: Mmh... « Homologuer » = « valider officiellement », ce que ne peut pas faire une personne physique au Canada ou en France (tenir compte du public cible). C'est aussi ce que dit votre lien anglais: faire une demande d'homologation, ce n'est pas homologuer.

La structure de la phrase source peut entraîner une erreur en français si on ignore la première proposition de Termium : « présenter un testament pour vérification ». Les autres propositions ne tiennent pas compte du sujet du verbe (any person appointed an executor). Or, en France en tout cas, l’homologation est le fait exclusif d’une instance judiciaire ou administrative (voire d’un organisme sportif dans un autre contexte) ; une personne physique telle qu’un exécuteur testamentaire ne peut homologuer/procéder à la vérification/établir la validité de quoi que ce soit.
D’où :
excluding any person … who has not proved this Will

« à l’exclusion de toute personne … qui n’a(urait) pas présenté le présent Testament pour vérification »
À partir de quoi on peut broder :
« … qui n’a(urait) pas demandé à un tribunal de vérifier… »,
« … qui n’a(urait) pas fait procéder à la vérification… »
« … qui n’a(urait) pas présenté une demande de vérification… »
etc.
