- im Folgenden kurz GEMA genannt - ,
§ 1
Der Berechtigte überträgt hiermit der GEMA als Treuhänderin für alle Länder alle ihm gegenwüartig zustehenden und während der Vertragsdauer noch zuwachsenden, zufallenden, wieder zufallenden oder sonst erworbenen Urheberrechte in folgendem Umfang zur Wahrnehmung nach Maßgabe der folgenden Bestimmungen:
a) Die Aufführungsrechte an Werken der Tonkunst mit oder ohne Text, jedoch unter Ausschluss der bühnenmaßigen Aufführung dramatisch-musikalischer Werke, sei es vollständig, als Querschnitt oder im großseren Teilen.
Bühnenmusiken, soweit sie nicht integrierender Bestandteil des Bühenwerkes sind, Bühnenschauen, Filmbegleitmusik, Einlagen in Revuen, Einlagen in Operetten, Possen und Lustspielen, melodramatische und Kabarettaufführungen sind Gegenstand dieses Vertrages, soweit es sich nicht um die Aufführung von Bestandteilen dramatisch-musikalischer Werke in anderen Bühnenwerken handelt.
b) Die Rechte der Hörfunk-Sendung mit Ausnahme der Sendung dramatisch-musikalischer Werke, sei es vollständig, als Querschnitt oder in größeren Teilen.
c) Die Rechte der Lautsprecherwiedergabe einschließlich der Wiedergabe von dramatisch-musikalischen Werken durch Lautsprecher.
d) Die Rechte der Fernseh-Sendung mit Ausnahme von dramatisch-musikalischen Werken, sei es vollständig, als Querschnitt oder in größeren Teilen.
e) Die Rechte der Fernseh-Wiedergabe einschließlich der Wiedergabe von dramatisch-musikalischen Werken.
f) Die Filmvorführungsrechte einschließlich der Rechte an dramatisch-musikalischen Werken.
g) Die Rechte der Aufführung und Wahrnehmbarmachung mittels der gemäß Absatz h) hergestellten Vorrichtungen, mit Ausnahme
aa) der bühnenmäßigen Aufführung dramatisch-musikalischer Werke, sei es vollständig, als Querschnitt oder in größeren Teilen.
bb) der Wahrnehmbarmachung dramatisch-musikalischer Werke in Theatern im Sinne von § 19 Absatz 3UrhG.
h) Die Rechte der Aufnahme auf Ton-, Bildton-, Multimedia- und andere Datenträger einschließlich z.B. Speichercard, DataPlay Disc, DVD, Twin Disc, Ton- und Bildträger mit ROM-part und entsprechende Träger mit Datenlink, sowie die Verfielfältigungsrechte an diesen Trägern.
Das Recht, Werke der Tonkunst (mit oder ohne Text) in Datenbanken, Dokumentationssysteme oder in Speicher ähnlicher Art einzubringen.
Das Recht, Werke der Tonkunst (mit oder ohne Text), die in Datenbanken, Dokumentationssysteme oder in Speicher ähnlicher Art eingebracht sind, elektronisch oder in ähnlicher Weise zu übermitteln, einschließlich z.B. für mobile Internetnutzung und für Musikaustauschsysteme.
Die Rechtsübertragung erfolgt zur Nutzung der Werke der Tonkunst (mit oder ohne Text) auch als Ruftonmelodien und als Freizeichenuntermalungsmelodien.
Die Rechtsübertragung erfolgt jeweils vorbehaltlich der Regelung nach Absatz i).
Die vorgenannten Rechte umfassen nicht die graphischen Rechte, insbesondere nicht das Recht am Notenbild oder Textbild.
Für Verfielfältigung dramatisch-musikalischer Werke - vollständig, als Querschnitt oder in größeren Teilen – zum persönlichen oder sonstigen eigenen Gebrauch durch Ton- oder Bildtonträger bleibt dem Berechtigen das Verfielfältigungsrecht vorbehalten, soweit es sich um die Wahrnehmung gegenüber Theatern handelt.
i)(1) Die Rechte zur Benutzung eines Werkes (mit oder ohne Text), zur Herstellung von Filmwerken oder jeder anderen Art von Aufnahmen auf Bildtonträger von Werken der Tonkunst (mit oder ohne Text) mit Werken anderer Gattungen auf Multimedia- und andere Datenträger oder in Databanken, Dokumentationssystemen oder in Speichern ähnlicher Art, u.a. mit der Möglichkeit interaktiver Nutzung, mit der Maßgabe, dass GEMA und Berechtigter sich gegenseitig von allen bekannt werdenden Fällen benachrichtigen. Der GEMA werden diese Rechte unter einer auflösenden Bedingung übertragen,
Die Bedingung tritt ein, wenn der Berechtigte der GEMA schriftlich mitteilt, dass er die Rechte im eigenen Namen wahrnehmen möchte. Diese Mitteilung muss innerhalb einer Frist von vier Wochen erfolgen; bei subverlegten Werken beträgt die Frist drie Monate. Die Frist wird von dem Zeitpunkt an berechnet, zu dem der Berechtigte im Einzelfall Kenntnis erlangt hat. In der Mitteilung des Berechtigten an die GEMA über einen ihm selbst bekannt gewordenen Einzelfall muss die Erklärung enthalten sein, ob er die Rechte im eigenen Namen wahrnehmen möchte. Der Rückfall tritt ein, soweit us sich um die Benutzung zur Herstellung eines bestimmten Filmwerkes oder sonstigen Bildtonträgers oder Multimedia-oder anderen Datenträgers oder die Verbindung mit Werken anderer Gattungen in einer bestimmten Datenbank, einem bestimmten Dokumentationssystem oder einem bestimmten Speicher ähnlicher Art handelt. Bei Filmwerken schließt der Rückfall das Recht zur Verfielfältigung und Verbreitung ein, soweit es sich um Werke handelt, die zur öffentlichen Vorführung in Lichtspieltheatern oder zur Sendung bestimmt sind. Bei sonstigen Aufnahmen auf Bildtonträger beschränkt sich der Rückfall auf die Befugnis, die Zustimmung zur Werkverbindung und zur Herstellung von 50 gesondert zu kennzeichenden Verfielfältigungsstücken für Einführungszwecke zu erteilen. Unberührt beiben die Rechte für Fernsehproduktionen im Sinne von Absatz 3).
(2) Gegenüber Wochenschau-Herstellern ist die GEMA selbst zur Vergabe der Filmherstellungsrechte befugt, soweit es sich nicht um Auftragskompositionen und –texte handelt, die von einem Berechtigten einem bestimmten Wochenschau-Unternehmen zur ausschließlichen Benutzung für Wochenschauen gegeben und dementsprechend der GEMA gemeldet worden sind.
Der Berechtigte hat jedoch das Recht, die Wochenschau-Herstellungsrechte an ausländische Wochenschau-Hersteller von sich aus ohne Zustimmung der GEMA zu vergeben.
(3) Bei Fernsehproduktionen vergibt die GEMA die Herstellungsrechte an Fernsehanstalten und deren eigene Werbegesellschaften insoweit, als es sich um Eigen- oder Auftragsproduktionen für eigene Sendezwecke und Übernahmesendungen handelt. Die Einwilligung des Berechtigten ist jedoch erforderlich, wenn Dritte an der Herstellung beteiligt sind oder wenn die Fernsehproduktionen von Dritten genutzt werden sollen. Das gilt insbesondere für Koproduktionen.
