Representation and Warranties
WE USE COMMERCIALLY REASONABLE EFFORTS TO PROVIDE ACCESS TO THE AB SMART HOME SERVICE ON A CONTINUOUS, HIGH QUALITY BASIS.
HOWEVER, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE AB SMART HOME SERVICE IS AT YOUR SOLE RISK AND THAT ACCESS TO THE AB SMART HOME SERVICE IS PROVIDED TO YOU ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WITHOUT ANY WARRANTY OF ANY KIND OR NATURE.

Changes to Terms of Use
We are allowed to change or amend our Terms of Use from time to time to correct editorial defects or phrase it more clearly without notice.
We will provide you at least 30 days prior notice (“Notification Period”) in case of any material changes to our Terms of Use are made via “Notification” menu in your AB mobile phone or by other suitable means which ensure that you will be able to take note of the revised Terms of Use.
You also accept the revised Terms of Use when you continue to use our Services after the Notification Period.
In this case you are bound by and we will treat you as bound by the revised Terms of Use from the date on which the revised Terms of Use become effective.
You are free to terminate your agreement to these Terms of Use at any time should you choose not to accept the revised Terms of Use.
Term and Termination
You may choose to stop using the AB Smart Home Service or to close your Account at any time.
This Agreement is effective until terminated by you or by ABE.
This Agreement and your rights under this Agreement will terminate immediately upon notice from ABE if you fail to comply with any term(s) or conditions of this Agreement, if you have clearly expressed or demonstrated (regardless of whether directly or through your actions or statements or otherwise) that you do not intend to comply with these Terms of Use, or in the event that your Account is closed by you or ABE for any reason.
Upon termination of this Agreement, you shall cease all use of the AB Smart Home Service, and destroy all copies, full or partial, of the AB Smart Home Service, including any accompanying documentation.
Furthermore, we reserve the right to terminate these Terms of Use at any time if; (1) we or any of our suppliers or partners providing the AB Smart Home Service to or together with us decide to terminate the AB Smart Home Service, in which or any parts thereof, or if any of our suppliers or partners decides to terminate the entire relationship with us, regardless of the reason of such termination, including where we or any of our suppliers or partners are of the opinion that the provision of the AB Smart Home Service or parts thereof to you or to us or together with us are no longer commercially feasible; and (2) we or any of our suppliers or partners providing the AB Smart Home Service to or together with us are required to terminate the provision of the AB Smart Home Service or any parts thereof by the applicable laws, regulations, or court rulings.
GOVERNING LAW; DISPUTE RESOLUTION
(a) Except to the extent prohibited by local law, any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be: (i) referred to and finally resolved by arbitration under the Rules of the Korean Commercial Arbitration Board (which rules are deemed to be incorporated by reference into this clause), (ii) where the number of arbitrators shall be one, (iii) the seat, or legal place, of arbitration shall be Seoul, South Korea, (iv) the language to be used in the arbitral proceedings shall be English and (v) the governing law of the contract shall be the substantive law of the Republic of Korea.
(b) To the extent required by local law in order for arbitration to be valid and legally effective as a means of dispute resolution, including as against a consumer, (i) shall be deemed to refer to the rules of the most prominent arbitration body (the “Local Arbitration Rules”) in your country and (iii) shall be deemed to refer to the capital city of your country.
(c) You may only resolve disputes with us on an individual basis, and not as a plaintiff or class member in any purported class or representative proceeding.
Miscellaneous Provisions
a.
License or Use by the U.S.
Government: If a Service is being used by or licensed to the United States Government, the following shall apply: The Service licensed under this Agreement is "commercial computer software" as the term is described in 48 C.F.R.
252.227-7014(a)(1).
If acquired by or on behalf of a civilian agency, the U.S.
Government acquires this commercial computer software and/or commercial computer software documentation subject to the terms of this Agreement as specified in 48 C.F.R.
12.212 (Computer Software) and 48 C.F.R.
12.211 (Technical Data) of the Federal Acquisition Regulations ("FAR") and its successors.
If acquired by or on behalf of any agency within the Department of Defense ("DOD"), the U.S.
Government acquires this commercial computer software and/ or commercial computer software documentation subject to the terms of this Agreement as specified in 48 C.F.R.
227.7202-3 of the DOD FAR Supplement ("DFAR") and its successors.
b.
Export Restrictions: You agree that you will not export or re-export any Service or accompanying documentation (or any copies thereof) in violation of any applicable laws or regulations of the United States.
You agree to comply with all applicable United States and international export laws and regulations.
These laws include restrictions on destinations, end users, and end use.
You represent and warrant that you are not prohibited from receiving exports or services under United States or other applicable export laws.
c.
Severability: In the event any provision of this Agreement is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of any of the remaining provisions shall not in any way be affected or impaired
d.
Enforcement of Agreement: ABE reserves the right to take any steps it believes to be reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement.
You agree that ABE has the right, without liability to you, to disclose any information relating to your use of the Service to law enforcement authorities, government officials, and/or a third party, as ABE believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement or to comply with applicable law.
e.
Assignment: We may assign, sub-contract or otherwise transfer any or all of our rights and obligations under these Terms of Use to any company, firm or person.
We can only do this if it does not materially affect your rights under these Terms of Use.
You may not assign, sub-contract or otherwise transfer your rights or obligations under these Terms to anyone else unless you first agree this with us in writing.

