instance granted the petition in full. As a result, the partial disability of Mr. Miguel was declared for matters related to the therapeutic control of his illness and submission to medical treatment, as well as the administration and disposition of his assets, with the exception of money on-hand, and was incapable of using weapons and driving. The Tutelar Institute of Biscay was designated as his guardian.
Mr. Miguel filed an appeal that was upheld solely to declare that he is capable of administering his pension and exercising the right to vote. In regard to everything else, he upheld the ruling of the Court of First Instance. The ruling of the appeal argues that, although it is true that the family members seeking disability declared, in the relevant hearing, that the appellant lives independently from his parents, that he has his own residence, that his relationships with family have been stabilized, and that he is displaying much more orderly and coherent behavior than that previously observed, it is also true that the forensic report and the hair analysis of the appellant himself reveal that “Mr. Miguel suffers from unspecified personality disorder, alcohol dependence disorder, and reactive depressive disorder, illnesses that limit the appellant’s abilities to understand, express desires, and exercise free will. The ruling considers that he is limited in his abilities to self-manage, make crucial decisions, and to manage his health and assets. The report concludes that partial disability must be upheld…”

SECOND.- In the appeal application, after referencing Article 200 of the Civil Code as the legal provision violated, the existence of reversal interest in opposition of the case law of the Supreme Court is alleged, to which end it references two Rulings from this Chamber, namely the rulings on the dates of July 14, 2004, and July 28, 1998, which establish that, with regard to disability, a restrictive criterion must always exist and that such doctrine has been violated by the appealed decision inasmuch as the excessive consumption of alcohol cannot be considered a disabling factor, not even partially, in preventing the appellant from governing his own person.
It is dismissed.
The ruling of April 29, 2009, states that, since the 1983 reform, the causes of disability are conceived as open in our laws so that, in contrast with what occurred in the former drafting of the Civil Code, there does not exist a list, but rather Article 200 CC, which establishes that, “causes of disability are illnesses or physical or mental impairments that prevent the individual from governing their own person.” It is clear that Article 322 CC establishes an assumption of non-disability that is applied to anybody of legal age, which only ceases to be effective when the concurrence of a persistent illness, which leads to the conclusion that the individual is not in a position to govern their own person, administer their assets, and perform the remaining functions of the average person, is proven.
Thus, the case law of this Chamber in rulings on the dates of May 19, 1998, July 26, 1990, November 20, 2002, and July 14, 2004, has been considered; as the ruling of July 28, 1998, affirms, “(…) for an individual to be considered disabled, it does not suffice to be suffering from a persistent physical or mental illness (…) what really counts is the concurrence of the second requisite, that is, that the disorder, be it permanent or fluctuating in severity, prevents the affected individual from governing their own person.”
Thus, it is not argued that the disability of an individual, total or partial, must always follow a restrictive criterion due to the limitations of fundamental rights that it entails. What is really questioned is whether or not is has been attested that a disabling mental illness which prevents the individual from governing themselves exists, and this affirmation results from the evidence that has been exhibited, with the assurance of the examination of the now disabled person and the hearing of the closest relatives, from which it is inferred that he suffers from secondary depressive disorder, alcohol abuse and dependence disorder, and personality disorder, which limits his abilities to understand, express wishes, and exercise free will, in such a way that his abilities to self-manage, make crucial decisions, and manage his health and assets, are limited.
No contradiction is evident in the assessment that the ruling made based on the facts. One factor is the opinion of the family members referring to the more orderly and coherent behavior they had been observing, and another distinction that this apparent improvement leaves the personality disorder resulting from the test without substance.
The Supreme Court Judgment of September 29, 2009 (case no. 1259/2006), during the Plenary Session, with regard to disability and on the interpretation of existing regulations in light of the Convention on the Rights of Persons with Disabilities, signed in New York on December 13, 2006, ratified by Spain on November 23, 20017, regarding whether, as a result of this Convention coming into force, the regulation related to disability as a protective measure of disabled persons should be considered contrary to itself, signaling the following: “disability, as well as underage status, does not at all change entitlement to fundamental rights, although it does determine the capacity to exercise these rights. Hence, an abstract and rigid regulation of the legal standing of the disabled person must be avoided… A protective measure such as disability, regardless of the denomination with which the legislator finally agrees to identify it, is only justifiable in respect to the protection of the person.”
