Texte source - français Alors que sur de nombreux marchés (spécialement ceux arrivant à maturité technologique ou très encombrés) les marques n’hésitent pas à sortir des codes visuels de leur catégorie de produits pour se différencier et communiquer un positionnement en rupture avec leurs concurrents (Divard et Urien, 2001 ; Peltier, 2003 ; Heilbrunn, 2006 ; Minvielle, 2006), un produit comme le vin semble rencontrer, en France, de réelles difficultés pour sortir des codes visuels traditionnellement utilisés sur son marché. Ainsi pour Aurier (2004), le vin français se caractérise par « un standard d’emballage quasi unique : la bouteille bordelaise en verre de 75cl et son étiquette aux évocations enracinées dans le terroir, l’univers des châteaux. ». Or, face à la perplexité du consommateur devant un rayon vin qui peut compter jusqu’à 700 références (Boulet et d’Hauteville, 1991 ; Lockshin, 2003), la question des modes de différenciation des produits et notamment celle de l’intérêt de l’innovation en matière de design est pertinente. Alors pourquoi les opérateurs n’utilisent- ils pas la variable « design du packaging » pour se différencier en rayon et ainsi simplifier le processus de choix du consommateur ? D’après les professionnels du secteur cela s’explique par le fait que le consommateur français, qu’il soit jeune, vieux, expert ou novice, est très conservateur concernant le vin et préfère les bouteilles les plus classiques en termes de design. Le risque élevé associé à la consommation de vin en France rendrait la nouveauté difficile à faire accepter au consommateur (Celhay et Trinquecoste, 2008).
Traduction - anglais While several markets (especially those that have reached technological maturity or are flooded with products) display brands that have been willing to depart from the visual codes of their product category in order to stand out and emphasise a break from their competitors (Divard and Urien, 2001; Peltier, 2003; Heilbrunn, 2006; Minvielle, 2006), a product such as wine—especially in France—seems to encounter real difficulties in making the same break from the visual codes traditionally used in its market. Aurier (2004) comments that French wine is characterised by “a standard of labelling that is almost monotonous: a 75cl bottle of Bordeaux with its label that evokes deep roots in the region, the world of Châteaux”. Given the level of perplexity experienced by consumers looking at up to 700 types of wine (Boulet and d’Hauteville, 1991; Lockshin, 2003), the question of how to make products stand out, and especially the question of how worthwhile it is to innovate in terms of design, therefore become highly relevant. So why is it that wine producers do not exploit the ‘packaging design’ variable in order to stand out on the shelf and thereby simplify consumer choice? According to professionals from this sector, the explanation lies with the French consumer, who, whether young or old, novice or expert, is highly conservative when it comes to wine and prefers the more traditional bottles in terms of design. The increased risk associated with the consumption of wine in France is said to make it difficult to endear the consumer to novelty (Celhay and Trinquecoste, 2008).

ARTICLE 1 : OBJET
Le présent contrat a pour objet la cession par le Contractant au Producteur, conformément aux dispositions du Code de la Propriété Intellectuelle, des droits permettant la réalisation et l'exploitation du film provisoirement ou définitivement intitulé : « xxx », d'après l’enregistrement du concert de l’artiste au festival xxx du xx/xx/2006.
Le Producteur sera seul juge du choix du réalisateur, des techniciens, et, d'une manière générale, de tous les collaborateurs du film.
ARTICLE 2 : CESSION
Contre entier respect des engagements du Producteur contenus dans le présent contrat, le Contractant cède au Producteur, à titre exclusif, pour la durée et les territoires spécifiés à l’article 3 ci-après, les droits d'exploitation ci-après définis.
Ces droits comprennent le droit de reproduction et le droit de représentation du film ainsi que les droits d'utilisation secondaire.
A - LE DROIT DE REPRODUCTION COMPORTE NOTAMMENT :
- Le droit d'enregistrer ou de faire enregistrer par tous procédés techniques connus ou inconnus à ce jour, sur tous supports, en tous formats en utilisant tous rapports de cadrage, les images en noir et blanc et/ou en couleurs, les sons, les titres ou sous-titres du film, ainsi que les photographies fixes représentant des scènes du film ;
- le droit d'établir et/ou de faire établir toutes versions du film tant française qu'étrangères ainsi que tous sous-titrage en toutes langues ;
- le droit d'établir et/ou de faire établir en tel nombre qu'il plaira au Producteur ou à ses ayants droit, tous originaux, doubles ou copies sur tous supports, notamment vidéo, et par tous autres procédés connus ou inconnus à ce jour, à partir des enregistrements ci-dessus ;
- le droit de mettre et/ou de faire mettre en circulation, ces originaux, doubles et copies pour toute communication au public par les modes d'exploitation prévus au paragraphe B ci-après.

ARTICLE 1: PURPOSE
The purpose of this contract is to enable the Contracting party to assign to the Producer, in accordance with the provisions of the French Code de la Propriété Intellectuelle (intellectual property code), the rights for the production and use of the Film entitled, either provisionally or definitively, “xxx en concert au festival xxx”, which will be produced from the recording of the Artist’s concert during the xxx festival on xx/xx/2006.
The Producer alone will choose the director, technicians and, in general terms, all persons who will contribute to the Film.
ARTICLE 2: ASSIGNMENT
In respect of the commitments made by the Producer under the terms of this contract, the Contracting party agrees to assign to the Producer, for the duration and territory defined in article 3 below, the exclusive user rights as defined below.
These rights include the right to reproduce and broadcast the Film, as well as secondary user rights.
A - REPRODUCTION RIGHTS INCLUDE THE FOLLOWING:
- The right to use any means currently in use to record or have recorded, in any format and with any framing configuration, the images, in black and white or in colour, the sound, titles and subtitles of the Film, as well as the still photography used to represent scenes from the Film;
- the right to produce and/or have produced all versions of the Film, both in French and foreign languages, as well as subtitles in all languages;
- the right to use the abovementioned recordings to produce and/or have produced, as many times as desired by the Producer or its assigns, all originals, reproductions or copies in all formats, especially video, and by any means currently in use or yet to be discovered;
- the right to use the methods outlined in paragraph B below to distribute and/or have distributed these originals, reproductions or copies with a view to public broadcast.
