Texte source - espagnol Constituye reiterada doctrina de este Tribunal que el derecho a la tutela judicial efectiva recogido en el art. 24.1 CE protege y garantiza la eficacia de la cosa juzgada material, tanto en su aspecto positivo o prejudicial, impidiendo que los Tribunales, en un proceso seguido entre los mismos sujetos, puedan desconocer o contradecir las situaciones jurídicas declaradas o reconocidas en una resolución que haya adquirido firmeza, como en su aspecto negativo o excluyente de nuevos pronunciamientos judiciales con idéntico objeto procesal al ya decidido en resolución firme. El desconocimiento de tal efecto de cosa juzgada material por parte de los Tribunales implicaría privar de eficacia a lo que se decidió con firmeza en el proceso, lesionándose así la paz y seguridad jurídicas de quien se vio protegido judicialmente por una resolución dictada en un proceso anterior entre las mismas partes (véanse SSTC 15/2002, de 28 de enero, FJ 3; 156/2002, de 23 de julio, FJ 3; 83/2006, de 13 de marzo, FJ 2). Ahora bien, este Tribunal también ha declarado que la determinación del alcance que quepa atribuir a la cosa juzgada constituye una cuestión que corresponde a la estricta competencia de los órganos judiciales, por lo que sus decisiones en esta materia sólo son revisables en sede constitucional si resultan incongruentes, arbitrarias, irrazonables o están incursas en error patente (SSTC 15/2002, de 28 de enero, FJ 3; STC 156/2002, de 23 de julio, FJ 3; 204/2003, de 1 de diciembre, FJ 3; 83/2006, de 13 de marzo, FJ 3; 177/2006, de 5 de junio, FJ 3).
La traslación de esta doctrina a los procesos de extradición y euroorden tiene algunas peculiaridades. En primer lugar, conviene recordar que “la competencia para interpretar la legalidad aplicable en materia de extradición y euroorden es de la jurisdicción ordinaria, por lo que a los órganos judiciales corresponde precisar, en primer lugar, si las resoluciones dictadas en materia extradicional tienen o carecen de efecto de cosa juzgada material. A este Tribunal Constitucional corresponde, tan sólo, revisar conforme a un control externo y negativo, si la fundamentación exteriorizada por la Audiencia Nacional ha vulnerado el derecho a la tutela judicial efectiva sin indefensión (art. 24.1 CE), de conformidad con el canon reforzado que este Tribunal utiliza cuando la cuestión de fondo sobre la que se proyecta la tutela se conecta con otros derechos fundamentales del recurrente”. (SSTC 83/2006, de 13 de marzo, FJ 3; 293/2006, de 10 de octubre, FJ 3). En segundo lugar, y en atención a la naturaleza del proceso extradicional, en el que simplemente se verifica el cumplimiento de requisitos y garantías previstos en las normas para acordar la entrega del sujeto afectado (por todas, SSTC 156/2002, de 23 de julio, FJ 3; 83/2006, de 13 de marzo, FJ 3), hemos afirmado que las resoluciones que resuelven los procesos de extradición no producen, en principio, el efecto de cosa juzgada y, por lo tanto, pueden “en determinados supuestos” ser sustituidas por otras (SSTC 227/2001, de 26 de noviembre, FJ 5; 156/2002, de 23 de julio, FJ 3; 83/2006, de 13 de marzo, FJ 3; 177/2006, de 5 de junio, FJ 3; 293/2006, de 10 de octubre, FJ 3).
La precisión de esta doctrina en cuanto a cuáles son los supuestos en que se excluye el efecto de cosa juzgada nos ha llevado a afirmar que su aplicación “ha de ser modulada en atención a las circunstancias del caso concreto, pues la cuestión podría recibir diferente respuesta en función de cuál fuera la ratio decidendi sobre la que se hubiera fundado la denegación de la entrega del reclamado en el primer proceso extradicional cuyo efecto de cosa juzgada se discute. En este sentido, la propia formulación de la doctrina de este Tribunal en las citadas Sentencias establece la posibilidad de que puedan producirse excepciones al principio expuesto, admitiendo, sensu contrario, que ‘en determinados supuestos’ las resoluciones que resuelven los procedimientos de extradición no puedan ser sustituidas por otras” (STC 83/2006, de 13 de marzo, FJ 3; en el mismo sentido STC 293/2006, de 10 de octubre, FJ 3).

