Odpowiedź: obowiązywać będzie dziedziczenie ustawowe (intestacy laws) zgodnie z przepisami naszego stanu.

Dziedziczenie ustawowe jest zależne od przepisów danego stanu i od tego, czy zmarły jest w związku małżeńskim, czy ma dzieci i inną rodzinę.

Descent means the succession to the estate property by inheritance, or by any act of law. These are the rules of inheritance established by law for cases in which there is no will naming the persons to receive the property of a person who has died. Therefore, title by descent is the title by which one person, upon the death of another, acquires the estate property of the latter as an heir at law. This manner of acquiring property stands in complete contrast to acquiring property through purchase.

The rules of descent vary slightly from state to state. As a general rule, if a person owning real estate dies without devising a will, the estate passes on to the descendants in the direct line of lineal descent. For example, from father or grandfather to son or grandson.

However, when the owner of an estate dies without any lawful issue, it is a rule in some states, that the estate shall ascend to the parents. If there are no parents, then the estate passes to the collateral descendants.

Stwierdzenie nabycia spadku to dopiero pierwszy etap postępowania mającego na celu podział majątku po zmarłym ojcu. Drugim niezbędnym krokiem jest dział spadku. Gdy już wiemy, kto dziedziczy, należy dokonać podziału składników majątku zmarłego pomiędzy te osoby. Dział spadku może nastąpić w drodze umowy pomiędzy spadkobiercami albo w drodze postanowienia sądu, wydanego na żądanie któregokolwiek z nich. Dziedziczenie ustawowe – dziedziczenie według przepisów prawa spadkowego, mające miejsce, gdy spadkodawca nie sporządził testamentu albo testament jest nieważny, albo gdy osoby powołane do dziedziczenia nie chcą lub nie mogą być spadkobiercami. Dziedziczenie ustawowe może odnosić się do całego spadku albo do jego części. Reguły dziedziczenia ustawowego opierają się na stosunku pokrewieństwa, małżeństwa lub przysposobienia. W Polsce dziedziczenie ustawowe jest regulowane przepisami Kodeksu cywilnego w księdze czwartej pt. "Spadki". What Is Descent and Distribution?

The terms “descent” and “distribution” are quite simple. Descent refers to the determination of rightful heirs. Distribution refers to how a decedent’s assets are shared by their heirs.

The laws in Florida regarding property ownership are quite protective. If your deceased relative did not leave a will, the laws of descent and distribution will determine who the rightful heirs are and how the property should be distributed.

Who can receive a decedent’s property when there’s no will? Generally, eligible individuals include spouses, children, siblings, and other family members. Spouses and children often get special consideration.

How Will Property Be Distributed under Florida Law?

Property distribution can be simple, but often it gets quite complicated.

The first thing that must be done is determine what property is eligible for distribution. This will be handled by the courts.

Homestead property tends to be distributed to the widow/widower and minor children. Adult children are usually next in line. In some cases, it may not be as clear-cut as this, but this is the general order that you should expect.

Other property and assets that were owned by the deceased are usually distributed after payments such as debts and taxes have been completed. There are many factors that will affect this distribution, starting with whether or not there is a validly executed last will and testament.
