1. Plaintiffs are, and were at all times herein mentioned, domiciled in and citizens of the State of California. Defendants, MAY FORRESTER, HARRY RICE Y HARVEY RICE, are and were at all times herein mentioned, domiciled in and citizens of the State of Nevada. Defendant, PARADISE FOUND, INC., was and is now a corporation duly organized and existing under the laws of the state of Idaho, with its offices and principal place of business in the state of Idaho. This is a civil action involving, exclusive of interest and costs, a sum in excess of $50,000. Every issue of law and fact in this action is wholly between citizens of different states.
2. Plaintiffs are informed and believe and thereupon allege that Defendants, HARRY RACE Y HARVEY RICE, are a partnership doing business as HEARTH & HOME REAL ESTATE CO.
3. Plaintiffs are informed and believe and thereupon allege that Defendant, PARADISE FOUND, INC., is a corporation duly organized and existing under the law of the state of Idaho.
4. Plaintiffs are now, and at all times mentioned in this complaint have been residents of San Francisco County, California.
5. Plaintiffs are informed and believe and thereupon allege that at all times herein mentioned, each of the defendants was the agent and employee of each of the remaining defendants and in doing the things hereinafter alleged, was acting within the scope of said agency.
6. On or about June 1, 1995, in the City of Reno, State of Nevada, defendant MAY FORRESTER, made the following false and fraudulent representations to plaintiffs:
Defendant represented that certain real property was ideal vacation property, that said property had been approved for and was suitable for building, that said property abutted a manmade lake, and that said property was worth at least $60,000.
7. The representations made by the defendant were false in that said real estate property has not been approved nor is it suitable for building, it is not adjacent to any body of water, and was and is valued at less than $5,000.
8. Defendant, at the time she made said representations, knew them to be false and made the statements with the intent to defraud and deceive plaintiffs and to induce them to purchase that certain real estate property described above.
9. Plaintiffs at the time the representations were made believed them to be true and had no reasons to believe that said representations were untrue. In reliance upon said representations, plaintiffs were induced to, and did, purchase the above described real property. Had plaintiffs known the true facts they would not have taken such action.
10. By reason of the facts alleged, plaintiffs have been damaged in the sum of $60,000.

8. Al momento que hizo dichas declaraciones, la demanda sabía que eran falsas e hizo las declaraciones con el intento de defraudar y engañar a los demandantes y de inducirlos a comprar ese inmueble descrito anteriormente.
9. Al momento en que se hicieron las declaraciones, los demandantes las creían de ser verdaderas y no tenían ninguna razón de creer de dichas declaraciones eran falsas. En confianza en dichas declaraciones, los demandantes fueron inducidos a comprar el inmueble descrito anteriormente y lo hicieron. Si los demandantes supieron los hechos verdaderos, no hubieron tomado dicha acción.
10. Debido a los hechos alegados, los demandantes han sido perjudicados la suma de $60.000.