En definitiva, si bien nuestra jurisprudencia admite que en determinados supuestos las resoluciones que deniegan una extradición pueden ser sustituidas por otras, también afirma que ello no es así en todo caso. Y que la clave para discriminar unos casos de otros está en el análisis de la ratio decidendi de la denegación en el primer proceso extradicional, diferenciando entre aquellas denegaciones fundadas en razones puramente formales o procedimentales no conectadas con las causas de denegación referidas a las condiciones procesales o materiales de la causa penal (que en principio no tienen efecto de cosa juzgada respecto de posteriores solicitudes de extradición o entrega), y aquellas que sí lo están (en las que sí podría concurrir tal efecto, pues estas últimas sí pueden generar en el ciudadano expectativas legítimas de intangibilidad de la primera decisión).
Traduction - anglais It is an established doctrine of this Court that the right to effective judicial protection provided for in Art. 24(1) of the Spanish Constitution protects and guarantees the effectiveness of material res judicata, both in its positive or preliminary aspect, by preventing courts, in subsequent proceedings between the same parties, from disregarding or contradicting legal positions declared or recognised in a decision which has become final, and in its negative or exclusionary aspect, by precluding new judicial decisions where the subject-matter of the proceedings is identical to that on which has final decision has already been given. The disregard by the courts of this material res judicata effect would render ineffective what was finally decided in the proceedings, thereby compromising the legal peace and certainty of those who were judicially protected by a judgement given in previous proceedings between the same parties (see Judgements of the Tribunal Constitucional (Constitutional Court, Spain) (SSTC) 15/2002 of 28 January, legal ground (FJ) 3; 156/2002 of 23 July, FJ 3; 83/2006 of 13 March, FJ 2). That said, this Court has also held that the task of determining the scope to be attributed to res judicata is strictly a matter for the judicial bodies, and thus their decisions on this matter are only reviewable by the Constitutional Court if they turn out to be inconsistent, arbitrary, unreasonable or vitiated by a manifest error (SSTC 15/2002 of 28 January, FJ 3; Judgement of the Tribunal Constitucional (STC) 156/2002 of 23 July, FJ 3; 204/2003 of 1 December, FJ 3; 83/2006 of 13 March, FJ 3; 177/2006 of 5 June, FJ 3).
The transfer of this doctrine to extradition and European arrest warrant proceedings has some peculiarities. First of all, it is useful to recall that "competence to interpret the applicable law with regard to extradition and the European arrest warrant lies with the ordinary courts. It therefore falls to the judicial bodies to first specify whether the judgement given regarding extradition has the force of material res judicata or not. It is for this Tribunal Constitucional to review, according to an external and negative review, only whether the rationale expressed by the Audencia Nacional (National High Court, Spain) infringed the right to effective judicial protection and not to go undefended (Art. 24(1) of the Spanish Constitution), in accordance with the enhanced canon this Court uses when the substantive issue for which protection is provided is connected to fundamental rights of the appellant". (SSTC 83/2006 of 13 March, FJ 3; 293/2006 of 10 October, FJ 3). Secondly, having regard to the nature of extradition proceedings, in which only the compliance with the requirements and safeguards stipulated in the regulations for agreeing to surrender the affected person is verified (among others, SSTC 156/2002 of 23 July, FJ 3; 83/2006 of 13 March, FJ 3), we held that decisions disposing of extradition proceedings do not, in principle, have the force of res judicata and can therefore be substituted by others "in certain cases" (SSTC 227/2001 of 26 November, FJ 5; 156/2002 of 23 July, FJ 3; 83/2006 of 13 March, FJ 3; 177/2006 of 5 June, FJ 3; 293/2006 of 10 October, FJ 3).
The preciseness of this doctrine regarding cases in which the effect of res judicata is excluded has led us to affirm that its application "must be adjusted having regard to the circumstances of the specific case, since the issue could receive a different answer depending on the ratio deciendi upon which the refusal to surrender the person claimed in the first extradition proceedings was founded, the res judicata effect of which is in dispute. In this sense, the very formulation of this doctrine by this Court in the abovementioned judgements establishes the possibility that there may be exceptions to the principle set out, admitting that, a sensu contrario, "in certain cases" the decisions disposing of extradition proceedings cannot be substituted by others" (STC 83/2006 of 13 March, FJ 3: in the same sense, STC 293/2006 of 10 October, FJ 3).

Finally, although our case-law accepts that decisions which deny an extradition can be substituted by others, it also accepts that this is not always the case. The key to differentiating some cases from other lies in the analysis of the ratio decidendi of the refusal in the first extradition proceedings. Through this analysis, a distinction can be made between those refusals founded on purely formal or procedural reasons, unconnected with the grounds for refusal related to the procedural or material conditions of the criminal case (which, in principle, do not have the force of res judicata with regard to subsequent requests for extradition or surrender), and those which are (in which case res judicata could apply, since it could create legitimate expectations in the citizen of the inviolability of the first decision).

