Texte source - anglais 1. DUTIES OF THE DISTRIBUTOR
1.1 Throughout the duration of this Agreement the DISTRIBUTOR shall:
a. Undertake the promotion and sale of the PRODUCT in THE TERRITORY with diligence and energy and by the use of its best efforts and facilities, such promotion to include participation in trade fairs and exhibitions in THE TERRITORY. The promotion is to include local production of marketing materials/brochures in THE TERRITORY's language if required as well as advertising the PRODUCT in appropriate media.
b. Not sell goods which compete with this PRODUCT.
c. Notify XXXX within three business days after receipt at the DISTRIBUTOR's premises thereof of any noticeable damage and shortages to PRODUCT received from XXXX In the absence of such notification within such period the DISTRIBUTOR shall be deemed to have accepted the PRODUCT.
d. Obtain all import licenses and pay all duties, levies, landing charges, taxes or other imports payable in respect of the importation, distribution or sale of the PRODUCT in THE TERRITORY.
e. Obtain any exchange control or administrative consents necessary to effect payment for the PRODUCT.
f. Register the PRODUCT as required registration if applicable with government agencies in THE TERRITORY other than the CE mark and where permitted, such registrations shall be jointly in the name of the Principle and the Distributor, failing which, all fees associated with this registration process will be the responsibility of the DISTRIBUTOR.
g. Obtain all necessary consents for the promotion, distribution and sale of the PRODUCT in THE TERRITORY and conduct the promotion, distribution and sale of the PRODUCT in THE TERRITORY strictly in accordance with the terms of such consents and with all applicable laws and regulations of the competent authorities.
h. Maintain insurance at all times for all PRODUCT stored at the premises of the DISTRIBUTOR or such other location as the DISTRIBUTOR determines. The PRODUCT shall be insured for a value of not less than the cost of having to replace them at the expense and cost of the DISTRIBUTOR.
i. Inform XXXX promptly of any factors (whether of a legal, scientific or other nature) which may affect the marketing of the PRODUCT in THE TERRITORY and to keep XXXX informed of the requirements of the law of THE TERRITORY regarding the PRODUCT and the manufacturing and labeling thereof.
j. Not to seek actively to promote the PRODUCT outside THE TERRITORY nor establish any branch office outside of THE TERRITORY for the sale or promotion of the PRODUCT without written consent from XXXX.
k. Not to make any statement or representation concerning the PRODUCT other than those contained in the provided current literature from time to time or those which shall have been approved in writing by XXXX.