Force Majeure: We are not liable or responsible for delay in performance of, or any failure to perform any of our obligations under these Terms of Use that is caused by events outside our reasonable control (“Force Majeure”), in particular (but not limited to) (a) acts, decrees, legislation, regulations or restrictions of any government; (b) unavailability of public or private telecommunication networks; or (c) strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attacks or threats of terrorist attacks, war (whether declared or not) or any natural disaster.

Texte source - anglais Swan in Fife, Scotland dies with H5N1 bird flu virus infection
It has been confirmed that tests done on a dead Mute Swan found in the village of Cellardyke in Fife, Scotland has tested positive for the deadly strain of H5N1 Bird Flu virus.
The swan is believed to have been native to Scotland.
Two other swans found in Richmond Park in Glasgow are being tested for the H5N1 virus.
They are among at least 14 other dead birds and 12 more swans found in Glasgow, that are being tested for the H5N1 virus.
This is the United Kingdom's first confirmed case of the H5N1 virus and would make the U.K. the 14th country to report the virus.
"The risk to humans has not changed by the fact that we have found the virus in the U.K..
There is a better chance of a person winning the national lottery than catching bird flu in the U.K. today," said Doctor Jim Robertson from the National Institutes for Biological Standards and Control in a press conference.
"We also have to work on the assumption that there is some spread among wild birds.
There is no doubt we are getting closer to the day when moving birds indoors will be necessary," said former President of the British Veterinary Association, Bob McCracken.
"The situation is that the virus is there, and it will probably continue to circulate among the birds.
It will spread through close contact, irrespective of species.
There is one big question mark: Will the virus disappear from wild birds after a period of six months, or will it still be present after a period of six years?"
added McCracken.
McCracken also said that the virus could turn up in more birds saying, "I would start from the assumption that a small pool of wild birds in the Fife area are infected and potentially passing it on to other birds" and that seagulls could pose a threat of passing on the virus because they have been known to peck at the bodies of other dead birds that were infected.
"We have to assume that," he said.
In a statement by the Department for Environment, Food and Rural Affairs, released yesterday, the Scottish Executive confirmed that a "highly pathogenic H5 avian flu" virus was found in a sample taken from the dead swan.
The swan was discovered March 29, 2006 and has been confirmed as a domestic species and officials say that it may have caught the virus from another infected bird.
Officials also report that the area where the swan has been found is being sealed off.
"In accordance with a recent EU decision the Scottish Executive is putting in place a protection zone of a minimum of three kilometres radius and a surveillance zone of 10 kilometers.
Keepers of birds in the protection zone are being instructed to isolate their birds from wild birds, by taking them indoors where ever possible," said the Scottish Executive in a statement.
Samples from the swan were sent to the European Union Bird Flu Laboratory at Weybridge.
"Bird keepers outside the protection zone should redouble their efforts to prepare for bringing their birds indoors if that becomes necessary.

