Hello,
The below is taken from the final clause of a power of attorney. My question is whether the 'lo' in 'copias del mismo, y sustituirlo total o parcialmente' is referring to the 'poder' or power of attorney document? I am not sure what else this might be relating to. Any second opinions would be very helpful. Thank you!
Para la efectividad y cumplimiento del poder, el apoderado podrá otorgar poderes para pleitos, instar la autorización de actas notariales, firmar cuantos documentos públicos o privados sean necesarios, incluso escrituras de rectificación o subsanación de defectos, pedir y obtener copias del mismo, y sustituirlo total o parcialmente.
My translation:
For the effectiveness and observance of power of attorney, the legal representative will be able to grant powers for legal actions, request authorization for notarial acts, sign all necessary private or public documents, including deeds to correct, clarify or rectify it, to request and obtain copies of it and substitute it completely or partially.

El Código Civil regula esta materia en el Art. 1721 al decir que: ”El mandatario puede nombrar sustituto si el mandante no se lo ha prohibido...”
Siguiendo a García Guardiola (Instituciones de Derecho Privado, Obligaciones y Contratos, Volumen 2º, Pág. 1246 y ss, Editorial Thomson/Civitas), de este precepto se desprende:
1) que cabe la sustitución y la delegación, salvo prohibición expresa.
2) que la sustitución implica una novación por cambio del deudor/apoderado, por lo que el sustituyente no quedará liberado mientras no preste su consentimiento el poderdante Cf. Art. 1.205 C.C., lo cual puede hacerse en el mismo poder, autorizando expresamente la sustitución; o en un momento posterior, ratificando la actuación del sustituto.

As an attorney in a South American country, I can totally assure you that the subsitution is referred to giving the representative the ability to sign another power of attorney to a third person, not exceeding the specific authorizations of the original document.