(4) In jedem Falle bleiben jedoch die Rechte bei Fernsehproduktionen und anderen Bildtonträgern bis auf die der GEMA vorbehaltenen Rechte selbst vorbehalten, wenn es sich handelt um
aa) vorbestehende dramatisch-musikalische Werke, sei es vollständig, als Querschnitt oder in größeren Teilen;
bb) die Benutzung eines Werkes (mit oder ohne Text) zur Herstellung eines dramatisch-musikalischen Werkes;
cc) die Verwendung von Konzertliedern, Schlagern oder Einalgen aus dramatisch-musikalischen Werken in anderen dramatisch-musikalischen Werken oder in Fernsehproduktionen oder bei anderen Bildtonträgern, die eine Verbindung mehrerer Musiktitel unter einem Leitgedanken und mit einem Handlungsfaden darstellen. Bei Fernsehproduktionen bleibt in allen diesen Fällen dem Berechtigten das Einwilligungsrecht vorbehalten. Die Einwilligung kann jedoch, soweit es sich um Eigen- und Auftragsproduktionen für eigene Sendezwecke und Übernahmesendungen der Fernsehanstaltungen und deren eigener Werbegesellschaften handelt, vom Berechtigten nicht von der Zahlung einer Vergütung abhängig gemacht werden. Wird die Einwilligung erteilt, erfolgt Verrechnung nach Maßgabe des Verteilungsplanes.
k) Unberührt bleibt die Befügnis des Berechtigten, die Einwilligung zur Benutzung eines Werkes (mit oder ohne Text) zur Herstellung von Werbespots der Werbung betreibenden Wirtschaft, z.B. im Rundfunk (Hörfunk und Fernsehen) zu erteilen.
Nicht vom Berechtigten werden der GEMA übertragen die Rechte zur Bearbeitung, Umgestaltung und/oder Kürzung eines Werkes der Tonkunst (mit oder ohne Text) zur Verwendung als Ruftonmelodie und/oder Freizeichenuntermalungsmelodie. Die Befugnis des Berechtigten, die Einwilligung in die Verwendung solcher Werkfassungen im Einzelfall zu erteilen, belibt unberührt. Es bleibt bei der Übertragung der unter Ziffer 1h) aufgeführten Nutzungsechte an die GEMA.
l) Die Rechte für Nutzungen, die durch technische oder rechtliche Weiterentwicklung der in den Absätzen a) bis i) geregelten Nutzungsarten entstehen und diesen entsprechen sowie darüber hinaus diejenigen Rechte für eigenständige Nutzungsarten, die erst nach Abschluss des Berechtigungsvertrages bekannt werden. Der Berechtigte kann die Übertragung der Rechte für eigenständige Nutzungsarten insgesamt oder für einzelne entstandene Nutzungsarten im Sinne des §31 a UrhG schriftlich widerrufen. Das Widerrufsrecht erlischt nach Ablauf von drei Monaten seit Absendung der schriftlichen Mitteilung über die beabsichtigte Aufnahme der Lizensierung der neuartigen Nutzung durch die GEMA. Die schriftliche Mitteilung erfolgt jeweils in dem an alle Mitglieder versandten „GEMA-Brief“.
m) Die Ansprüche aus §§ 20 b Absatz 2, 27 Absatz 1 und 2, 52 a Absatz 4, 54 Absatz 1, 54 b Absatz 1, 54 e und 54 f UrhG sowie 137 | Absatz 5 UrhG; dazu gehören die Vergütungsansprüche aus § 27 Absatz 2 UrhG für Musiknoten.
§ 2
Soweit der Berechtigte über die Rechte gegenwärtig nicht verfügen kann, überträgt er sie für den Fall, dass ihm die Verfügungsbefügnis wieder zufällt. Die Übertragung umfasst die vorgenannten Rechte auch insoweit, as der Berechtigte sie durch Rechtsnachfolge erlangt oder erlangt hat.
§ 3
1. Die GEMA ist berechtigt, die ihr vom Berechtigten übertragenen Rechte im eigenen Namen auszuüben, sie auszuwerten, die zu zahlende Gegenleistung im Epmfang zu nehmen und über den Empfang rechtsverbindlich zu quittieren, die ihr übertragenen Rechte an Dritte ganz oder zum Teil weiter zu übertragen, alle ihr zustehenden Rechte auch gerichtlich in jeder der GEMA zweckmäßig erscheinenden Weise im eigenen Namen geltend zu machen.
2. Die GEMA sorgt durch den Abschluss von Mandats- und Gegenseitigkeitsverträgen mit ausländischen Verwertungsgesellschaften dafür, dass die ihr vom Berechtigten übertragenen Rechte auch international wahrgenommen werden. Darüber hinaus ist die GEMA außerhalb ihres Verwaltungsgebietes nicht zur Rechtewahrnehmung verpflichtet. Ist die Rechtewahrnehmung für ein Land insgesamt odre im Hinblick auf einzelne Nutzungsarten nicht durch Mandats- oder Gegenseitigkeitsverträge geregelt, so kann der Berechtigte für das entsprechende Land oder die entsprechenden Nutzungsarten jederzeit auch ohne Einhaltung der Kündigungsfrist gemäß §§ 10 und 16 schriftlich die Rückübertragung der eingeräumten Rechte verlangen. Derartige Beschränkungen der internationalen Rechtewahrnehmung werden den Berechtigten regelmäßig über den an alle Berechtigten versandten „GEMA-Brief“ mitgeteilt.
§ 4
Die Ansprüche des Berechtigten gegen die GEMA sind nur nach Vereinbarung mit der GEMA abtretbar. Die GEMA ist berechtigt, für die Bearbeitung von Pfändungen und Abtretungen – mit Ausnahme von Beitragsabtretungen an die Berufsverbände – zu Lasten ihres Berechtigten (Schuldners) eine den Unkosten entsprechende Verwaltungsgebühr zu erheben.
Bei Vorauszahlungen tritt der Berechtigte seine Zahlungsansprüche bis zur Tilgung der Vorauszahlungen unwiderruflich an die GEMA ab.
§ 5
Der Berechtigte verpflichtet sich, der GEMA alle unter diesen Vertrag fallenden Werke auf den von ihr ausgegebenen Formularen, insbesondere unter Ausgabe des Titels und der Gattung der Werke, der Namen der Komponisten, Textdichter, Verleger und auch eines eventuellen Pseudonyms anzumelden, ein vervielfältigtes Exemplars jedes angemeldeten Werkes zur Registrierung vorzulegen und die Richtigkeit seiner Angaben hinsichtlich seiner Urheberschaft in der von der GEMA vorgechcriebenen Form nachzuweisen.
Für Werke, die der Berechtigte nicht ordnungsgemäß anmeldet, verliert er gegenüber der GEMA den Anspruch auf Verrechnung bis zur ordnungsgemäßen Anmeldung.
Der Berechtigte verpflichtet sich, an der GEMA für die Feststellung seiner Rechte jede erofrderliche Auskunft zu erteilen.
§ 5 a
Der Berechtigte darf die Tarifpartner der GEMA oder anderer Verwertungsgesellschaften weder direkt noch indirekt an seinem Aufkommen beteiligen, damit diese bei der Nutzung des GEMA Repertoires bestimmte Werke des Berechtigten in ungerechtfertiger Weise bevorzugen. Im Falle der Zuwiderhandlung ist der Berechtigte verpflichtet, einen Betrag in der Höhe an die Sozialkasse der GEMA abzufühhren, in der er den Tarifpartner an seinem Aufkommen beteiligt hat. Übersteigt der an den Tarifpartner abgeführte Betrag die auf den Berechtigten entfallende Vergütung für das betroffenne Werk, so ist nur diese Vergütung an die Sozialkasse der GEMA abzuführen.
Die anderen Vorschriften der Satzung über satzungwidriges Verhalten bleiben unberührt.
§ 6
a) Satzung wie Verteilungsplan, auch soweit künftig die Satzung oder der Verteilungsplan geändert werden sollte, bilden einen Bestandteil dieses Vertrages.
Beshcließt die Mitgiledsversammlung in Zukunft Abänderungen oder Ergänzungen des Berechtigungsvertrages, so gelten auch diese Abänderungen oder Ergänzungen als Bestandteil des Berechtigungsvertrages. Abänderungen oder Ergänzungen sind dem Berechtigten schriftlich mitzuteilen. Die Zustimmung des Berechtigten zur Änderung oder Ergänzung gilt als erteilt, wenn er nicht binnen drei Monaten seit Absendung der schriftlichen Mitteilung ausdrücklich schriftlich widerspricht; auf diese Rechtsfolge ist er in der Mitteilung hinzuweisen. Die schriftliche Mitteilung erfolgt in dem auf die Mitgliederversammlung folgenden, an alle Mitglieder versandten „GEMA-Brief“.