It has been confirmed that tests done on a dead Mute Swan found in the village of Cellardyke in Fife, Scotland has tested positive for the deadly strain of H5N1 Bird Flu virus.
The swan is believed to have been native to Scotland.
Two other swans found in Richmond Park in Glasgow are being tested for the H5N1 virus.
They are among at least 14 other dead birds and 12 more swans found in Glasgow, that are being tested for the H5N1 virus.
This is the United Kingdom's first confirmed case of the H5N1 virus and would make the U.K. the 14th country to report the virus.
"The risk to humans has not changed by the fact that we have found the virus in the U.K..
There is a better chance of a person winning the national lottery than catching bird flu in the U.K. today," said Doctor Jim Robertson from the National Institutes for Biological Standards and Control in a press conference.
"We also have to work on the assumption that there is some spread among wild birds.
There is no doubt we are getting closer to the day when moving birds indoors will be necessary," said former President of the British Veterinary Association, Bob McCracken.
"The situation is that the virus is there, and it will probably continue to circulate among the birds.
It will spread through close contact, irrespective of species.
There is one big question mark: Will the virus disappear from wild birds after a period of six months, or will it still be present after a period of six years?"
added McCracken.
McCracken also said that the virus could turn up in more birds saying, "I would start from the assumption that a small pool of wild birds in the Fife area are infected and potentially passing it on to other birds" and that seagulls could pose a threat of passing on the virus because they have been known to peck at the bodies of other dead birds that were infected.
"We have to assume that," he said.
In a statement by the Department for Environment, Food and Rural Affairs, released yesterday, the Scottish Executive confirmed that a "highly pathogenic H5 avian flu" virus was found in a sample taken from the dead swan.
The swan was discovered March 29, 2006 and has been confirmed as a domestic species and officials say that it may have caught the virus from another infected bird.
Officials also report that the area where the swan has been found is being sealed off.
"In accordance with a recent EU decision the Scottish Executive is putting in place a protection zone of a minimum of three kilometres radius and a surveillance zone of 10 kilometers.
Keepers of birds in the protection zone are being instructed to isolate their birds from wild birds, by taking them indoors where ever possible," said the Scottish Executive in a statement.
Samples from the swan were sent to the European Union Bird Flu Laboratory at Weybridge.
"Bird keepers outside the protection zone should redouble their efforts to prepare for bringing their birds indoors if that becomes necessary.

A United States federal jury found that self-confessed al-Qaida conspirator Zacarias Moussaoui may, according to U.S. law, be put to death after deciding that his statements to FBI agents led directly to at least one death in the terrorist attacks on September 11, 2001.
Moussaoui is alleged to have had prior knowledge of the 9/11 attacks, but did not inform FBI agents of it.
Evidence of Moussaoui's knowledge of 9/11 attacks are based on Moussaoui's own testimony, and some al-Qaida members have said that "he knew nothing" and is "boasting" of it and that Ramzi Binalshibh is the actual '20th hijacker'.
Aaron Zebley, one of the FBI's two chief case agents on the Moussaoui investigation, also testified that "Moussaoui knew nothing about some key elements" of the 9/11 plot.
Moussaoui is the only person to face charges in connection with the 9/11 attacks.
It was not expected that Moussaoui would testify on his own behalf during the trial, but he changed his mind and testified in the last week of March that he was supposed to fly a plane with the "shoe bomber" on 9/11.
Moussaoui's lawyers said that his claim was absurd and that Moussaoui was intentionally trying to elicit an execution for martyrdom purposes.
Moussaoui refused to stand and prayed silently as the verdict was read.
"You'll never get my blood, God curse you all," Moussaoui said after the jurors had left the courtroom.
The jury took four days to arrive at the verdict.
"By this verdict, the jury has found that death is a possible sentence in this case," a court spokesman said.
On the key question before the jurors, they answered yes on whether at least one victim died on 9/11 as a direct result of Moussaoui's actions.
If the jury had voted against his eligibility for the death penalty, Moussaoui would have been sentenced to life in prison.
The jury began weighing Moussaoui's fate last Wednesday.
During its deliberations, jurors asked only one question, seeking a definition of a "weapon of mass destruction."
One of the three convictions for which Moussaoui could be put to death is conspiracy to use weapons of mass destruction.
The jurors were told that a plane used as a missile (the tactic employed on 9/11) qualifies as a weapon of mass destruction.
Moussaoui pleaded guilty April 2005 to conspiring with al-Qaida to hijack aircraft and other crimes.

