Memorandom of Understanding
between
the Minister of Agriculture, Agri-Food and Forestry of the Republic of France
and
the Minister of Agriculture and Rural Development of the Republic
of the Socialist Republic of Vietnam
on cooperation in the agricultural sector
The Minister of Agriculture, Agri-Food and Forestry of the Republic of France and the Minister of Agriculture and Rural Development of the Socialist Republic of Vietnam, hereafter named ≪ the Parties ≫,
BUILDING on the strategic partnership signed between France and Vietnam and the fruitful past experiences of cooperation between the Parties,
CONSIDERING the strategies and priorities of the Parties and in particular the importance for them to develop a satisfactory agricultural production in both quantity and quality, and at the same time to ensure its sustainability,
DEFENDING the principle of strong agricultural policies as essential to food security and economic prosperity, in particular in rural areas,
BASING on the opportunity to promote food products diversity and quality and the necessity to ensure food safety for consumers,
CONSIDERING the need to promote trade of agricultural and food goods based on international sanitary and phyto-sanitary standards, adopted by the World Organization for Animal Health (OIE), the International Plant Protection Convention and the Codex Alimentarius Commission,
HOPING to develop, based on reciprocity and mutual interest, cooperation and exchanges between the competent authorities and scientific, technical and training institutions operating in the field of agriculture,
RECOGNIZING the skills, know-how and the potentials that exist in each of the two countries in this field,
Have agreed as follows:
Article 1 - Scope of application
The Parties agree to strengthen their communication and cooperation in areas of common interest and in particular:
- development of the agriculture and forestry sectors and of public policies in the areas of agriculture, forestry and rural development;
- promotion of sustainable agricultural and forestry practices (including agro-ecology) in order to preserve soil and water resources, protect biodiversity and prevent or mitigate climate change;
- protection of the agricultural sector against natural disasters and similar risks;
- development of agrifood industries, especially in terms of value chains organization, quality control, promotion of international commercial exchanges and business linkage between the Parties;
- trade-related sanitary and phytosanitary issues in order to facilitate technical communication between the Parties;
- promotion of food products diversity and quality and development of public policies regarding food safety, especially in terms of institutional organization, capacity building and human resources training;
- development of high agricultural technology on flower, fruit and vegetable production including agrifood industries, post harvesting and processing;
- Exchange information on agricultural market;
- promote cooperation on the Convention on International Trade in Endangered Species of Wild Fauna and Flora;
- higher agricultural education and academic exchanges.
An annexed action plan states the priority projects for the beginning of the cooperation between the Parties.
Article 2 - Implementation
The Parties may designate operators to implement some of the areas of cooperation identified in this administrative arrangement.
The Ministry of Agriculture, Agri-Food and Forestry of the Republic of France may notably rely on AGREENIUM (consortium of key agencies of research, development and higher education in the agronomic and veterinary field in France) and the public interest group ADECIA for cooperation actions falling within their respective areas of competence.
The Parties define precisely the objectives for each of the areas of cooperation.
They undertake to facilitate the linkage between relevant organizations and companies of the two countries in each of the areas of cooperation.
Article 3 - Conditions of application
All actions taken pursuant to this administrative arrangement are subject to the budget and human resources that the Parties have at their disposal annually for their day-to-day operation. They must comply with legislative and regulatory provisions applicable in each Parties. Each action is the subject of a detailed financing plan, defined on a case by case basis and at the start of the action under review; the financial participation of each of the Parties is clearly specified.
The provisions of this administrative arrangement may be amended by mutual consent of the Parties.
This administrative arrangement does not influence nor affect the rights and obligations contracted by one of the Parties to a third party.
This arrangement can give rise, where necessary, to the signing of agreements between counterparts.
Article 4 – Follow up and coordination
The Parties shall ensure regular monitoring of the actions implemented under the administrative arrangement. The action plan may be updated annually, possibly during meetings between the Parties.
Any dispute concerning the interpretation or implementation of this administrative arrangement is settled by consultation or negotiation between the Parties.
The Parties shall meet once every two years to review the process of cooperation, taking place in French and Viet Nam alternatively.
Article 5 – Entry into force, duration and termination
This administrative arrangement shall enter into force on the date of its signature. It is concluded for a period of five years, tacitly renewable for equal periods. It may be terminated at any time by one of the Parties after a written notice of six months.
Issued in XX, on XX XX 2013, in two original copies, each in French and Vietnamese languages, the two language versions being equally authentic.