Thus, the system of protection established in the Civil Code remains in effect, even in the text which proposes that: “First, it is always considered that the disabled person remains entitled to their fundamental rights and that disability is only a form of protection. Second, disability is not a discriminatory measure since the situation deemed worthy of protection has specific and unique characteristics. We are referring to people whose intellectual and self-determining faculties do not permit them to exercise their rights like usual because they are incapable of governing themselves. Hence, it is not a system of protection of the family, but rather solely and exclusively of the affected individual.”
All of the aforementioned is fulfilled in this case from facts that remain unchanged in cassation and that prove to be decisive in the application of guardianship, reinterpreted in light of the aforementioned Convention, from a support and assistance model and on the basis of the best interest of the disabled person that, in keeping up with his personality, requires a complement to his capacities, precisely to protect his personality, according to the Convention itself.
THIRD.- As a result of the reasoning set forth, the appeal is dismissed and the appellant is ordered to bear the costs of cassation, in accordance with what is set out in Articles 394 and 398, both part of the Spanish Code of Civil Procedure (Ley de Enjuiciamiento Civil).
For the reasons set out above, on behalf of the King and by the authority vested in the people of Spain.
WE HEREBY PRONOUNCE:
To dismiss the appeal proposed by the legal representative, Ms. Diana M. Gonzalez Doiz, in the representation attested by Mr. Miguel, against the judgment issued by the Fourth Section of the Provincial Court of Biscay on November 2, 2011, with an express award of incurred costs imposed on the appellant.
The corresponding certification is to be released to the aforementioned Court, with the request that it return the records and appeal proceedings forwarded to it.

MEMORANDUM OPINION AND ORDER
Before the Court is Jose Ganuza’s (“Ganuza”) motion to withdraw his guilty plea.
I. FACTS
On May 10, 2005, the United States Coast Guard (“Coast Guard”) boarded a vessel captained by Ganuza. Ganuza and codefendant,
Andrea Mauro, were the only two individuals onboard.
The vessel was sailing north of St. John, Antigua, in international waters, when it was boarded by the Coast Guard. While onboard the vessel, the Coast Guard conducted an ion scan on various parts of the vessel. The scan produced positive hits for cocaine and marijuana. The Coast Guard searched the vessel and recovered approximately 160 kilograms of cocaine in the berth of the vessel. On a subsequent search in October, 2005, an additional 778 kilograms of cocaine were recovered from hidden compartments in the vessel.
On May 16, 2005, the United States charged Ganuza with possession with intent to distribute controlled substances on board a vessel subject to its jurisdiction in violation of the Maritime Drug Enforcement Act. 46 App. U.S.C. § 1903(a). Ganuza
was represented by Attorney Stephen Brusch. Ganuza pled guilty
plea pursuant to a plea agreement. The plea agreement provided
that in exchange for Ganuza’s substantial assistance, the
Government would recommend a downward departure in his sentence.
Thereafter, on March 29, 2006, Ganuza was debriefed by both
French and United States authorities. The Government did not file a motion for downward departure. On September 20, 2006, Ganuza filed a motion to enforce the plea agreement which was denied by this Court on November 15, 2006.
Ganuza now moves to withdraw his guilty plea and proceed to
trial. In his motion Ganuza argues that he received ineffective
assistance of counsel. More specifically, Ganuza argues that
Brusch advised him that if he entered the guilty plea, he was
guaranteed a maximum sentence of five years, regardless of the
amount of information he was able to give the Government. Ganuza
also states that Brusch advised him that the Court would not
consider any motions to suppress evidence seized from the vessel
without a warrant, or any motion to dismiss the indictment based
on a lack of jurisdictional nexus between the alleged criminal
violation and the United States.
II. DISCUSSION
Motions to withdraw a guilty plea should be construed in favor of the defendant and granted freely. See Government of the Virgin Islands v. Berry, 631 F.2d 214, 219 (3d Cir. 1980) (stating “motions to withdraw guilty pleas made before sentencing should be liberally construed in favor of the accused and should be granted freely”); United States v. Stayton, 408 F.2d 559, 560 (3d Cir. 1969) (stating “such requests made before sentencing ‘should be construed liberally in favor of the accused’ by the trial courts”).