The last people executed without killing anyone were Julius and Ethel Rosenberg fifty years ago.
Next phase of the trial
Now that this first phase of the trial to decide possible penalties is established, the jury of nine men and three women will hear more testimony, expected last as long as 3-months, on whether the 37-year-old Frenchman will face life imprisonment or execution.
Testimony will include the families of 9/11 victims who will describe the human toll of the al-Qaida operation, in which four passenger airliners were taken over and two were flown to New York City and crashed into the World Trade Center, a third airplane struck the Pentagon, and the last crashed in a field near Shanksville, Pennsylvania apparently, after passengers intervened.

The University of Florida Gators beat the University of Calfornia, Los Angeles Bruins 73-57 in the RCA Dome last night.
The win gave the Gators their first NCAA basketball championship.
The Gators, a number three seed in the tournament, spent most of the night dominating the Bruins on both offense and defense.
Joakim Noah, center for the Gators, recorded 16 points, nine rebounds, and a NCAA tournament championship game record 6 blocks.
Noah said, "It's like I'm in a cloud.
Not only does this feel good, but it smells good and it tastes good.
I can't even describe it."
In the previous two games the Bruins allowed only a combined 90 points, but they never seemed to get organized on defense.
Florida's early lead stayed throughout the game, with the Bruins unable to re-take the lead.
Joakim Noah's father Yannick Noah was a French tennis player (now a singer) who won the Roland Garros tennis tournament.
His grandfather was a soccer professional.

Apple has released an application that limits the volume produced from its iPod portable music players.
The software update, iPod Software 1.1.1, works with the iPod Nano and the Video version.
Apple released the program in response to complaints that it had not taken necessary measures to prevent hearing loss in iPod users.
In California, a class-action lawsuit was filed against Apple in January over claims of hearing loss from iPod use.
Apple's worldwide vice-president of marketing for the iPod, Greg Joswiak, indicated that this patch is available for people who want "an easy-to-use option to set their own personal volume limit."
It is available for free download.
The software also has the option of being used with parental controls to prevent children from modifying the volume.
iPods sold in France already have the volume limited, as the law forbids a sound louder than 100 decibels (dB).
The American Speech Language Hearing Association published a study where it appears that iPod's (and mp3 players's) power is 120 dB, comparable to a live concert.
A gunshot is 140 dB.
Flooding Danube threatens thousands

Budapest, Hungary – The Danube River, running from Germany to the Black Sea in Romania, is currently at 859cm (28 ft 2 in) higher than its normal level in Budapest.
Climatologists are predicting that the river will crest as high as 865 cm (28' 5").
This places the crest higher than in 2002, when floods swept across all Europe.
The Danube crested at 860 cm (28' 3") high then.
According to officials, 11,000 buildings are in danger of flood damage, and 172 hectares (475 acres) of land are currently under water.
Officials also placed the country under a Level 3 Alert (on a 3 level scale).
Margit Island is completely under water, with 3500 sandbags giving it protection.
The riverside is no less under water, and the underground number 2 (M2) is currently in danger of being closed since one of its stations, Battyány tér, is flooded.
According to Hungarian Water engineers, a flood of this magnitude hasn't occured since 1838 when ice coming down the river blocked the Danube, creating a natural dam which caused the water to flood everything behind it.
General elections are on Sunday in Hungary.
The election is heated with MSZP and FIDESZ in a virtual dead heat with polls rating both at 45%.
Other smaller parties are voicing concern about gaining a 5% toe-hold to gain a seat in Parliament.
It is not yet clear how the flood will impact the final campaign.

DeLay has allegedly been linked to lobbyist Jack Abramoff, who in January 2006 entered a guilty plea to charges of conspiracy to corrupt public officials, mail fraud, and tax evasion.
Judge throws out petition case against Patrick Murphy in PA Congressional race

On Friday, Judge Robert Simpson Jr.
threw out a petition challenge brought by Jane Faust against Patrick Murphy, a candidate for the 8th Congressional District in Pennsylvania.
Josh Nanberg, Murphy's campaign manager, stated, "We won."
The case centered on objections to Murphy's nominating papers.
The judge threw the case out due to a part of the law which requires that any objections must be raised at least seven days prior to the court case to allow the defendant time to collect evidence.
The objections in this case were brought the day of the trial.
Jen Paski, a spokeswoman for the Democratic Congressional Campaign Committee said, “We were very distressed by this challenge and we are absolutely thrilled that it failed."
The lawyer who filed the challenge on behalf of Faust has stated that he will continue the case, and will attempt to bring it to the state Supreme Court, the Pennsylvania Supreme Court.
Iran tests its second missile