Presently before the Court is a Motion to Dismiss filed by Defendants Paris Devon (“Devon”) and Frank R. Seese (“Seese”) (collectively, the “Defendants”) requesting that this Court dismiss Plaintiff Albert Cheshire, Jr.’s (“Cheshire” o “Plaintiff”) Complaint against Defendants for lack of personal jurisdiction. Plaintiff has failed to respond to Defendants’ motion, despite being duly served. Thus, for the following reasons, this Court GRANTS Defendants’ Motion to Dismiss as uncontested pursuant to Local Rule 7.1(c) .1
I. BACKGROUND
Cheshire, a resident of Pennsylvania, initiated the instant action in this Court for injuries he sustained while riding as a passenger on a bus owned by Defendant Greyhound Lines, Inc. (“Greyhound”), a corporation of Texas, and operated by Defendant Donnell Merritt, a resident of Ohio. (Compl. at PP 1-3, 6.) Cheshire alleges that, on or about October 1, 2000, he was thrown from his seat when the negligently operated Greyhound bus he was riding on collided with a second motor vehicle that was also negligently operated. (Compl. at PP 6-7.) Cheshire alleges that the second motor vehicle is owned by, and was in the possession and control of, Devon, a resident of Ohio, when it collided with the Greyhound bus. (Compl. at P 20.) Cheshire also alleges, in the alternative, that the second motor vehicle, was owned by, and was in the possession and control of, Seese, at the time of the accident. (Compl. at P 23).
Cheshire’s Complaint contains no other jurisdictional averments pertaining to Defendants, and Defendants now move this court for dismissal for lack of personal jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(2).
II. STANDARD OF REVIEW
Federal Rule of Civil Procedure 12 provides that a matter may be dismissed for a court’s lack of personal jurisdiction over a litigant. Fed. R. Civ. P. 12(b)(2). A federal district court may assert personal jurisdiction over a nonresident of the state in which the court sits, to the extent authorized by the law of that state. Fed. R. Civ. P. 4(e). See Dunnigan v. Silverthorn, 542 F. Supp. 32, 33 (E.D. Pa. 1982). The Pennsylvania Long-Arm Statute provides in relevant part, that “the jurisdiction of the tribunals of this Commonwealth shall extend…to the fullest extent allowed under the Constitution of the United States and may be based on the most minimum contact with this Commonwealth allowed under the Constitution of the United States.” 42 Pa. Cons. Stat. Ann,. § 5322(b). The Due Process Clause of the Fourteenth Amendment of the United States Constitution permits a court to exercise [the forum] such that the maintenance of the suit does not offend ‘traditional notions of fair play and substantial justice.’” International Shoe Co. v. Washington, 326 U.S. 310, 316, 90 L. Ed. 95, 66 S. Ct. 154 (1945) (citando Milliken v. Meyer, 311 U.S. 457, 463, 85 L. Ed. 278, 61 S. Ct. 339 (1940)). The nature of these contacts must be such that the defendant should be reasonably able to anticipate being haled into court in the forum state. World-Wide Volkswagen Corp. v. Woodson, 444 U.S. 286, 297, 62 L. Ed 2d 490, 100 S. Ct. 559 (1980).
When a defendant raises a personal jurisdiction defense, the burden rests with the plaintiff to establish with “reasonable particularity” sufficient contacts between the defendant and the forum state to support jurisdiction. Provident Nat. Bank v. Cal. Fed. Sav. & Loan Ass’n, 819 F.2d 434, 437 (3d Cir 1987). To meet this burden, the plaintiff must establish either that the particular cause of action arose from the defendant’s activities within the forum state - specific jurisdiction - or that the defendant has “continuous and systematic” contacts with the forum state - general jurisdiction. Id. (citing Helicopteros Nacionales de Colombia, S.A. v. Hall, 466 U.S. 408, 414, 80 L. Ed. 2d 404, 104 S. Ct. 1868 (1984)).
Prior to trial, a plaintiff need only make a prima facie showing of jurisdiction. Mellon Bank (East) PSFS, Nat’l Ass’n v. Farino, 960 F.2d 1217, 1223 (3d Cir. 1992). A plaintiff’s jurisdictional allegations will be taken as true and factual disputes are resolved in the plaintiff’s favor. Aircraft Guaranty Corporation v. Strato-Lift, Inc., 974 F. Supp. 468, 471 (E.D. Pa. 1997).

Ante el Tribunal está presente una Moción de Desestimación solicitada por los Demandados Paris Devon (“Devon”) y Frank R. Seese (“Seese”) (colectivamente, los “Demandados”) pidiendo que este Tribunal desestime la Demanda del Demandante Albert Cheshire, Jr. (“Cheshire” o “Demandante”) contra los Demandados por motivos de una falta de jurisdicción personal. El Demandante ha fallado en responder a la moción de los Demandados a pesar de ser notificado debidamente. De este modo, por las siguientes razones, este Tribunal CONCEDE la Moción de Desestimación solicitada por los Demandados como si fuera no contenciosa acordemente con Regla Local 7.1(c) .1
I. ANTECEDENTES
Cheshire, un residente de Pennsylvania, inició la acción actual en este Tribunal por las heridas que él sufrió mientras montaba como pasajero en un autobús poseído por el Demandado, Greyhound Lines, Inc. (“Greyhound”), una corporación de Texas, y operado por el Demandado Donnell Merritt, un residente de Ohio. (Compl. a PP 1-3, 6.) II. ESTÁNDAR DE REVISIÓN