XEM XÉT các chiến lược và những ưu tiên của các Bên và đặc biệt là tầm quan trọng của phát triển sản xuất nông nghiệp thỏa đáng cả về số lượng và chất lượng, song song với phát triển bền vững,
BẢO VỆ nguyên tắc của các chính sách nông nghiệp hiệu quả được xem như yếu tố tiên quyết đối với an ninh lương thực và phát triển kinh tế, đặc biệt ở những vùng nông thôn,
DỰA TRÊN cơ hội thúc đẩy đa dạng hóa thực phẩm nông nghiệp và sự cần thiết phải đảm bảo an toàn thực phẩm cho người tiêu dùng,
XEM XÉT nhu cầu xúc tiến thương mại các sản phẩm nông nghiệp và thực phẩm dựa trên các tiêu chuẩn vệ sinh và vệ sinh thực vật quốc tế, đã được Tổ chức Thú y Thế giới (OIE), Công ước Quốc tế về Bảo vệ Thực vật và Ủy ban Tiêu chuẩn hóa Thực phẩm thông qua,
HY VỌNG phát triển, dựa trên trao đổi và lợi ích song phương, hợp tác và giao lưu giữa các cơ quan có thẩm quyền và các viện khoa học, kỹ thuật và đào tạo hoạt động trong lĩnh vực nông nghiệp,
CÔNG NHẬN những kỹ năng, bí quyết và tiềm năng hiện có của mỗi quốc gia trong lĩnh vực này,
Các Bên thống nhất như sau:
Điều 1 - Phạm vi Áp dụng
Các Bên đồng ý tăng cường giao tiếp và hợp tác ở các lĩnh vực hai bên cùng quan tâm, đặc biệt là:
- phát triển các ngành nông nghiệp và lâm nghiệp và các chính sách xã hội trong lĩnh vực nông nghiệp, lâm nghiệp và phát triển nông thôn;
- Xúc tiến các thông lệ hoạt động nông nghiệp và lâm nghiệp bền vững (kể cả nông nghiệp sinh thái) nhằm bảo tồn tài nguyên đất và nước, bảo tồn đa dạng sinh học và ngăn ngừa hoặc giảm nhẹ biến đổi khí hậu;
- Bảo vệ ngành nông nghiệp trước những thảm họa thiên nhiên và những rủi ro tương tự;
- Phát triển ngành chế biến thực phẩm nông nghiệp, đặc biệt trong lĩnh vực tổ chức chuỗi cung ứng, kiểm soát chất lượng, khuyến khích trao đổi thương mại quốc tế và liên kết kinh doanh giữa các Bên;
- Các vấn đề vệ sinh và vệ sinh thực vật liên quan đến thương mại nhằm tạo điều kiện cho việc trao đổi kỹ thuật giữa các Bên;
- Khuyến khích đa dạng hóa các sản phẩm lương thực, nâng cao chất lượng và phát triển các chính sách xã hội liên quan đến an toàn thực phẩm, đặc biệt trong tổ chức thể chế, xây dựng năng lực và đào tạo nguồn nhân lực;
- Phát triển công nghệ nông nghiệp cao trong lĩnh vực sản xuất hoa và rau quả, trong các ngành ngành chế biến lương thực, sau thu hoạch và chế biến;
- Trao đổi thông tin về thị trường nông nghiệp;
- khuyến khích hợp tác dựa trên Công ước quốc tế về buôn bán các loại động, thực vật hoang dã nguy cấp;
- trao đổi giáo dục hàn lâm và sau đại học trong lĩnh vực nông nghiệp
Kế hoạch hành động có phụ lục kèm theo nêu rõ những dự án ưu tiên thực hiện nhằm khởi đầu quan hệ hợp tác giữa các Bên.
Điều 2 - Tổ chức Thực hiện
Các Bên có thể chỉ định các cơ quan quản lý thực hiện một số lĩnh vực hợp tác đề ra trong bản thoả thuận này.
Bộ Nông nghiệp, Thực phẩm Nông nghiệp và Lâm nghiệp nước Cộng hòa Pháp có thể ủy thác cho AGREENIUM (Hiệp hội các cơ quan nghiên cứu, phát triển và giáo dục sau đại học trong lĩnh vực nông học và thú y tại Pháp) và nhóm lợi ích công cộng ADECIA thực hiện một số hoạt động hợp tác căn cứ vào những thế mạnh riêng của các cơ quan đó.
Các Bên xác định chính xác các mục tiêu của từng lĩnh vực hợp tác cụ thể.
Các bên tạo điều kiện để các tổ chức và công ty có liên quan của hai quốc gia liên kết với nhau trong từng lĩnh vực hợp tác.
Điều 3 - Điều kiện áp dụng
Mọi hoạt động được tiến hành theo bản ghi nhớ này căn cứ vào nguồn lực của các bên về tài chính và con người được phân bổ theo năm. Các hoạt động cần phải tuân thủ pháp luật và các quy định hiện hành. Kế hoạch ngân sách chi tiết sẽ được xây dựng cho từng hoạt động căn cứ theo từng trường hợp cụ thể và xem xét kỹ lưỡng trước khi hoạt động đó được tiến hành; mức đóng góp tài chính của từng Bên được nêu rõ.
Các quy định của bản thỏa thuận này có thể được sửa đổi nếu có sự đồng ý của các Bên.
Bản Thoả thuận này không tác động hay ảnh hưởng đến các quyền và nghĩa vụ theo hợp đồng của một trong hai Bên với bên thứ ba.
Trong khuôn khổ của bản thỏa thuận này, trong những trường hợp cần thiết, có thể có các thỏa thuận khác sẽ được ký kết giữa các cơ quan đồng cấp.
Điều 4 – Giám sát và phối hợp
Các Bên sẽ thường xuyên tiến hành giám sát các hoạt động đề ra trong Bản thoả thuận hợp tác này. Kế hoạch hành động sẽ được xây dựng hàng năm, có thể là trong thời gian diễn ra cuộc họp giữa các Bên.
Mọi tranh chấp liên quan đến việc giải thích hoặc thực hiện Bản thoả thuận này sẽ được giải quyết thông qua tham vấn hoặc hoặc đàm phán giữa các bên.
Các bên sẽ hội đàm hai năm một lần để xem xét lại quá trình hợp tác, luân phiên tại Pháp và Việt Nam.
Điều 5 – Hiệu lực, thời hạn và chấm dứt hợp tác
Bản Thoả thuận này có hiệu lực kể từ ngày ký. Thời hạn của Bản thoả thuận là năm năm, có thể được gia hạn với cùng thời hạn. Một trong hai bên có quyền chấm dứt thoả thuận này vào bất kỳ thời điểm nào sau khi gửi thông báo bằng văn bản cho bên kia trước sáu tháng.
Bản Thoả thuận được công bố tại XX, ngày XX XX năm 2013, được lập thành hai bản chính bằng cả tiếng Pháp và tiếng Việt, có giá trị pháp lý như nhau.