Iran has successfully tested the Kowsar land-to-sea missile, and a "flying boat", Iran state media report.
According to the country's state television service, "A super-modern flying boat was successfully tested in the 'Great Prophet' war game in Persian Gulf waters.
Because of its hull's advanced design, no radar at sea or in the air can locate it.
It can lift out of the water.
It is wholly domestically built and can launch missiles with precise targeting while moving."
Iran says that the Kowser missile can be used to sink enemy ships in the Gulf.
Iran also announced that the missile's onboard systems could not be scrambled by enemy action.
Brian Whitman, a spokesman for the Pentagon in the United States, said, "We know that the Iranians are always trying to improve their weapons system by both foreign and indigenous measures.
It's possible that they are increasing their capability and making strides in radar-absorbing materials and technology.
[However] the Iranians have also been known to boast and exaggerate [in] their statements about greater technical and tactical capabilities."
On Friday, Iran tested its Fajr-3 missile, which Iran says can evade radar and can carry many warheads.
On Monday, Iran tested in the Straits of Hormuz a torpedo that the country claims can evade sonar.
It is estimated that at least 1500 ships and aircraft, and at least 17,000 Iranian Revolutionary Guard troops, are participating in a week-long war games exercise in the Gulf.

Two other swans found in Richmond Park in Glasgow are being tested for the H5N1 virus.
They are among at least 14 other dead birds and 12 more swans found in Glasgow, that are being tested for the H5N1 virus.
This is the United Kingdom's first confirmed case of the H5N1 virus and would make the U.K. the 14th country to report the virus.
"The risk to humans has not changed by the fact that we have found the virus in the U.K..
There is a better chance of a person winning the national lottery than catching bird flu in the U.K. today," said Doctor Jim Robertson from the National Institutes for Biological Standards and Control in a press conference.
"We also have to work on the assumption that there is some spread among wild birds.
There is no doubt we are getting closer to the day when moving birds indoors will be necessary," said former President of the British Veterinary Association, Bob McCracken.
"The situation is that the virus is there, and it will probably continue to circulate among the birds.
It will spread through close contact, irrespective of species.
There is one big question mark: Will the virus disappear from wild birds after a period of six months, or will it still be present after a period of six years?"
added McCracken.
McCracken also said that the virus could turn up in more birds saying, "I would start from the assumption that a small pool of wild birds in the Fife area are infected and potentially passing it on to other birds" and that seagulls could pose a threat of passing on the virus because they have been known to peck at the bodies of other dead birds that were infected.
"We have to assume that," he said.
In a statement by the Department for Environment, Food and Rural Affairs, released yesterday, the Scottish Executive confirmed that a "highly pathogenic H5 avian flu" virus was found in a sample taken from the dead swan.
The swan was discovered March 29, 2006 and has been confirmed as a domestic species and officials say that it may have caught the virus from another infected bird.
Officials also report that the area where the swan has been found is being sealed off.
"In accordance with a recent EU decision the Scottish Executive is putting in place a protection zone of a minimum of three kilometres radius and a surveillance zone of 10 kilometers.
Keepers of birds in the protection zone are being instructed to isolate their birds from wild birds, by taking them indoors where ever possible," said the Scottish Executive in a statement.
Samples from the swan were sent to the European Union Bird Flu Laboratory at Weybridge.
"Bird keepers outside the protection zone should redouble their efforts to prepare for bringing their birds indoors if that becomes necessary.
They must also review their biosecurity measures to ensure that all possible precautions have been taken," said Charles Milne, Chief Veterinary Officer for Scotland yesterday in the statement.
An exercise named 'Exercise Hawthorn' was to prepare people for a possible pandemic was taking place yesterday and was halted just after the discovery of the dead swan.
Officials were in the second phase of the exercise.
Taking part in the exercises were the Ministry of Defence, the Association of Chief Police Officers, the Environment Agency and several other areas of the British government.
"I brought to an end the national avian influenza exercise to ensure that we can bring all our resources to bear on this situation.
We are already in a high state of readiness and I have every confidence that officials north and south of the border will work together to manage this incident successfully," said the United Kingdom's Chief Veterinary Officer, Debby Reynolds.
However; today Reynolds stated "there is no reason for public health concern" and also stated that in order for Bird Flu to infect humans, it would require "extremely close contact with infected birds, particularly feces."
According to the World Health Organization H5N1 has killed 109 people worldwide since 2003.
U.S. jury decision moves Moussaoui closer to execution