P. 12(b)(2). (d)(1) [§3] No employer having employees subject to any provisions of this section shall discriminate, within any establishment in which such employees are employed, between employees on the basis of sex by paying wages to employees in such establishment at a rate less than the rate at which he pays wages to employees of the opposite sex in such establishment for equal work on jobs the performance of which requires equal skill, effort, and responsibility, and which are performed under similar working conditions, except where such payment is made pursuant to (i) a seniority system; (ii) a merit system; (iii) a system which measures earnings by quantity or quality of production; or (iv) a differential based on any other factor other than sex: Provided, That an employer who is paying a wage rate differential in violation of this subsection shall not, in order to comply with the provisions of this subsection, reduce the wage rate of any employee.
(2) No labor organization, or its agents, representing employees of an employer having employees subject to any provisions of this section shall cause or attempt to cause such an employer to discriminate against an employee in violation of paragraph (1) of this subsection.
(3) For purposes of administration and enforcement, any amounts owing to any employee which have been withheld in violation of this subsection shall be deemed to be unpaid minimum wages or unpaid overtime compensation under this chapter.
(4) As used in this subsection, the term “labor organization” means any organization of any kind, or any agency or employee representation committee or plan, in which employees participate and which exists for the purpose, in whole or in part, of dealing with employers concerning grievances, labor disputes, wages, rates of pay, hours of employment, or conditions of work.

BOGOTÁ, FEB 27 (AFP) – El Índice General de la Bolsa de Valores de Colombia (IGBC) cerró este lunes con baja de 2,13% respecto de rueda del viernes anterior, y concluyó la jornada en 11.022,09 puntos, informó la entidad.
El viernes el IGBC había registrado una alza de 0,12%, fijándose en los 11.262,25 puntos.
Los negocios de la jornada bursátil del lunes sumaron 147.689 millones de pesos (65,7 millones de dólares), que representaron 2.944 operaciones bursátiles.
De acuerdo con la Bolsa, “el mercado de renta variable de la jornada estuvo influenciada por la aprobación del Tratado del Libre Comercio (TLC) entre Colombia y Estados Unidos”, alcanzada el lunes temprano en Washington.

Hispanic Institute Unites Programs, Students

For years before earning a certificate in translation from La Salle in 2007, Cecilia Spearing had been an informal interpreter, bridging the language gap between her non-Spanish-speaking husband and her Puerto Rican family. Now, she provides interpreting services in courtrooms, school classrooms, and doctor’s offices.
“I always enjoyed interpreting because I could help people to understand each other more fully,” said Spearing, who also earned a master’s degree in bilingual/bicultural studies from La Salle in 1985. “It is a reality that we have people from many different cultures who live here. The more prepared people are to work with them, the better, so we can avoid confusion and misunderstanding.”
Promoting understanding and dialogue between cultures is one of the hallmarks of La Salle’s Hispanic Institute, which houses master’s degree programs in Bilingual/Bicultural Studies and Teaching English to Speakers of Other Languages (TESOL) as well as certificate programs in translation and English as a Second Language (ESL).
The seed was planted for the Hispanic Institute in 1982, when the master’s program in Bilingual/Bicultural Studies began. At first, the program attracted primarily social workers and teachers, but since then, a variety of professionals have enrolled to enhance their linguistic and cultural skills.
“From my perspective, the program prepares both Hispanic and non-Hispanic students for the professional world by preparing them to gain the necessary skills to become more culturally sensitive instructors, case-workers, medical professionals, or entrepreneurs,” said Steve Kopec, ’89, M.A. ’92, an adjunct instructor in the Bilingual/Bicultural Studies program, from which he is also a graduate. Additionally, Kopec directs La Salle’s Adult Learning Program, which offers several ESL classes, and teaches in the master’s program in TESOL.
Elise Favilla, who earned her master’s from the Bilingual/Bicultural Studies program in 2005, credits the program with helping her get a full-time teaching job at Camden County College. Growing up in Spain, Spanish was her first language, but she said she can now offer students a well-rounded education in language and culture.
“When you teach them that Hispanic people come from many countries and have unique traditions, backgrounds, and ways of life it becomes more than just a language,” Favilla said.
When the state began to require ESL instructors to be certified in the subject, La Salle responded by developing a program leading to ESL certification. A grant from the Philadelphia School District helped many city teachers meet the new requirements.
As these programs developed, according to Hispanic Institute Director Luis Gomez, Ph.D., the need emerged to organized existing programs dealing with Spanish language and culture under a unifying umbrella.
“The Hispanic Institute was created as an organizational entity to manage, control, and develop La Salle University’s response to the educational issues associated with demographic changes,” Gomez said. “In particular, the University is responding to changes related to the Hispanic population in need of services, and the non-Hispanic populations that are and will be crucial in assuring the successful integration of Hispanic immigrants into American society.”
The Institute also watches workplace trends to develop new programs for professionals who are working in the Hispanic community.

