You're right, this is a tricky one to express succinctly. I'm not entirely happy with my answer, but I think while Sandra's answer basically expresses the meaning, you have to be more explicit and literal in legal contexts.

lest the benefit of professional secrecy be (used )against him
I think "lest" best translates "sans que" to the extent that in both languages the subjuntive is used.