A United States federal jury found that self-confessed al-Qaida conspirator Zacarias Moussaoui may, according to U.S. law, be put to death after deciding that his statements to FBI agents led directly to at least one death in the terrorist attacks on September 11, 2001.
Moussaoui is alleged to have had prior knowledge of the 9/11 attacks, but did not inform FBI agents of it.
Evidence of Moussaoui's knowledge of 9/11 attacks are based on Moussaoui's own testimony, and some al-Qaida members have said that "he knew nothing" and is "boasting" of it and that Ramzi Binalshibh is the actual '20th hijacker'.
Aaron Zebley, one of the FBI's two chief case agents on the Moussaoui investigation, also testified that "Moussaoui knew nothing about some key elements" of the 9/11 plot.
Moussaoui is the only person to face charges in connection with the 9/11 attacks.
It was not expected that Moussaoui would testify on his own behalf during the trial, but he changed his mind and testified in the last week of March that he was supposed to fly a plane with the "shoe bomber" on 9/11.
Moussaoui's lawyers said that his claim was absurd and that Moussaoui was intentionally trying to elicit an execution for martyrdom purposes.
Moussaoui refused to stand and prayed silently as the verdict was read.
"You'll never get my blood, God curse you all," Moussaoui said after the jurors had left the courtroom.
The jury took four days to arrive at the verdict.
"By this verdict, the jury has found that death is a possible sentence in this case," a court spokesman said.
On the key question before the jurors, they answered yes on whether at least one victim died on 9/11 as a direct result of Moussaoui's actions.
If the jury had voted against his eligibility for the death penalty, Moussaoui would have been sentenced to life in prison.
The jury began weighing Moussaoui's fate last Wednesday.
During its deliberations, jurors asked only one question, seeking a definition of a "weapon of mass destruction."
One of the three convictions for which Moussaoui could be put to death is conspiracy to use weapons of mass destruction.
The jurors were told that a plane used as a missile (the tactic employed on 9/11) qualifies as a weapon of mass destruction.
Moussaoui pleaded guilty April 2005 to conspiring with al-Qaida to hijack aircraft and other crimes.
At the time, he denied being part of the 9/11 plot, saying he was being trained for a separate attack, but he changed his testimony when he took the stand and claimed he was supposed to have flown a hijacked jetliner into the White House that day.
Moussaoui was in jail at the time of the attacks, but prosecutors argue federal agents would have been able to stop or at least minimize the attacks if he had revealed his al-Qaida membership and his terrorist plans when he was arrested and interrogated by federal agents.
The last people executed without killing anyone were Julius and Ethel Rosenberg fifty years ago.
Next phase of the trial
Now that this first phase of the trial to decide possible penalties is established, the jury of nine men and three women will hear more testimony, expected last as long as 3-months, on whether the 37-year-old Frenchman will face life imprisonment or execution.
Testimony will include the families of 9/11 victims who will describe the human toll of the al-Qaida operation, in which four passenger airliners were taken over and two were flown to New York City and crashed into the World Trade Center, a third airplane struck the Pentagon, and the last crashed in a field near Shanksville, Pennsylvania apparently, after passengers intervened.
Court-appointed defense lawyers, whom Moussaoui has tried to reject, will summon experts to suggest he is schizophrenic after a cruel childhood during which he faced racism in France over his Moroccan ancestry.
University of Florida wins NCAA basketball championship