Un estudio realizado por la Universidad de Castilla la Mancha revela que la diversidad de género dentro de un equipo investigador fomenta soluciones novedosas que conducen a innovaciones radicales tanto para la empresa como para el mercado. Además, según el trabajo, formar equipos mixtos de hombres y mujeres en un contexto tecnológico es un elemento clave para aumentar la competitividad.

Hasta el momento hay muy pocos datos sobre diversidad de género en los equipos de I+D y su impacto en las innovaciones de las organizaciones. Sin embargo, un estudio llevado a cabo por investigadores de la Universidad de Castilla la Mancha (UCLM) indica que el equilibrio entre hombres y mujeres en un contexto tecnológico es un elemento clave para aumentar la competitividad y favorecer la innovación más rompedora.
El trabajo, publicado en la revista Innovation-Management Policy & Practice, destaca que la diversidad de género dentro de los equipos de I+D favorece dinámicas que conducen a una innovación radical, aquella que provoca cambios en el paradigma debido a la introducción de nuevas prestaciones y conlleva la aparición de mercados totalmente nuevos.
Con este estudio, los investigadores de la UCLM han querido cubrir una laguna en la investigación previa, relacionando los resultados de innovación con la diversidad de género de los equipos de I+D.

Para llevar a cabo el trabajo, el equipo utilizó la información sobre las actividades innovadoras de empresas del Panel de Innovación Tecnológica con una muestra de 4.277 compañías, 83% del sector industrial y 17% de servicios.
Al analizar los datos, encontraron una relación positiva entre la diversidad de género y la innovación radical. Según la muestra, la probabilidad de desarrollo más novedoso se incrementa significativamente cuando en el equipo de I+D se aumenta la diversidad de género. También indica que contratar I+D externa y que la empresa opere en una industria de alta tecnología contribuye a este tipo de innovación.
Diferentes perspectivas
“En este contexto, la diversidad de género fomenta soluciones novedosas que conducen a innovación radical tanto en las compañías como para el mercado –señala Cristina Díaz García, investigadora principal–. La diversidad de género puede aportar diferentes perspectivas y conocimientos cuya combinación ofrece una gama más amplia de ideas y, por consiguiente, una mayor creatividad, facilitando los procesos de toma de decisiones”.
Las implicaciones del estudio son múltiples: “En el entorno empresarial, los resultados apuntan la necesidad de reconocer y valorar la diversidad de género, que, a su vez, podría mejorar la capacidad de una organización para atraer y retener al personal clave”, añade.
En su opinión, “la diversidad de género no solo tiene implicaciones en los ámbitos de equidad y de igualdad sino que aporta mayor eficacia del trabajo en equipo”.
El estudio recomienda a los gestores que tengan en cuenta el potencial de formar equipos con un mayor equilibrio entre hombres y mujeres en sectores tecnológicos si se persigue una innovación radical, pues “la innovación es un elemento clave en un contexto de competencia global creciente”, concluye Díaz.

So far, information on gender diversity in R+D teams and its impact on innovation in organisations has been limited. However, a study carried out by researchers at the University of Castilla la Mancha (UCLM) indicates that the balance between men and women in a technological context is a critical element in increasing competitiveness and promoting the most ground-breaking innovation.
The research, published in the ‘Innovation-Management Policy & Practice’ journal, demonstrates that gender diversity within R+D teams generates dynamics that lend themselves to radical innovation, which causes a paradigm shift by the introduction of new features, resulting in the emergence of completely new markets.
With this study, researchers at the UCLM aimed to fill the gap left in previous research, relating innovative results with gender diversity in R+D teams.
In their research, the team used information on innovative activities performed by companies of the Technological Innovation Panel, with a sample of 4,277 companies, 83% from the industrial sector and 17% from the service sector.
In analysing the data, they found a positive relation between gender diversity and radical innovation. According to the sample, the probability of innovative development is significantly increased when gender diversity in the R+D team is increased. It also indicates that contracting external R+D and the fact that the company operates in a high-technology industry contributes to this type of innovation.
Different perspectives
"In this context, gender diversity fosters novel solutions leading to radical innovation, in companies as well as in the market," says lead researcher, Cristina Díaz García. “Gender diversity can provide different perspectives and insights. The combination of these offers a wider range of ideas and, thus, greater creativity, facilitating decision-making processes.”
Cristina Díaz García points out that the study has several implications: "In the business environment, the results point to the need to recognise and value gender diversity, which could, in turn, make an organisation more able to attract and retain key staff.”
In her opinion, "gender diversity not only has implications in the fields of equity and equality but also make teamwork more effective.”
The study recommends that if innovation is to be radical, managers should consider the potential offered by forming teams with more balance between men and women in technology sectors, since "innovation is a critical element within a context of increasing global competition," concludes Díaz.