Der Berechtigte erklärt, Satzung und Verteilungsplan ausgehändigt erhalten zu haben.
b) Der Berechtigte, der seinen Verpflichtungen aus der Satzung, dem Verteilungsplan and dem Berechtigungsvertrag nicht nachkommt, ist verpflichtet, die der GEMA durch seinen Verzug enstandenen Kosten zu erstatten.
§ 7
Der Berechtigte verpflichtet sich, jeden Wechsel des Wohnsitzes und der Staatsangehörigkeit, jede Änderung der Firma, ihrer Inhaber- und Gesellschaftsverhältnisse oder in der Zeichnung der Firma, jede Verlegung der Niederlassung sowie jeden Fall der Inverlagnahme oder des Verlagswechsels unverzüglich der GEMA anzuzeigen.
Wird der Anzeige der Adressenänderung vom Berechtigten oder im Todesfall durch seinen rechtsnachfolger unterlassen und lässt sich die neue Adresse des Berechtigten nicht durch Rückfrage bei der für den letzten Wohnsitz zuständigen Meldebehörde feststellen, so ist die GEMA berechtigt, den Berechtigungsvertrag zum Ende des Geschäftsjahres vorzeitig zu kündigen, in dem die negetive Nachricht der Meldebehörde eingegangen ist. Die Kündigung erfolgt in diesem Falle durch eingeschriebenen Brief, der an die letzte der GEMA bekannt gegebene Adresse zu richten ist. Nach Ablauf eines weiteren Geschäftsjahres kann der Aufsichtsrat über die bis zur Beendigung des Vertrages etwa vorhandenen Guthaben nach eigenem Ermessen bestimmen, falls der Berechtigte bis dahin keine eigene Verfügung getroffen hat.
§ 8
1. Der Berechtigte verpflichtet sich, bei erstmaligem Vertragsabschluss einmalig eine vom Aufsichtsrat festsusetzende Aufnahmegebühr an die GEMA zu entrichten.
2. Der Berechtigte verpflichtet sich, einen vom Aufsichtsrat festsusetzenden jährlichen Mitgliedsbeitrag an die GEMA zu entrichten.
Bei Vertragsabschluss ist der Mitgliedsbeitrag im Voraus zu bezahlen. In den Folgejahren wird der Mitgliedsbeitrag jährlich dem Mitgliedskonto des Berechtigten belastet und gegen die in dem betreffenden Jahr anfallenden Gutschriften verrechnet. Soweit die für den Berechtigten anfallenden Gutschriften die Höhe des Mitgliedsbeitrages nicht erreichen, ist der Berechtigte zur umgehenden Zahlung des Differenzbetrages an die GEMA verpflichtet. Erreichen die für den Berechtigten erfolgenden Gutschriften die Höhe des Mitgliedsbeitrages in drei aufeinander folgenden Jahren nicht, so kann die GEMA den Berechtigungsvertrag zum Ende des darauf folgenden Geschäftsjahres vorzeitig schriftlich kündigen oder die weitere Wahrnehmung seiner Rechte davon abhängig machen, dass der Mitgliedsbeitrag bei Beginn des Geschäftsjahres im Voraus entrichtet wird.
3. Im Gegensatz zu der Regelung über die Verteilung der Erträge aus dem Aufführungsrecht gilt vorbehaltlich anderweitiger Beschlüsse für die Verteilung der Erträge aus dem Verfielfältigungsrecht der Grundsatz, dass der GEMA aus diesen Erträgen eine Komission in Höhe von bis zu 25% zusteht.
§ 9
Für die Rechtsnachfolge im Vertragsverhältnis sind die allgemeinen gesetzlichen Bestimmungen maßgebend, soweit nicht die GEMA – Satzung und dieser Vertrag abweichende Bestimmungen enthalten.
Im Falle des Todes des Berechtigten wird der Berechtigungsvertrag mit dessen Reshtsnachfolger bzw. Rechtsnachfolgern in den Urheberrechten fortgesetzt. Die GEMA kann verlangen, dass der Nachweis der Rechtsinhaberschaft durch einen Erbschein, die Vorlage eines Testamentsvollstreckerzeugnisses oder sonstiger vom Nachlassgericht auszustellender Urkunden geführt wird. Bis zum Nachweis der Rechtsinhaberschaft ist die GEMA zu Auszahlungen nicht verpflichtet.
Sind mehrere Rechtsnachfolger vorhanden, müssen diese ihre Rechte gegenüber der GEMA durch einen gemeinsamen Bevollmächtigten ausüben. Die GEMA kann verlangen, dass die Bevollmächtigung durch öffentlich beglaubigte Urkunden nachgewiesen wird. Biz zur Bestellung eines gemeinsamen Bevollmächtigten ist die GEMA zu Auszahlungen nicht verpflichtet.
Jeder Rechtsnachfolger in den Urheberrechten eines verstorbenen Berechtigten ist verpflichtet, den Todesfall innerhalb von sechs Wochen nach Kenntniserhalt der GEMA mitzuteilen. Hinterlässt ein Berechtigter mehrere Rechtsnachfolger und verstirbt einer dieser Rechtsnachfolger, so ist auch der nach Absatz 3 zu bestellende gemeinsame Bevollmächtigte zu dieser Mitteilung verpflichtet.
Kommt ein zur Mitteilung Verpflichteter dieser Pflicht nicht nach und bewirkt die GEMA deshalb rechtsgrundlose Zahlungen, so ist die GEMA berechtigt, diese Zahlungen zurückzufordern, ohne dass von den Zahlungsempfängern ein Wegfall der Bereicherung gem. § 818 Absatz 3BGB geltend gemacht werden kann.
Werdeni nnerhalb von zwei Jahren nach dem Tode des Berechtigten keine Ansprüche auf die Rechtsnachfolge in den Urheberrechten geltend gemacht und erreichen die für die unbekannten Rechtsnachfolger erfolgenden Gutschriften in zwei aufeinander folgenden Jahren die Höhe des Mitgliedsbeitrages nicht, so endet der Berechtigungsvertrag zum Ende des darauf folgenden Geschäftsjahres.
§ 10
1. Der Vertrag wird mit Wirkung vom 01.01.2008 zunächst für die Dauer von sechs Jahren geschlossen. Falls der Vertrag nicht ein Jahr vor Ablauf schriftlich gekündigt wird, verlängert er sich jeweils um sechs Jahre.
2. Abweichend von Ziffer 1 kann der Berechtigungsvertrag hinsichtlich der Rechtsübertragung für die von § 1h) Absatz 2 bis 4 erfassten Onlinenutzungen unter Einhaltung einer Frist von drei Monaten schriftlich zum Ende eines jeden Kalendarjahres gekündigt werden.
Soweit dies für die von § 1h) Absatz 2 bis 4 erfassten Onlinenutzungen erforderlich ist, umfasst die Teilkündigung auch das Recht, Werke der Tonkunst aufzunehmen und technisch aufzubereiten. Umfasst ist auch die sich an eine solche Onlinenutzung unmittelbar anscließende Speicherung des übermittelten Werkes beim Endnutzer (Download).
Im Übrigen bleiben Bestand und Laufzeit des Berechtigungsvertrages von der Teilkündigung unberührt. Dies gilt insbesondere hinsichtlich der Rechtsübertragung für die von § 1 b) und d) erfassten Sendevorgänge, auch soweit sie im Wege der Onlinedistribution erfolgen (z.B. Internetradio und Internetfernsehen).