Pursuant to Rule 11(d) the court may permit withdrawal of a
guilty plea before sentencing if the defendant shows a fair and
just reason. See United States v. Jones, 336 F.3d 245, 252 (3d Cir. 2003) (noting that “[t]he burden of demonstrating a “fair and just” reason falls on the defendant, and that burden is substantial”). “A shift in tactics, a change of mind, or the fear of punishment are not adequate reasons to impose on the government the expense, difficulty, and risk of trying a defendant who has already acknowledged his guilt by pleading guilty.” United States v. Brown, 250 F.3d 811, 815 (3d Cir. 2001)
The Court considers three factors in determining whether to
grant a motion to withdraw a guilty plea: 1) whether the
defendant asserts his innocence; 2) the strength of the
defendant’s reasons for withdrawing the plea; and 3) whether the
government would be prejudiced by the withdrawal. Brown, 250
F.3d at 815. There is no absolute right to withdraw a guilty
plea. The decision whether to grant a motion to withdraw a
guilty plea is within the sound discretion of the Court. United
States v. Crowley, 529 F.2d 1066, 1072 (3d Cir. 19760).

RESOLUCIÓN Y ORDEN
Ante el tribunal se presenta la petición de José Ganuza para retirar su declaración de culpabilidad.
I. HECHOS
El 10 de mayo de 2005, la Guardia Costera de los Estados Unidos subió a bordo de un buque capitaneado por Ganuza. Ganuza y el coacusado, Andrea Mauro, eran los únicos dos individuos a bordo.
El buque navegaba hacia el norte de San Juan, Antigua, en aguas internacionales, cuando abordó la Guardia Costera. Al estar a bordo del buque la Guardia Costera realizó un escaneo de iones en varias partes del buque. La exploración dio resultados positivos de cocaína y marihuana. La Guardia Costera registró el buque y recuperó aproximadamente 160 kilogramos de cocaína en el camarote del buque. Durante una inspección posterior en octubre de 2005, se recuperaron 778 kilogramos más de cocaína de compartimientos escondidos en el buque.
El 16 de mayo de 2005, los Estados Unidos acusó a Ganuza de posesión con intención de distribuir sustancias controladas a bordo de un buque sujeto a su jurisdicción en contra de la legislación sobre el tráfico de drogas por vía marítima (Maritime Drug Enforcement Act. 46 App. U.S.C. § 1903(a)). DISCUSIÓN
Las peticiones para retirar una declaración de culpabilidad deben interpretarse a favor del acusado y concederse libremente. Véase Government of the Virgin Islands v. La preocupación por la seguridad energética y el cambio climático impulsan el uso de los agrocombustibles, cuyo desarrollo se adelantó a las evaluaciones ambientales, generándose una candente polémica. Aquí se revisan los principales cuestionamientos hechos al agroetanol. Los agrocombustibles tienen un balance energético neto positivo; para el etanol de caña de azúcar es ~8 y para el del maíz es 50% para 2030, siendo la demanda de combustible líquido y electricidad las de mayor crecimiento.
Desafortunadamente, el desarrollo de los agrocombustibles, con inmensas inversiones, se adelantó sin que se hicieran los necesarios estudios ambientales comprehensivos y actualmente existe una candente polémica sobre los beneficios, tanto energéticos como ambientales. Una defensa a la sustentabilidad de los agroetanoles, especialmente del etanol de caña de azúcar, se encuentra en los artículos de Goldemberg (Goldemberg, 2007; Goldemberg et al., 2008; Goldemberg y Guardabassi, 2009). En el presente trabajo se hace una revisión de los principales cuestionamientos hechos al agroetanol actualmente producido a partir de cultivos alimenticios (maíz, caña de azúcar) y los potenciales problemas asociados a una producción futura de etanol de celulosa. En lo posible, se citan publicaciones arbitradas. Recientemente, varias empresas han venido desarrollando la producción de etanol a partir de microalgas, cuya producción industrial, al parecer, podría iniciarse en un futuro próximo. Sin embargo, todavía no existen evaluaciones independientes en revistas arbitradas, ni sobre su viabilidad (costos, balance neto de energía, etc.) ni sobre posibles impactos ambientales (emisiones de compuestos climáticamente activos diferentes al CO2 desde los bioreactores, degradación de ecosistemas por deposición de desechos, contaminación de los océanos con microalgas genéticamente modificadas), por lo que una evaluación/revisión (propósito de este artículo) de lo amigable/sustentable del etanol de algas con el ambiente no es posible de hacerse por ahora. Sin duda habrá que hacerlo en el futuro.