The University of Florida Gators beat the University of Calfornia, Los Angeles Bruins 73-57 in the RCA Dome last night.
The win gave the Gators their first NCAA basketball championship.
The Gators, a number three seed in the tournament, spent most of the night dominating the Bruins on both offense and defense.
Joakim Noah, center for the Gators, recorded 16 points, nine rebounds, and a NCAA tournament championship game record 6 blocks.
Noah said, "It's like I'm in a cloud.
Not only does this feel good, but it smells good and it tastes good.
I can't even describe it."
In the previous two games the Bruins allowed only a combined 90 points, but they never seemed to get organized on defense.
Florida's early lead stayed throughout the game, with the Bruins unable to re-take the lead.
Joakim Noah's father Yannick Noah was a French tennis player (now a singer) who won the Roland Garros tennis tournament.
His grandfather was a soccer professional.
It's the first time a french basketball player has been part of a winning NCAA basketball championship team.
He'll join Tony Parker on the French national basketball team.
Apple releases program to limit iPod volume

Apple has released an application that limits the volume produced from its iPod portable music players.
The software update, iPod Software 1.1.1, works with the iPod Nano and the Video version.
Apple released the program in response to complaints that it had not taken necessary measures to prevent hearing loss in iPod users.
In California, a class-action lawsuit was filed against Apple in January over claims of hearing loss from iPod use.
Apple's worldwide vice-president of marketing for the iPod, Greg Joswiak, indicated that this patch is available for people who want "an easy-to-use option to set their own personal volume limit."
It is available for free download.
The software also has the option of being used with parental controls to prevent children from modifying the volume.
iPods sold in France already have the volume limited, as the law forbids a sound louder than 100 decibels (dB).
The American Speech Language Hearing Association published a study where it appears that iPod's (and mp3 players's) power is 120 dB, comparable to a live concert.
A gunshot is 140 dB.
Flooding Danube threatens thousands

Budapest, Hungary – The Danube River, running from Germany to the Black Sea in Romania, is currently at 859cm (28 ft 2 in) higher than its normal level in Budapest.
Climatologists are predicting that the river will crest as high as 865 cm (28' 5").
This places the crest higher than in 2002, when floods swept across all Europe.
The Danube crested at 860 cm (28' 3") high then.
According to officials, 11,000 buildings are in danger of flood damage, and 172 hectares (475 acres) of land are currently under water.
Officials also placed the country under a Level 3 Alert (on a 3 level scale).
Margit Island is completely under water, with 3500 sandbags giving it protection.
The riverside is no less under water, and the underground number 2 (M2) is currently in danger of being closed since one of its stations, Battyány tér, is flooded.
According to Hungarian Water engineers, a flood of this magnitude hasn't occured since 1838 when ice coming down the river blocked the Danube, creating a natural dam which caused the water to flood everything behind it.
General elections are on Sunday in Hungary.
The election is heated with MSZP and FIDESZ in a virtual dead heat with polls rating both at 45%.
Other smaller parties are voicing concern about gaining a 5% toe-hold to gain a seat in Parliament.
It is not yet clear how the flood will impact the final campaign.
Tom DeLay will not seek re-election; to resign from Congress

According to various news reports, former United States House Majority Leader Tom DeLay (R-Texas) will announce his withdrawal from the Congressional race on Tuesday, April 4, 2006.
In an interview on Monday, April 3, 2006, DeLay spoke with Time Magazine's White House correspondent Mike Allen, revealing his plans to give up his bid for re-election to the House seat representing the 22nd District in Texas.
In addition, DeLay said that he plans to leave Congress in the next few months, though he has not yet decided on the date.
DeLay's office released a taped statement to media outlets on April 4, 2006 that addressed his decision to resign from Congress.
"I will make that resignation effective sometime before mid-June, but largely dependent on the congressional calendar.
I plan to begin focusing on the next phase of my life as a private citizen."
DeLay's statement points to "negative, personal campaign[ing]" by "liberal Democrats" as a reason behind his resignation.
He plans to determine "new ways from various arenas outside of public office that will allow me to continue to contribute to and engage in the policy, political, and cultural issues of national importance to the conservative majority."
DeLay will be moving from Texas to his property in Virginia in order to be closer to Washington, DC.
DeLay has served in Congress for 11 terms.
He temporarily gave up his seat as House Majority leader in 2005 after he was indicted in Texas on money laundering charges and then permanently relinquished his House leadership position in January 2006.
DeLay has allegedly been linked to lobbyist Jack Abramoff, who in January 2006 entered a guilty plea to charges of conspiracy to corrupt public officials, mail fraud, and tax evasion.
Judge throws out petition case against Patrick Murphy in PA Congressional race