§ 11
Mit Beendigung des Vertrages fallen die Rechte an den bisherigen Berechtigten zurück, ohne dass es einer besonderen Rückübertragung bedarf. Jedoch soll zur Vermeidung einer Störung der öffentlichen Musikpflege die Auseinandersetzung bezüglich der zurückfallenden Urheberrechte in der Weise erfolgen, dass die Musikverbraucher, deren Verträge vor Beendigung dieses Berechtigungsvertrages für die Nutzung von Werken des ausgeschiedenen Berechtigten abgeschlossen wurden und über den Zeitpunkt des Ablaufs des Berechtigungsvertrages hinaus bestehen, für die ganze Dauer ihrer Verträge zur Nutzung befugt bleiben.
Die Verrechnung der demnach etwa noch auf den ausgeschiedenen Berechtigten entfallenden Erträge erfolgt nach den Bestimmungen des Verteilungsplanes der GEMA.
§ 12
Wird die GEMA aufgelöst, so gilt dieser Vertrag zum Ende desjenigen Vierteljahres als gekündigt, welches auf das Vierteljahr folgt, in dem der Auflösungsbeschluss durch die zuständige Staatsbehörde genehmigt ist.
§ 13
Der Erfüllungsort dieses Vertrages ist der Sitz der GEMA, durch den auch der Gerichtsstand für Streitigkeiten zwischen den Parteien aus diesem Vertrage bestimmt wird.
§ 14
Dieser Vertrag, von dem der Berechtigte eine Ausfertigung erhält, wird von beiden Teilen unterzeichnet. Soweit zwischen den vertragsschließenden Parteien bereits ein Vertragsverhältnis bestanden hat, tritt dieser Vertrag an die Stelle der bisherigen Vereinbarungen.
§ 15
Zu Änderungen des Berechtigungsvertrages bedarf es der für Satzungs- und Verteilungsplan- Änderungen erforderlichen Mehrheit in der Mitgliederversammlung.
§1 6
Besondere Vereinbarungen
Auf den Berechtigungsvertrag finden die Vorschriften des § 3 Ziffer 2 der Satzung der GEMA Anwendung. Die Rechtsübertragung erfolgt demgemäß für drei Jahre, falls keine Kündigung unter Einhaltung einer Frist von sechs Monaten zum Ende des jeweiligen Drei-Jahres-Zyklus erfolgt. § 10 Ziffer 2 des Berechtigungsvertrages bleibt unberührt. Ausgenommen von der Rechtsübertragung werden folgende Länder Nutzungsarten : USA und Kanada -;-

§ 1
The rightsholder transfers hereby to GEMA as trustee for all countries all authors’ rights to which he may be entitled during the term of the contract or come to be entitled, or acquire by any means, in the following extent for representation in accordance with the following conditions:
a) The performing rights to musical works with or without text, but excluding staged performances of dramatic – musical works, whether completely, as selections, or in large part;
Stage musics, so long as they are not an integral part of the stage work, stage shows, music accompanying film, musical interludes in reviews, interludes in operettas, selections and comedies, melodramatic and cabaret performances are a part of this contract, insofar as they are not performances of components of dramatic – musical works within other stage works.
b) The rights to radio broadcast, with the exception of broadcasts of dramatic – musical works, whether completely, as selections, or in large part;
c) The rights to performance by loudspeaker, including the performance of dramatic – musical works by loudspeaker.
d) The right to TV broadcast, with the exception of dramatic – musical works, whether completely, as selections, or in large part;
e) The rights to performance by television, including the performance of dramatic – musical works.
f) The film performance rights, including the rights to dramatic – musical works.
g) The rights to performance and making available for hearing by means of the devices set forth in paragraph h), with the exception of:
aa) The staged presentation of dramatic – musical works, whether completely, as selections, or in large part;
bb) The making available for hearing of dramatic – musical works in theatres in the sense of §19 paragraph 3 UrhG.
h) The rights to recordings on audio, audiovisual, multimedia and other data storage media, including e.g. data storage cards, Data Play Disc, DVD (Digital Versatile Disc), Twin Disc, audio and audiovisual media with ROM and corresponding media with data link, as well as the reproduction and performing rights to these media.
The right to store works of musical art (with or without text) in databases, documentation systems or in data storage cards of a similar nature.
The right to convey electronically or in a similar manner musical works of art (with or without text) that have been stored in databases, documentation systems or in data storage cards of a similar nature, including e.g. for mobile internet use and for music exchange systems.
The transfer of rights also applies to the use of the works of musical art (with or without text) as dial tone melodies or dial tones
The transfer of rights occurs in accordance with the regulations in paragraph i).
The above – mentioned rights do not include the graphic rights, in particular not the right to physical copies of the notated score or lyrics.
For reproduction of dramatic – musical works - completely, as selections, or in large part – for personal or other individual uses by means of audio or audiovisual media, the rights remain reserved to the entitled party, insofar as it is a matter of performance in theatres.
i) (1) The rights to the use of a work (with or without text) in the creation of film works or any other type of recording on audio media, as well as any other publication of works of musical art (with or without text) with works of other genres on multimedia and other data storage media or in databases, documentation systems or in storage cards of a similar nature, including, among others, those with the capacity for interactive use, with the understanding that GEMA and the rightsholder will report to each other all cases of such use as they become known. These rights will be transferred to GEMA under a comprehensive condition.
This condition will take effect if the rightsholder gives GEMA written notice that he would like to represent the rights in his own name. This notice must be given within a period of four weeks; for subpublished works the period is three months. The period is calculated from the date when the rightsholder has obtained information of a particular case. In the notification given by the rightsholder to GEMA regarding a particular case of which he has become aware, mention must be made as to whether the rightsholder wants to represent the rights in his own name. This relapse occurs only in the event of use for manufacture of a specific film work or other audiovisual medium or multimedia or other data storage, or the publication with works of other genres in a particular database, in a particular documentation system, or a particular data storage card of a similar nature. For film works the relapse includes the right to reproduction and publication, to the extent that it deals with works that are intended for public performance in cinema theatres or for broadcast. For other recordings on audiovisual media, the relapse is limited to the authority to give consent to the publication and manufacture of 50 copies specifically to be used for promotional purposes. The rights to TV productions in the sense of Paragraph (3) remain unaffected.
(2) In relations with creators of weekly news programs GEMA is itself authorized to award film manufacture rights, so long as this does not involve compositions or texts created for hire, that a rightsholder has given to a particular weekly news entrepreneur for exclusive use on weekly programs, and reported to GEMA as such.
The rightsholder nevertheless has the right to award the weekly show production rights to foreign weekly show producers all by himself, without the consent of GEMA.
(3) For TV productions GEMA awards the production rights to TV companies and their own advertising companies, insofar as it is a matter of their own or a contracted production for their own broadcast and rebroadcast transmissions. The consent of the rightsholder is, however, required if third parties participate in the production or if the TV productions are intended for use by third parties. This applies in particular for coproductions.
(4) In any case, however, the rights to TV productions and other audiovisual media , up to the rights that GEMA reserves for itself, remain reserved to the rightsholder himself, when it is a case of:
aa) pre-existing dramatic – musical works, whether complete, as selections, or in large part;
bb) the use of a work (with or without text) for the production of a dramatic – musical work;
cc) the use of concert songs, hits or musical interludes from dramatic – musical works in other dramatic – musical works or dramatic works or in TV productions or in other audiovisual media, which present the binding together of several musical titles under one leading idea and with one common treatment. For TV productions, in all these instances the right to consent is retained by the rightsholder. The consent may not, however, insofar as it is a case of a TV production company’s own production or a work for hire for its own broadcast and rebroadcast purposes and those of its own advertising department, be made conditional by the rightsholder on the payment of a remuneration. If consent is granted, distribution of rights proceeds according to the distribution plan.
k) The rightsholder’s authority to grant consent for the use of a work (with or without text) in the production of an advertising spot in the economic sector that creates advertisements, e.g. in broadcasting (radio and TV), remains unaffected.