Por años antes de obtener un Certificado de Traducción de la Universidad de La Salle en 2007, Cecilia Spearing había sido intérprete informal, salvando la barrera idiomática entre su esposo no hispanohablante y su familia puertorriqueña. Ahora, provee servicios de interpretación en los tribunales, las escuelas y los consultorios médicos.
“Siempre disfruté de interpretar, porque podía ayudar a la gente a entenderse mejor”, dijo Spearing, quien también obtuvo una Maestría en Estudios Bilingües/Biculturales de La Salle en 1985. “Es una realidad que tenemos gente de varias culturas que viven aquí. Cuanto más preparadas estén las personas para trabajar con ellos, mejor; así podemos evitar confusión y malentendidos”.
Promover la comprensión y el diálogo es uno de los distintivos del Instituto Hispánico de La Salle, que administra los programas de maestría en Estudios Bilingües/Biculturales (Bilingual/Bicultural Studies) y Enseñanza del Inglés a Hablantes de Otros Idiomas (Teaching English to Speakers of Other Languages/TESOL) además de los certificados de Traducción e Inglés Como Segunda Idioma (English as a Second Language/ESL).
La semilla del Instituto Hispánico se sembró en 1982, cuando empezó el programa graduado de Estudios Bilingües/Biculturales. Al principio, la mayoría de estudiantes que el programa atraía eran asistentes sociales y profesores; pero, desde entonces, una variedad de profesionales se han matriculado para elevar sus habilidades lingüísticas y culturales.
“Desde mi perspectiva, el programa prepara a los estudiantes hispanos y no hispanos para el mundo profesional, preparándoles para obtener las destrezas necesarias para convertirse en profesores, asistentes sociales, profesionales médicos o empresarios con más sensibilidad cultural”, según declaró Steve Kopec, con título de licenciado en 1989 y con maestría en 1992, profesor adjunto en el programa de Estudios Bilingües/Biculturales, del que se graduó también. Además, Kopec dirige el Adult Learning Program (Programa de Enseñanza Adulta) de La Salle, el cual ofrece varias clases de ESL, y enseña en el programa de maestría en TESOL.
Elise Favilla, quien obtuvo su maestría en Estudios Bilingües/Biculturales en 2005, atribuye al programa su puesto de profesora en Camden County College. Al crecer en España, el español era su lengua nativa, pero ahora ella puede ofrecer una educación equilibrada de lenguaje y cultura a sus alumnos.
“Cuando se les enseña que los hispanos vienen de numerosos países y tienen tradiciones, orígenes y vidas distintas, se convierte en algo más que sólo un idioma”, opina Favilla.
Cuando el estado de Pensilvania empezó a requerir que los instructores de ESL tuvieron certificación en la materia, La Salle respondió desarrollando un programa con el fin de estar certificado en ESL. Una subvención del Distrito Escolar de Filadelfia ayudó a muchos profesores públicos a satisfacer los nuevos requisitos.
Según el Dr. Luis Gómez, Director del Instituto Hispánico, mientras se desarrollaban estos programas, surgió la necesidad de unificar los programas existentes de la lengua española y cultura hispana.
“El Instituto Hispánico se estableció como una entidad organizadora para dirigir, controlar y desarrollar la respuesta de la Universidad de La Salle a las cuestiones educativas asociadas con los cambios demográficos”, según declaró Gómez. “Particularmente, la Universidad está respondiendo a los cambios relacionados con la población hispana que necesita servicios, y con las poblaciones no hispanas que tienen, y tendrán, un papel crucial de asegurar la integración exitosa de los inmigrantes hispanos a la sociedad americana”.
El Instituto está atento a las tendencias del trabajo también, para desarrollar nuevos programas para los profesionales que trabajan en la comunidad hispana.