Balance Neto de Energía de los Agrocombustibles
Una de las preocupaciones (y controversias) acerca de los agrocombustibles está relacionada con la eficiencia de la bioenergía, frecuentemente expresada como el balance neto de energía. Éste es la proporción entre la energía contenida en una unidad de agroenergía y la energía fósil requerida para producir esa unidad. Cuando es mayor que uno, sería eficiente usar agrocombustibles en reemplazo de los combustibles fósiles convencionales. La determinación del balance energético neto de los agrocombustibles es una tarea difícil y desafiante, ya que supone considerar todos los requerimientos energéticos del proceso total para producir y convertir biomasa en combustible. En la Tabla I se dan los balances energéticos netos de los principales agrocombustibles.
Los valores de la tabla muestran que todos los agrocombustibles tienen un balance energético neto positivo (>1). La producción de biodiésel a partir del aceite de palma sería el proceso más eficiente, tanto por rendimiento por ha, como por su balance energético neto. En segundo lugar está el etanol de caña de azúcar. El etanol de maíz tiene, comparativamente, un desempeño bastante pobre. El alto balance energético neto del etanol de caña de azúcar se debe fundamentalmente a la combustión del bagazo como fuente de energía en las “refinerías”. De acuerdo a las evaluaciones teóricas, la ganancia de energía del etanol celulósico podría ser muy alta.
Es importante señalar que, por unidad de superficie, las celdas fotovoltaicas colectan entre 100 y 200 veces más energía que las plantas verdes; e.g., la electricidad necesaria para una población de 100000 personas requiere de ~200000ha de bosque sustentable, pero solo ~3000ha de celdas fotovoltaicas (Pimentel, 2005).

El CO2 emitido en la combustión del agroetanol no cuenta como gas de invernadero, ya que sale de vuelta de la atmósfera durante el crecimiento de las plantas que dieron origen al biocombustible. Sin embargo, durante la producción del etanol es necesario el uso de energía, ya sea durante la etapa de cultivo o en su producción en las “refinerías”, la cual generalmente proviene de un combustible fósil que produce gases de invernadero. Además, los cultivos requieren de fertilización y debido a los procesos microbianos en el suelo se produce N2O, el cual es un potente gas de invernadero (298 veces más efectivo que el CO2 en un horizonte de tiempo de 100 años).

SUMMARY
Concern for energy security and climate change drive forward the use of biofuels, the development of which preceded environmental assessments, resulting in a heated debate. The main arguments made about bioethanol are reviewed here. Biofuels have a positive net energy balance; for sugarcane ethanol it is ~8 and for corn ethanol it is 1). The production of biodiesel from palm oil would be the most efficient process both in terms of yield per hectare and net energy balance. In second place is sugarcane ethanol. Comparatively, corn ethanol performs quite poorly. The high net energy balance of sugarcane ethanol is mainly due to the combustion of bagasse as an energy source in the “refineries.” In accordance with theoretical evaluations, the energy gain of cellulosic ethanol could be remarkably high.
It is important to point out that, per surface unit, photovoltaic cells collect between 100 and 200 times more energy than green plants; e.g. the electricity necessary for a population of 100,000 people requires ~200,000 hectares of sustainable forest, but only ~3,000 hectares of photovoltaic cells (Pimentel, 2005).
Environmental Effects During Ethanol Production
Emission of climatically active compounds and global warming
The CO2 emitted from bioethanol combustion does not count as a greenhouse gas since it returns from the atmosphere during the growth of the plants that gave rise to the biofuel. However, the use of energy during ethanol production, which generally comes from fossil fuel combustion that produces greenhouse gases, is necessary, be it during the cultivation stage or during its production in the “refineries.” Furthermore, crops require fertilization and, due to microbial processes in the soil, N20, a potent greenhouse gas (298 times more effective than CO2 in a time period of 100 years) is produced.