The rights to arrangement, transformation and / or abridgement of a work of musical art (with or without text) for use as dialtone and / or ringtone melody are not transferred by the rightsholder to GEMA. The rightsholder’s authority to grant consent to the use of such versions of a work in particular cases remains unaffected. It remains with the transfer of use rights listed under number 1 h) to GEMA.
l) The rights for uses that originate from further legal or technological developments of the uses regulated under paragraph a) to I) and correspond to these as well as those rights for independent types of use, that come to be known only after the signing of a rights contract. The rightsholder may revoke in writing the transfer of rights for independent types of uses altogether, or for individual newly created types of use in the sense of § 31 a UrhG. The right of revocation expires three months after the sending of a written notification of the intended beginning of licensing of the new type of use by GEMA. The written notification occurs in the “GEMA Letter” [“GEMA – Brief”] that is sent to all members.
m) The claims from §§ 20b Paragraph 2; 27 Paragraph 1 and 2; 52a Paragraph 4; 54 Paragraph 1; 54b Paragraph 1; 54e and 54f UrhG, as well as 137 | Paragraph 5 Urh%; to these belong the claims for remuneration from § 27 Paragraph 2 UrhG for music notation.
§ 2
Insofar as the rightsholder can not at present use the rights, he carries them over for the event that he once again obtains the authority to use them. This carrying forward includes the above – mentioned rights also, to the extent that the rightsholder gains or has gained them through succession.
§ 3
1. GEMA is entitled to exercise in its own name the rights transferred to it by the rightsholder, to utilize them, to accept them in receipts as payment and to dispose of the receipts legally, to transfer to third parties wholly or partially the rights that have been transferred to GEMA or to prohibit their use, and to assert all its rights in any legal manner that may appear to further GEMA’s goals.
2. GEMA ensures, by means of the mandates and reciprocal representation agreements that it signs with foreign performing rights societies for that purpose, that the rights transferred to GEMA by the rightsholder will also be recognized internationally. In addition to this, outside its
management territory GEMA is not obligated to represent rights. If the representation of rights in a country as a whole, or with respect to a particular form of use, is not regulated by mandates or reciprocal representation agreements, then the rightsholder may at any time, for the corresponding country or form of use, make written request for the return transfer of the rights he had transferred, without having to observe the advance notice for termination required under §§ 10 and 16. Such limitations to the international exercise of rights are reported regularly in the “GEMA Letter” [“GEMA Brief”] sent to all rightsholders.
§ 4
The rightsholder’s claims against GEMA are transferable only after agreement with GEMA. GEMA is entitled, for the preparation of distraints and transfers – with the exception of transfers of contributions to trade associations – to collect from its rightsholders (debtors) an administrative fee corresponding to its expenses.
In the case of advance payments the rightsholder irrevocably transfers his payment claim to GEMA until repayment of the advance.
§ 5
The rightsholder accepts the obligation to report to GEMA on the forms it provides, for all the works subject to this contract, the title and genre each work, the name of the composer, text author, publisher as well as pseudonyms, if used, to provide a printed copy for registration of each reported work, and to prove the correctness of the information provided with respect to his authorship.
For works for which the rightsholder does not submit a report in accordance with regulations, he loses his right to claim payment from GEMA until such time as he makes a report in accordance with regulations.
The rightsholder accepts the obligation to provide GEMA all the information required for the establishment of his rights.
§ 5 a
The rightsholder is not allowed to give to GEMA’s tariff partners or to other performing rights societies, either directly or indirectly, a share in his revenue, for which these would, in the use of the GEMA repertory, give certain works of the rightsholder an unjustified preference. In case of infringement the rightsholder is required to pay into the GEMA social assistance fund an amount equal to the share in his revenue that he granted to the tariff partner. If the amount paid out to the tariff partner exceeds the remuneration due to the rightsholder for the corresponding work, then this remuneration will also be paid into the GEMA social assistance fund.
The other regulations in the statutes regarding conduct in contravention of the Statutes remain unchanged.
§ 6
a) The Statutes and the Distribution Plan, and the future amendments that may be made to these, are a component of this contract.
In the event that the General Assembly of Members should in future decide on amendments or additions to the rights contract, then those amendments or additions shall also be considered components of the rights contract. The rightsholder is to be informed in writing of amendments or additions. The consent of the rightsholder to the amendments or additions is considered as granted, if he has not responded, within a period of three months following the mailing of written notification, stating in writing his explicit opposition; the notification must include mention of this course of legal action. The written notification occurs in the “GEMA Letter” [“GEMA – Brief”] that is sent to all members.
The rightsholder states that he has received the Statutes and Distribution Plan.
b) The rightsholder who does not fulfill his obligations under the Statutes, the Distribution Plan and the rights contract, will be required to reimburse GEMA for the costs arising from his delay.
§ 7
The rightsholder accepts the obligation to report to GEMA immediately any change of address or nationality, any change of the firm, its ownership and business relationships or the personnel with signatory responsibility, any change of address of the main office as well as any case of acceptance by a publisher or change of publisher.
If the report of address change is neglected by the rightsholder, or in the event of death by the heirs to his rights, and if the rightsholder’s new address can not be discovered by inquiring with the local government office for the registration of residents at the last known address, then GEMA is entitled to terminate the rights contract prematurely at the end of the fiscal year in which the local government office issued its negative report. Termination in this case is managed by registered letter sent to the last address known to GEMA. After the end of another fiscal year the Advisory Board may dispose of any credit balance that may have been present at the time of termination of the contract as it deems appropriate, in the event that the rightsholder has made no arrangements of his own by this time.
§ 8
1. The rightsholder accepts the obligation to pay a one – time enrollment fee set by the Advisory Board upon first signing of the contract.
2. The rightsholder accepts the obligation to pay an annual membership fee set by the Advisory Board.
Upon signing of the contract the membership fee is to be paid in advance. In subsequent years the membership fee will be deducted annually from the rightsholder’s member account, and settled against the credits in the corresponding year. If the rightsholder’s credits are less than the amount of the membership fee, then the rightsholder is required to pay GEMA the difference immediately. If the credits to the rightsholder are less than the amount of the membership fee for three consecutive years, then GEMA may terminate the contract prematurely, by written notice, at the end of the following fiscal year, or it may make the continued representation of rights dependent upon the advance payment of the membership fee at the beginning of each fiscal year.
3. In contrast to the regulation regarding the distribution of yields from performing rights, subject to other decisions for the distribution of yields from mechanical rights, the principal applies that GEMA is entitled to a commission in the amount of up to 25% of these yields.
§ 9
For the inheritance of the contractual relations the general legal conditions are authoritative, insofar as the GEMA Statutes and this contract do not contain any deviating conditions.
In the event of the death of the rightsholder, the rights contract will continue with his heirs. GEMA may request that proof of inheritance be supplied, in the form of a certificate of inheritance, the submission of a certificate from the executor of the will, or other documents to be issued by the probate court. Until the capacity of rightsholder [by inheritance] has been proven, GEMA is under no obligation to make distributions.
In the event that there exist multiple heirs, these must exercise their rights with GEMA by means of a common authorized representative. GEMA may request that the authorized representative be established by means of notarized documents. GEMA is under no obligation to make distributions until the appointment of an authorized representative.
Every heir to the authors’ rights of a deceased rightsholder is under the obligation to report the death to GEMA within six weeks of learning of the death. If a rightsholder leaves behind multiple heirs, and if one of these heirs dies, then the authorized representative appointed in accordance with Paragraph 3 is under the obligation to make this report.
If one of the parties under the obligation to make this report does not fulfill this duty, and therefore GEMA makes payments for which there is no legal basis, then GEMA is entitled to demand the return of these payments, and the receivers of the payment may make no complaint regarding the discontinuation of enrichment as under §818, Paragraph 3 BGB.
If within a period of two years following the death of the rightsholder no claim to the inheritance of the authors’ rights has been made and the amounts to the credit of the unknown heirs in two consecutive years are less than the amount of the membership fee, then the rights contract terminates at the end of the following fiscal year.
§ 10
1. This contract is entered into with effect from ` 01.01.2008 for a period of six years. If written notice of intent to terminate the contract is not given one year before its expiration, then the contract is extended for six years.
