Χρησιμοποιώντας την τελευταία λέξη στην επιστήμη της γενετικής, η XXXXXXX σας προσφέρει ένα μοναδικό τεστ πρόληψης σημαντικών ασθενειών. Ένα εκτενές σκανάρισμα του γενετικού υλικού, αποκαλύπτει ενδεχόμενη προδιάθεση σε μια σειρά από ασθένειες, προσφέροντας έτσι τη γνώση και τη δυνατότητα για επιλεγμένες αλλαγές του τρόπου ζωής. Texte source - grec Επικρατεί η άποψη, τόσο σε Έλληνες μελετητές, όσο και σε ξένους ότι στην Ελληνική Πολιτεία ο χωρισμός κράτους και εκκλησίας δεν είναι θεσμικά και συνταγματικά καθιερωμένος και ότι ο κοσμικός χαρακτήρας του Ελληνικού κράτους δεν προκύπτει με σαφήνεια από το Σύνταγμα. Ορισμένοι μάλιστα υποστηρίζουν ότι το Ελληνικό Σύνταγμα επιτρέπει στο κράτος να θρησκεύεται και ότι η εξουσία του οφείλει να ασκείται σύμφωνα με τους ιερούς κανόνες της Ορθόδοξης πίστης.
Οι απόψεις αυτές βρίσκουν στήριγμα, είναι αλήθεια, σε ορισμένες συνταγματικές διατάξεις, καθώς και στην προνομιακή υπέρ της Ορθόδοξης Εκκλησίας νομοθεσία του ελληνικού κράτους. Από τις συνταγματικές διατάξεις αρκεί να αναφέρουμε ότι το Σύνταγμα, στην προμετωπίδα του επικαλείται το θείο: «εις το Όνομα της Αγίας και Ομοουσίου και αδιαιρέτου Τριάδος», ότι η ορθόδοξη πίστη αναγνωρίζεται ρητά ως η «κρατούσα στην επικράτεια θρησκεία», ότι οι «ιεροί κανόνες της Ορθόδοξης Εκκλησίας» είναι συνταγματικά κατοχυρωμένοι, ότι η εκπαίδευση επιβάλλει τη καλλιέργεια της θρησκευτικής συνείδησης των Ελλήνων.
Η διατήρηση εξάλλου της μεταξικής νομοθεσίας, της περιόδου 1937-1939, ενισχύει τις αντιλήψεις αυτές, αφού εξαρτά την άδεια ίδρυσης και λειτουργίας ναών για τους ετεροδόξους από τη συναίνεση των ορθόδοξων εκκλησιαστικών αρχών, δεν προβλέπει την αποτέφρωση των νεκρών ούτε η πολιτική κηδεία κ.ά.
Πράγματι, όλα αυτά ανοίγουν ρωγμές στο σύστημα πλήρους χωρισμού κράτους και εκκλησίας, δεν είναι όμως ικανά, από μόνα τους να αναιρέσουν ούτε καν να θίξουν τόσο το δημοκρατικό-λαϊκό χαρακτήρα του συνταγματικού κράτους στην Ελλάδα καθώς και την σαφή θεσμική διάκριση της πολιτικής από τη εκκλησιαστική εξουσία, όσο και την συνταγματική αρχή της ανεξιθρησκείας και της ουδετερότητας του κράτους που ρητά απορρέει από το άρθρο 13Σ που καθιερώνει τη θρησκευτική ελευθερία και δέχεται η θεωρία και η νομολογία δύο αιώνες τώρα.
Ας πάρουμε ως παράδειγμα την συνταγματική κατοχύρωση των ιερών κανόνων και ας προσεγγίσουμε το πραγματικό νόημα της διάταξης αυτής. Οι ιεροί κανόνες της Ορθόδοξης Εκκλησίας της Ελλάδος είτε αναφέρονται σε δογματικά ή λατρευτικά ζητήματα είτε αφορούν τις θεμελιώδεις αρχές που διέπουν τη διοίκησή της είναι συνταγματικά κατοχυρωμένοι, αφού στο Σύνταγμα ορίζει ρητά ότι «Η Ορθόδοξη Εκκλησία της Ελλάδος τηρεί απαρασαλεύτως τους ιερούς αποστολικούς και συνοδικούς κανόνες και τις ιερές παραδόσεις». Παραγνωρίζεται συχνά ότι η υποχρέωση σεβασμού των ιερών κανόνων απευθύνεται και αφορά κατά πρώτο και κύριο της Εκκλησία. Δέκτης της υποχρέωσης είναι άρα η Εκκλησία και τα μέλη της, πιστοί και ιερείς. Η Πολιτεία οφείλει βέβαια και αυτή να σέβεται και να περιφρουρεί ή να μη περιφρονεί τους κανόνες που διασφαλίζουν τη δογματική ενότητα της Ορδοδοξίας καθώς και την "ενότητα της διοικήσεώς της" και κυρίως τους κανόνες που θεμελιώνουν το αυτοδιοίκητο της Εκκλησίας της Ελλάδος. Οφείλει να επεμβαίνει και να μη παραβιάζει το αυτοδιοίκητο της Εκκλησίας. Από την υποχρέωση όμως αυτού του σεβασμού δεν απορρέει και υπέρ συνταγματική ισχύ των ιερών εκκλησιαστικών κανόνων και κατίσχυσή τους απέναντι σε πράξεις κοινές, σε νόμους ή σε διατάγματα του κράτους.