1.1 Le DISTRIBUTEUR sera tenu aux obligations suivantes pendant toute la durée du présent Contrat :

La promotion impliquera également, si besoin, la production de supports marketing/brochures au niveau local dans la langue du TERRITOIRE ainsi que la diffusion de publicités sur les médias appropriés.
b. Ne pas commercialiser de produits entrant en concurrence avec les PRODUITS.
c. Signaler à XXXX, dans un délai de trois jours ouvrables suivant la réception des PRODUITS dans les locaux du DISTRIBUTEUR, les éventuels dégâts visibles ou articles manquants parmi les PRODUITS expédiés par XXXX. En l’absence de notification pendant ledit délai, le DISTRIBUTEUR sera réputé avoir accepté les PRODUITS.
d. Se procurer toutes les licences d’importation et régler tous les droits, impôts, redevances d’atterrissage, taxes et autres redevances relatives à l’importation, la distribution ou la vente des PRODUITS dans LE TERRITOIRE.
e. Se procurer toutes les autorisations administratives et de contrôle des changes nécessaires pour effectuer le règlement des PRODUITS.
f. Réaliser, conformément aux protocoles qu’XXXX devra approuver,
g. Enregistrer les PRODUITS conformément aux règles en vigueur, le cas échéant, auprès des agences gouvernementales du TERRITOIRE, outre la question du marquage CE, et, lorsque c’est autorisé, cet enregistrement devra être fait au nom de la Société principale et du Distributeur, faute de quoi tous les droits associés à cet enregistrement seront à la charge du DISTRIBUTEUR.
h. Se procurer toutes les autorisations nécessaires à la promotion, la distribution et la vente des PRODUITS dans LE TERRITOIRE et assurer la promotion, la distribution et la vente des PRODUITS dans LE TERRITOIRE dans le strict respect des règles énoncées dans lesdites autorisations et des dispositions légales et réglementaires imposées par les autorités compétentes.
i. Contracter une assurance couvrant à tout moment l’ensemble des PRODUITS entreposés dans les locaux du DISTRIBUTEUR ou dans toute autre structure choisie par le DISTRIBUTEUR. Les PRODUITS devront être assurés pour une valeur au moins égale aux coûts dont le DISTRIBUTEUR aurait à s’acquitter pour assurer leur remplacement.
j. Informer XXXX dans les meilleurs délais de tout facteur (de nature juridique, scientifique ou autre) susceptible d'affecter la commercialisation des PRODUITS dans LE TERRITOIRE et tenir XXXX informé des obligations légales en vigueur dans LE TERRITOIRE concernant les PRODUITS, leur fabrication et leur étiquetage.
k. Ne pas tenter de promouvoir les PRODUITS de manière active à l’extérieur du TERRITOIRE et ne pas créer de succursale extérieure au TERRITOIRE en vue d’assurer la vente ou la promotion des PRODUITS sans accord écrit de la part d’XXXX.
S’abstenir de toute affirmation ou allégation concernant les PRODUITS qui s’écarterait des informations contenues dans les documents fournis occasionnellement ou de celles qui auront fait l’objet d’une approbation écrite de la part d’XXXX.

Texte source - anglais There is an aura of nostalgia to the scene, and nostalgia always means we are in the presence of something dead, if not yet emotionally over with - something that endures in memory, and, while it no longer shapes the living moment, unconsciously influences the sense of a life as a whole. Nostalgia is a way of processing the past without ever letting go of it. In other words, Fehér’s figures are endowed with absence rather th an presence, and they are experienced as if in aglass darkly. They convey the melancholy of the past, a melancholy that seems as eternal as the figures, fixed in form and space like timeless statues. The static character of the scenes - their concentrated stillness - seems fatalistic. Fate has indeed overtaken Fehér’s figures, but they have no idea that it lay in wait for them. The incongruity between the everyday figures and the abstract wasteland they inhabit makes for a weird tension and anxiety. There is another tension, inducing another kind of anxiety: the incongruity between the elusive figures and the things they share their space with, which are also rendered schematically, but are more conspicuously concrete, for they are opaque rather than transparent, material rather than immaterial, solid rather th an porous. Thus, there is a double paradox. On the one hand, the figures are as disembodied as the space, and invaded by its abstract emptiness. They are simple, fragile outlines inscribed in its flatness - transient, finite apparitions within its infinite extension. We see through them to the nothingness, suggesting their own nothingness: they are whimsical hallucinations, on the verge of dissolving into space, confirming their illusory nature. On the other hand, they are comfortably ensconced in a very modern, functional world. They live in modern houses (XXX, 1991), which have modern chairs and modern coftee tables (XXX II), and live in a society that builds modern bridges (XXX, 1989). All these modern things are as fiat - one-dimensional - and abstract as the picture plane, confirming that Fehér paints modern pictures, if with an emotional catch.

On se trouve donc face à un double paradoxe. D’un côté des personnages aussi désincarnés que l’espace et envahis par le vide abstrait qui le constitue. Ce sont des silhouettes simples, fragiles, intégrées à sa planéité, des apparitions transitoires, finies, perdues dans son domaine infini. Le néant se donne à voir à travers eux, suggérant leur propre néant : ce ne sont que capricieuses hallucinations prêtes à se dissoudre dans l’espace, confirmant ainsi leur nature illusoire. D’un autre côté, ils sont confortablement installés dans un monde fonctionnel ultra moderne. Ils vivent dans des maisons modernes (Freunde, 1991) dotées de chaises modernes et de tables basses modernes (Raucher II), et ils vivent dans une société qui construit des ponts modernes (Paar et Var der Brücke, 1989).