2. Differing from Number 1, the rights contract with regard to transfer of rights for online uses as included under § 1 h) Paragraph 2 to 4, may be terminated by written notice delivered three months before the end of each calendar year.
To the extent that it is required for the online uses included under § 1 h) Paragraph 2 to 4, the partial termination also includes the right to record works of musical art and technically arrange them. Also included is the storage of the transferred work by the end user that immediately follows such an online use (Download).
Otherwise the conditions and period of the rights contract remain unchanged by the partial termination. This applies in particular to the transfer of rights for the sending procedures under § 1 b) and d), also to the extent that they occur in the course of online distribution (e.g. internet radio and internet TV).
§ 11
Upon the termination of the contract the rights revert to the previous rightsholder, without there being any need for a special retransfer. However, in the interest of preventing disturbances to the public use of music, the partition of the reverting authors’ rights shall be carried out in such a manner, that the music users whose contracts for use of works by the deceased rightsholder were signed before the termination of this rights contract, and are valid beyond the termination of the rights contract, have the authority to continue use for the entire duration of their contracts.
The settlement of the amounts that may be due thereafter to the various rightsholders will be performed in accordance with the conditions of the GEMA Distribution Plan.
§ 12
In the event that GEMA is dissolved, this contract will be considered terminated at the end of the quarter year following that in which the decision of dissolution was accepted by the appropriate state authorities.
§ 13
The place of performance of this contract is GEMA headquarters, by which the place of jurisdiction for disputes between the parties to this contract will be chosen.
§ 14
This contract, of which the rightsholder receives a copy, is signed by both parties. To the extent that a contractual relationship already existed between the two parties entering into this contract, this contract takes the place of prior agreements.
§ 15
Amendments to the rights contract require the same majority in the Membership Assembly that is required for changes to the Statutes and Distribution Plan.
§ 16
Special Agreements
The regulations in § 3 Number 2 of the GEMA Statutes are applicable to the rights contract. The transfer of rights accordingly is for a period of three years, however it will be at least until yearend of the third year, and is extended by three years in the event that no notice of termination has been given by six months before the end of the current three – year cycle. § 10 Number 2 of the rights contract remains unaffected. PROJET D’ASSISTANCE TECHNIQUE POUR LE DEVELOPPEMENT DE LA MONETIQUE
CONTEXTE :
Dans le cadre de la modernisation de son système bancaire, l’Algérie a élaboré depuis quelques années un programme de développement de son système de paiement bancaire et plus particulièrement de la monétique. Un programme pilote de développement de la monétique au niveau de la région d’Alger est en cours d’achèvement et sera suivi par sa généralisation progressive à l’ensemble du territoire algérien. Ce programme a déjà fait l’objet d’un audit dont est ressortie une série de recommandations et de feuilles de routes dont la mise en oeuvre se poursuit. Cependant, malgré toutes les mesures prises, d’importants retards sont constatées et les réalisations sont encore trop modestes. Plusieurs facteurs se situant au niveau de la maîtrise de la technologie, de l’organisation, de la cohérence des structures institutionnelles et de la commercialisation et du marketing sont à l’origine de cette situation. 2. Dans ce contexte, le gouvernement algérien a sollicité auprès de la Banque africaine de développement (BAD) une assistance technique en vue d’accélérer le développement de la monétique, et ce en ayant recours à un bureau d’études maîtrisant non seulement la technologie de la monétique mais aussi ses aspects organisationnels, institutionnels et juridiques ainsi que les techniques de commercialisation et de marketing des produits de la monétique.

RATIONALE :
L’assistance technique va permettre d’accélérer le développement de la monétique, et ce en ayant recours à un bureau d’études maîtrisant non seulement la technologie de la monétique mais aussi ses aspects organisationnels, institutionnels et juridiques ainsi que les techniques de commercialisation et de marketing des produits de la monétique. .
OBJECTIF:
Les objectifs spécifiques de l’opération sont: a) L’identification et l’analyse selon une démarche systématique et rigoureuse des obstacles et des contraintes techniques, organisationnelles et institutionnelles qui sont à l’origine du retard de la monétique en Algérie ; b) l’élaboration d’une solution cohérente et intégrale acceptable par toutes les parties prenantes ainsi qu’un plan d’action permettant de surmonter ces obstacles et d’assurer le développement de la monétique, et ce en tenant compte des leçons d’expérience d’autres pays ayant une situation comparable ; c) la préparation des autorités algériennes à mettre en oeuvre cette solution et à vérifier son efficacité et sa cohérence.

DESCRIPTION
L’assistance technique sera donc sous la forme d’une étude. Elle sera fournie par un bureau d’études et portera sur trois composantes majeures que sont : (i) le diagnostic ; (ii) la conception d’une nouvelle architecture et d’un plan d’action ; et (iii) la communication des résultats et tests d’efficacité. 1. Le diagnostic consiste à approfondir l’analyse de la situation actuelle et à bien identifier les obstacles au développement de la monétique en Algérie. Pour se faire la mise en oeuvre et la conception des feuilles de routes établies sur la base de l’audit déjà effectué seront revues. L’analyse portera sur chacune des six banques publiques, l’actuel opérateur monétique interbancaire en Algérie et la SATIM. Le bureau d’études consultera tous les organes concernés par la monétique (le reste des banques, la Banque d’Algérie, la Poste, Algérie Télécom) et examinera toutes les modalités de coordination de la monétique. S’agissant des autres banques, elles seront consultées mais pas diagnostiquées car leur situation non contraignante; 2. La Conception d’une nouvelle architecture consiste à concevoir une solution cohérente et complète et optimale intégrant tous les aspects de la monétique déjà mentionnés (techniques, organisationnels et institutionnels, juridiques, commerciaux) et tous ses opérateurs, compte tenu des meilleures pratiques au niveau international ainsi que des contraintes et des spécificités de l’Algérie. L’étude tiendra compte de l’existant, en particulier des feuilles de route déjà établies et proposera les mesures correctives permettant de les mettre plus rapidement en oeuvre. Cependant, cette étude devra être innovante en s’adressant aux problèmes non résolus, notamment au niveau institutionnel et organisationnel. Des programmes d’action, de nouveaux schémas institutionnels et organisationnels, de nouvelles règles de fonctionnement ou de nouveaux textes règlementaires (compatibles avec les lois fondamentales du pays) et un plan de marketing seront présentés. 3. Communication des résultats et tests d’efficacité : il s’agit de préparer les autorités algériennes et les responsables de la monétique à la mise en oeuvre de la nouvelle architecture et du plan d’action proposés, et ce pendant les trois premiers mois suivant la validation de leur validation par le comité de pilotage. Dans le cadre de cette composante le bureau d’études organisera et animera des ateliers de restitution et des ateliers destinés aux principaux responsables de la monétique permettant de les préparer à assumer la phase de mise en #uvre. Il s’agira de sensibiliser l’ensemble des parties prenantes pour les amener à s’approprier la nouvelle architecture et le plan d’action afin d’en assumer la mise en oeuvre. Le bureau d’études vérifiera également la validité, l’efficacité et la cohérence de la solution proposée sur le plan pratique à travers des tests et des procédures bien définis. Au terme de cette phase, le rapport final ainsi que les délibérations des trois ateliers, y compris celui de la phase trois, seront soumis au Comité de pilotage pour validation. ..

PROJECT FOR TECHNICAL ASSISTANCE FOR THE DEVELOPMENT OF ELECTRONIC BANKING SERVICES
CONTEXT:
In the frame of the modernization of its banking system, for several years Algeria has been working on a development program for its banking system and in particular the electronic banking services. A pilot program for development of the electronic banking services in the region of Algiers is in the final stages of implementation and will be followed by its gradual extension throughout the entire country of Algeria. This program has already been the object of an audit that has led to a series of recommendations and schedules, whose implementation is in progress. Nevertheless, despite all the measures taken, significant delays have been experienced and the rates of completion are still too small. Several factors in the areas of technological expertise, of organization, of the coherence of institutional structures and commercialization and marketing, have given rise to this situation. 2. In this context the Algerian government has asked the African Development Bank (ADB) for technical assistance with the goal of accelerating the development of electronic banking services, while employing the services of a consultancy with expertise not only in electronic banking services technology but also its organizational, institutional and legal aspects, as well as the techniques of commercialization and marketing of electronic banking services products.