Οι κανόνες της Εκκλησίας είτε έχουν τεθεί από εκκλησιαστικές αρχές κατόπιν νομοθετικής εξουσιοδοτήσεως είτε βρίσκονται σε κείμενα ιερά και σε αποφάσεις Οικουμενικών Συνόδων, θα πρέπει να θεωρηθούν ότι αποτελούν, όλα μαζί, μια ξεχωριστή "δικαιοταξία" εντός της κρατικής έννομης τάξης, η οποία διαθέτει το δικό της πεδίο εφαρμογής και ονομάζεται "κανονικότητα". Ισχύουν, επομένως, και εφαρμόζονται στο εσωτερικό της δικαιοταξίας αυτής και δεσμεύουν άμεσα και παράγουν υποχρεώσεις μόνο σε όσους υπάγονται σε αυτήν.
Αυτό σημαίνει ότι οι εν λόγω κανόνες κατοχυρώνονται, κυρίως, "υπέρ της Εκκλησίας" με την έννοια ότι όλοι βαρύνονται με την υποχρέωση σεβασμού τους: Πολιτεία, πολίτες και πιστοί, υπόκεινται όμως σε αυτούς και δεσμεύονται άμεσα από αυτούς οι ιερείς, οι μοναχοί και οι πιστοί ως μέλη της εκκλησίας-κοινωνίας πιστών. Δεν μπορούν επομένως οι ιεροί κανόνες να εξομοιωθούν με τους νόμους του κράτους ούτε αποκτούν καθολική ισχύ, έναντι πάντων ούτε εξοπλίζονται με δύναμη παραμερισμού κανόνων δικαίου και αποφάσεων της πολιτείας και κατίσχυσης απέναντί τους. Traduction - anglais Greek and non-Greek researchers agree that the separation of state and church in the Greek polity is neither institutionally nor constitutionally established and that the secular status of the Greek state does not clearly derive from the Constitution. Indeed, certain scholars argue that the Greek Constitution allows the state to become attached to a religion and that its authority ought to be practiced according to the holy rules of the Orthodox faith.
It is true that these views are based on certain constitutional stipulations as well as on the privileged position of the Orthodox Church within Greek legislation. These stipulations include the very heading of the Constitutions which calls upon God: “In the name of the Holy and Consubstantial and Indivisible Trinity”. In addition, the orthodox faith is strictly recognised by the Constitution as the “predominant religion”; the “holy rules of the Orthodox Church” are constitutionally established and education imposes the development of religious consciousness among Greeks.
These views have been reinforced by the preservation of the Metaxas legislation (1937-1939), which ensured that the issuing of building permits for churches belonging to other denominations is dependent on consent by the Orthodox Church authorities. The Metaxas legislation also prohibited cremation, civil funerals etc.
Although this is highly detrimental to the system of complete separation between state and church, nevertheless it cannot abolish or even affect neither the democratic –secular nature of the constitutional state in Greece, with a clear institutional distinction between state and church authority, nor the constitutional principle of religious freedom and state neutrality guaranteed by article 13S. The latter establishes religious freedom and has been accepted by theory and case-law for 2 centuries.
Let us use the example of the constitutional establishment of holy rules in order to analyse the rationale behind this stipulation.The holy rules of the Greek Orthodox Church, which either refer to dogmatic or worship issues, or they enshrine the fundamental principles of the Church administration, are constitutionally established. According to the Greek Constitution, “the Orthodox Church of Greece obeys and respects in the strictest manner the holy apostolic and synodal rules and holy traditions”. The fact that the Church should be first and foremost responsible and obliged to respect the holy rules is often disregarded. The Church therefore is the one who assumes this obligation. Certainly, the state is also obliged to respect and safeguard or not safeguard the rules that ensure the dogmatic unity of Orthodoxy and “the unity of its administration” and most importantly the rules that govern the self-government of the Church of Greece. However, the constitutional primacy of the holy ecclesiastical rules and their predominance over common acts, laws or decrees do not derive from the obligation of this respect.
The rules of the Church, either made by the Church authorities upon legislative authorization, or found in holy texts and in Ecumenical Council decisions, should be regarded as constituting a distinct “legal order” within the law and order of the state, which has its own field of application and is named “canonicity”. Therefore, the rules of the Church are applied within this “legal order” and they directly bind and oblige only those who come under it.
This means that the rules in question are established mainly “in favour of the Church”, in that everyone is obliged to show their respect: the State, the citizens and the faithful. However, this neither makes the rules of the Church equal to those of the State nor does it grant them universal validity, nor does it give them the power to disregard the rules of law and State decisions, nor does it give them primacy over such laws.