On Friday, Judge Robert Simpson Jr.
threw out a petition challenge brought by Jane Faust against Patrick Murphy, a candidate for the 8th Congressional District in Pennsylvania.
Josh Nanberg, Murphy's campaign manager, stated, "We won."
The case centered on objections to Murphy's nominating papers.
The judge threw the case out due to a part of the law which requires that any objections must be raised at least seven days prior to the court case to allow the defendant time to collect evidence.
The objections in this case were brought the day of the trial.
Jen Paski, a spokeswoman for the Democratic Congressional Campaign Committee said, “We were very distressed by this challenge and we are absolutely thrilled that it failed."
The lawyer who filed the challenge on behalf of Faust has stated that he will continue the case, and will attempt to bring it to the state Supreme Court, the Pennsylvania Supreme Court.
Iran tests its second missile

Iran has successfully tested the Kowsar land-to-sea missile, and a "flying boat", Iran state media report.
According to the country's state television service, "A super-modern flying boat was successfully tested in the 'Great Prophet' war game in Persian Gulf waters.
Because of its hull's advanced design, no radar at sea or in the air can locate it.
It can lift out of the water.
It is wholly domestically built and can launch missiles with precise targeting while moving."
Iran says that the Kowser missile can be used to sink enemy ships in the Gulf.
Iran also announced that the missile's onboard systems could not be scrambled by enemy action.
Brian Whitman, a spokesman for the Pentagon in the United States, said, "We know that the Iranians are always trying to improve their weapons system by both foreign and indigenous measures.
It's possible that they are increasing their capability and making strides in radar-absorbing materials and technology.
[However] the Iranians have also been known to boast and exaggerate [in] their statements about greater technical and tactical capabilities."
On Friday, Iran tested its Fajr-3 missile, which Iran says can evade radar and can carry many warheads.
On Monday, Iran tested in the Straits of Hormuz a torpedo that the country claims can evade sonar.
It is estimated that at least 1500 ships and aircraft, and at least 17,000 Iranian Revolutionary Guard troops, are participating in a week-long war games exercise in the Gulf.

The Simpsons, a major hit animated television show, is set to appear in movie theatres.
It has been confirmed that The Simpsons Movie will appear in theatres July 27, 2007.
The Simpsons has been on television for 17 seasons and FOX confirms that it will run at least two more seasons.
The show is currently contracted through FOX until 2008 and is the longest running television show on prime-time in the United States.
An estimated over nine million people watch the show every Sunday night, but that number is down from earlier peak viewer numbers.
Moviegoers that go to see Ice Age: The Meltdown will get to see a 25-second 'teaser' trailer of the upcoming movie.
The Simpsons first began on the The Tracey Ullman Show in 1987 and in 1989 they started their 30-minute series on FOX.
Iraq war vet claims atrocities by U.S. soldiers

Joshua Key, a 27-year-old U.S. war deserter, alleged to a Canadian Immigration and Refugee Board yesterday that American soldiers had been kicking the severed head of an Iraqi in Ramadi "like a soccer ball."
"I couldn't believe someone could do that to a human being," said Key, who is the first U.S. army deserter to make application for refugee status after serving in Iraq.
The U.S. Army's attitude in Iraq was "just shoot and ask questions later," according to Key.
He said, "It's like people could kill if they just wanted to.
Everything is justified."
Key also claimed to have witnessed a "trigger happy" platoon squad sergeant shooting part of an unarmed Iraqi man's foot off after the man had raised his foot as a sign of disrespect.
There are five members of the U.S. armed forces requesting asylum in Canada but Key is the only applicant who has combat experience in Iraq, said Key's lawyer, Jeffry House.
"He has boots-on-the-ground experience about what the actual conduct of the war in Iraq is," House said.
Key also said at the hearing; "(Iraqis) are just normal people.
They're farmers, mothers, fathers; just like us, just like my home country.
I didn't see why we was there."
Key now works as a welder in British Columbia where he and his wife have four children under six years of age.

Death toll of Bahrain tourist boat capsizing rises to 57

At least 57 people are now known to have died when a boat designed similar to a traditional dhow capsized one mile of the coast of Bahrain in the Persian Gulf.
Seventeen were Indian and a further 13 of the dead are British; people of another six nationalities are also known to have died.