RATIONALE:

GOAL:
The specific goals of the operation are: a) the identification and analysis, by means of a systematic and rigorous process, of the technical, organizational and institutional obstacles and constraints that are the cause of the delay in electronic banking services in Algeria; b) the creation of a complete and coherent solution acceptable to all participants, as well as a plan of action that will facilitate surmounting these obstacles and assuring the development of the electronic banking services, while taking into account the lessons of experience in other countries in a comparable situation; c) preparing Algerian authorities to implement this solution and to verify its effectiveness and coherence.
DESCRIPTION:
The technical assistance will thus be in the form of a study. It will be supplied by a consultancy and will bear on three major components, which are: (i) diagnostic; (ii) conception of a new architecture and a plan of action; and (iii) the communication of results and tests of effectiveness. 1. The diagnostic consists in more deeply analyzing the current situation and identifying the obstacles to development of electronic banking services in Algeria. To do this, the implementation and conception of schedules, established on the basis of the audit already completed, will be reviewed. The analysis will focus on each of the six public banks, the current operator of interbank electronic banking services in Algeria, and the SATIM. The consultancy will consult with all organizations with electronic banking services (the other banks, the Bank of Algeria, the Post Office, Algeria Telecom) and will examine all the means of coordination of the electronic banking services. As regards the other banks, they will be consulted but not diagnosed because their situation is not restrictive; 2. The Conception of a new architecture consists in conceiving a coherent, complete and optimal solution integrating all aspects of the electronic banking services that have already been mentioned (organizational, institutional, legal and commercial techniques) and all their operators, taking into account the best practices at the international level, as well as the constraints and conditions specific to Algeria. The study will take into account existing conditions, in particular the scchedules already established, and will propose corrective measures allowing them to be implemented more quickly. However, this study must be innovative in addressing unresolved problems, in particular at the institutional and organizational levels. Programs for action, new institutional and organizational schemas, new rules of operation or new regulatory texts (compatible with the fundamental laws of the country), and a marketing plan will be presented. 3. Communication of results and tests of effectiveness: this is a matter of preparing both the Algerian authorities, and those responsible for electronic banking services, for the implementation of the proposed new architecture and the action plan, all during the first three months following the validation
of their validation by the steering committee. In the framework of this component the consultancy will organize and host reconstruction workshops and workshops intended for the principals responsible for electronic banking services, permitting them to prepare to take over the implementation phase. This will be a matter of sensitizing the ensemble of participants in order to lead them to take over the new architecture and the action plan in order to take over its implementation. The consultancy will also verify the validity, the effectiveness and the coherence of the proposed solution on a practical level, by means of well - defined tests and procedures. PROJET D’AMELIORATION ET DE RENFORCEMENT DES CAPACITES AEROPORTUAIRES
CONTEXTE:
L’Office National Des aéroports (ONDA) déploie sans relâche des efforts matériels dans le but de mettre à niveau les installations aéroportuaires dont il a en charge la gestion. Il a établi un programme d’investissement qui couvre plusieurs années et dont le financement se réalise progressivement. Les projets de modernisation qu’il a entrepris visent essentiellement la réalisation d’ouvrages à l’échelle de la demande en croissance continue et, l’atteinte d’un bon niveau de fiabilité et de couverture de l’espace aérien marocain.
Le Maroc est en cours de négociation avec la communauté européenne et les Etats de l’Amérique du nord, pour conclure des accords du type «Open sky» et le développement des installations de Casablanca pour en faire une plaque tournante «hubs» préférentielle pour les deux continents.
L’objectif du Gouvernement inscrit dans le Plan quinquennal 2000-2004 pour le sous secteur aérien prévoit l’intégration de l’espace aérien marocain dans l’espace aérien européen. Ceci devra se traduire par une amélioration des capacités aéroportuaires du Maroc et de prise en charge en toute sécurité la navigation aérienne par la couverture à radar à 100% de l’espace aérien marocain.
RATIONALE :
Le secteur des transports représente l’infrastructure de base au développement harmonieux du tourisme, de l’industrie et de l’agriculture. Son inadéquation se justifie par une maintenance en deçà du degré et de la cadence attendus, par l’insuffisance des ressources que l’Etat mobilise annuellement à cet effet. Ce projet qui vise à la sauvegarde, l’amélioration et l’extension des infrastructures aéroportuaires, correspond aux priorités du Gouvernement, et ses objectifs rentrent dans les priorités que la Banque soutient dans le secteur des transports. Il se justifie par l’accroissement galopant du trafic qui a augmenté entre 1997 et 1998 de 24% et de 1998 à 1999 de 17% avec un nombre de 150 mouvements par jours enregistrés au niveau de l’aéroport Mohammed V et 3,4 millions de passagers en 1999. Eu égard aux capacités actuelles, cette tendance risque de saturer les installations vers l’an 2002.
OBJECTIF :
1) Améliorer et garantir la sécurité de la navigation aérienne par la couverture radar à 100% de l’espace aérien marocain; 2) Augmenter les capacités de l’aéroport Mohammed V à 6 millions de passagers en 2005; 3) Rendre compatibles les installations aéroportuaires avec les normes de l’OACI en matière de sécurité et de sûreté au sol; 4) Préparer le Maroc à l’intégration de son espace aérien dans l’espace l’espace aérien européen.

PROJECT FOR AIRPORT IMPROVEMENT AND CAPACITY BUILDING
CONTEXT:
The National Office of Airports is constantly involved in material projects for the upgrading of the airport installations for which it has management responsibility.
It has established a multi – year investment program for which the financing is realized progressively. The modernization projects that it has undertaken aim essentially at the completion of projects in scale with the continually growing demand, and the maintenance of a good level of reliability and coverage of the Moroccan airspace.
Morocco is involved in negotiations with the European Community and the USA aimed at concluding an “Open Sky” type of agreement, and the development of the Casablanca airport to develop it into a preferred “hub” for the two continents.
The Government goals set forth in the five – year plan for 2000 – 2004 for the airports subsector envisage the integration of Moroccan airspace with European airspace. This should translate into an improvement in the capacity of Moroccan airports and enhanced security for air travel by providing radar coverage for 100% of the Moroccan airspace.
RATIONALE:
The transportation sector represents the basic infrastructure for the harmonious development of tourism, industry and agriculture. Its inadequacy is explained by maintenance below the expected degree and rate, and by the insufficiency of resources that the State dedicates annually for this purpose. This project, aiming at the protection, improvement and expansion of airport infrastructure corresponds to the Government’s priorities, and its goals fit within the priorities that the Bank supports in the transportation sector. It is justified by the galloping growth in traffic, which increased by 24% between 1997 and 1998, and by 17% between 1998 and 1999, with 150 movements daily recorded at Mohammed V airport, and 3.4 million passengers in 1999. Considering current capacity, this trend risks saturating the installations by 2002.
GOAL:
1) To improve and guarantee the security of air travel by providing radar coverage for 100% of Moroccan airspace; 2) To increase the capacity of Mohammed V airport to 6 million passengers in 2005; 3) To make airport installations compatible with OACI
norms in matters of security and safety on the ground; 4) To prepare Morocco for the integration of its airspace with European airspace.
DESCRIPTION:

PROJET D’APPUI AU DEVELOPPEMENT BOVIN LAITIER (PADEBL)
CONTEXTE:
Au début des années 1990, le Gouvernement du Rwanda a sollicité l’appui de la Banque pour entreprendre une étude du sous secteur de l’élevage, afin d’identifier les solutions concrètes susceptibles d’augmenter les productions animales et les revenus des opérateurs du sous-secteur. A cet effet, deux études ont été réalisées dans le cadre du projet de développement du Mutara, financé par le FAD, et concernent notamment le Plan Directeur de l’Elevage et la Filière Lait et Viande bovine. Les événements de 1994 et l’insécurité générale qui régnait à l’époque ont retardé l’exécution de ces études jusqu’en 1997. Les rapports de ces études ont été soumis à la Banque en 1998.
RATIONALE :
Face à une forte démographie, sans cesse croissante et suite aux terribles événements sociopolitiques de 1994, le pays se retrouve confronté à quatre problèmes majeurs : (i) répondre à une forte demande nationale en viande et en lait, (ii) reconstruire les infrastructures de production qui ont été détruites, (iii) fournir aux éleveurs de l’intérieur, les moyens de reconstituer leur cheptel décimé et (iv) installer les nouveaux éleveurs de la diaspora qui étaient rentrés massivement avec leurs troupeaux. La pression démographique et les besoins en terre pour différentes spéculations
ne permettent plus à l’élevage de poursuivre la conduite des troupeaux en mode de transhumance. La survie du sous secteur passe inexorablement par une intensification (passage d’un élevage extensif à un élevage semi intensif ou intensif, géré comme une petite entreprise agricole de marché), associée à la reconstruction et à la modernisation des infrastructures de production et de commercialisation. La stratégie adoptée repose sur : (i) l’organisation des opérateurs à la base, (ii) la recapitalisation du cheptel et l’amélioration de la race locale, (iii) la construction de certaines infrastructures, (iv) la maîtrise des soins vétérinaires et des techniques appropriées de reproduction, d’alimentation, de transformation, de conservation et (v) l’amélioration des circuits de commercialisation.
OBJECTIF :
L’objectif sectoriel du projet est de contribuer à l’amélioration de la sécurité alimentaire et à la réduction de la pauvreté. Pour atteindre ces objectifs, le projet vise les réalisations suivantes: (i) organiser, former, équiper et encadrer les opérateurs à la base, afin de leur permettre de participer dès le départ à l’exécution du projet et de s’en approprier, (ii) améliorer la race bovine locale avec des races performantes afin d’améliorer sa productivité, puis la vulgariser, (iii) assurer des services vétérinaires appropriés par la mise en place d’un réseau de surveillance épidémiologique, d’un service de contrôle de qualité, l’organisation des campagnes de prophylaxie et la mise à disposition des intrants vétérinaires, (iv) assurer une gestion rationnelle des parcours et améliorer l’alimentation du bétail, (v) construire et rendre opérationnelles les infrastructures de collectes, de stockage et de commercialisation des produits d’élevage, (vi) renforcer les capacités des services nationaux impliqués dans l’exécution du projet et (vii) créer et rendre opérationnelle, une cellule de gestion du projet..

IMPACT:
Le projet permettra aux éleveurs des trois systèmes d’accroître leurs revenus Le fumier permettra l’amélioration des pâturages et l’accroissement des rendements des cultures (en raison de la pauvreté des sols, de la rareté des terres et de la cherté des intrants agricoles). Avec la réalisation du projet, la production additionnelle estimée en année de croisière (année 5) est de 28,5 millions de litres de lait et de 11.800 tonnes de viande bovine, alors que les productions annuelles totales actuelles sont respectivement de 45 millions de litres et 10.000 tonnes actuellement. Sur la base des importations actuelles de lait, qui s’élèvent à 4,4 millions de litres de lait par an, le pays devrait pouvoir grâce au projet, couvrir la demande intérieure en lait frais, et réaliser d’importantes économies de devises.
L’intensification de l’élevage procurera du travail permanent à une main-d’ouvre agricole estimée à quelques 2 500 personnes par an après 5 ans et à un peu plus de 10 000 personnes après 10 ans. Par ailleurs, un certain nombre d’emplois permanents sera créé dans le secteur privé par la mise en place des infrastructures. De plus, le développement de la filière offrira de multiples opportunités de financement par le secteur privé (grâce à la ligne de crédit) et d’emplois dans les services divers, principalement au niveau de la fourniture des intrants et des prestations vétérinaires, de même que dans la fabrication d’aliments pour bétail, la transformation artisanale et industrielle du lait et la transformation de la viande.

PROJECT FOR AID TO THE DEVELOPMENT OF DAIRY CATTLE
CONTEXT:
At the beginning of the 1990’s, the Government of Rwanda sought the Bank’s help in undertaking a study of the breeding sub – sector, in order to identify concrete solutions that could increase animal production and the earnings of the operators in this sub – sector. For this purpose, two studies were completed in the frame of the Mutara development project, financed by the African Development Fund (ADF), and concerning in particular the Master Plan for Breeding and the Dairy and Meat Industry. The events of 1994 and the general insecurity that prevailed at that time delayed the execution of these studies until 1997. The reports on these studies were submitted to the Bank in 1998.
RATIONALE:
Faced with strong population growth, increasing incessantly, and in the aftermath of the terrible sociopolitical events of 1994, the country finds itself confronting four major problems: (i) to respond to strong domestic demand for meat and milk; (ii) to rebuild the productive infrastructure that was destroyed; (iii) to provide the breeders in the interior of the country with the means to rebuild their decimated herds of livestock; (iv) to install new breeders of the diaspora who have re – entered the country en masse with their herds. Population pressure and the needs to devote land to other uses no longer allow breeders to continue to change pastures seasonally. The survival of the sub – sector will evolve inexorably by intensification (evolution from raising herds in an extensive territory to semi – intensive or intensive, managed like a small agricultural market enterprise), associated with the reconstruction and modernization of the infrastructure for production and sale. The adopted strategy relies on: (i) the organization operators at the base; (ii) the re – capitalization of livestock and the improvement of the local race; (iii) the construction of certain infrastructures; (iv) the mastery of veterinary needs and appropriate techniques for reproduction, feeding, transformation, and conservation, and (v) the improvement of marketing channels.
GOAL
The goal for this sector is to contribute to the improvement of food security and the reduction of poverty. To reach these goals, the project aims at the following achievements: (i) to organize, form, equip and manage the operators fundamentally, in order to enable them to participate from the beginning in the execution of the project and to take charge of it; (ii) to improve the local bovine race with performing races in order to improve their productivity, then make them commonly available; (iii) to assure veterinary services appropriate to the implementation of an epidemiological surveillance network, as well as a quality control service; to organize preventive medicine campaigns; and to make veterinary inputs available; (iv) to assure rational management of the course and improve feeding of the cattle; (v) to construct and make operational collective infrastructures, for stocking and sale of breeding stock; (vi) to strengthen the capacities of domestic services involved in the execution of the project, and (vii) to create and make operational a unit for the management of the project.
DESCRIPTION:
The principal components of the project are: A leadership and popularization; B Intensification of cattle breeding; C Veterinary action; D Promotion of cattle breeding products; E Institutional reinforcement, and F Management of the project.
IMPACT:
The project will provide breeders with three systems to increase their incomes. Manure will allow the improvement of pastures and increased crop yield (because of the poverty of the soils, the scarcity of fields and the high cost of agricultural inputs). Upon completion of the project, the estimated additional production in year 5 will be 28.5 million liters of milk and 11,800 tons of beef, while current total annual productions are 45 million liters and 10,000 tons, respectively. On the basis of current milk imports, which amount to 4.4 million liters per year, the country should be able, thanks to this project, to meet domestic demand and to make important savings on foreign exchange.
The intensification of breeding will provide permanent employment to an agricultural workforce of an estimated 2,500 persons per year after 5 years, and to a bit more than 10,000 persons after 10 years. Moreover, a certain number of permanent jobs will be created in the private sector by the creation of infrastructure. Additionally, the development of the stream will offer multiple opportunities of financing by the private sector (thanks to the line of credit) and employment in the various services, principally at the level of providing veterinary inputs and services, as well as the fabrication of livestock feed, artisanal and industrial transformation of milk, and the transformation of meat.
