French term or phrase: poursuivre exécution
Court case to do with problematic redevelopment project.

This is a little allusive flourish just before "PAR CES MOTIFS".

"Toutefois, il convient de rappeler les termes de l'article L. 111-10 du code des procédures civiles d'exécution :
'L'exécution est poursuivie aux risques du créancier.
Celui-ci rétablit le débiteur dans ses droits en nature ou par équivalent si le titre est ultérieurement modifié.'"

The sense is clear: if the judgment is modified you may have to give things back to the obligor. I'm just not clear on what the right verb for poursuivre might be here: "*implement* enforcement"?

Enforcement is the general term, with methods of levying execution > AmE: of levy > needing to being tied down to specific forms, such as distraint, levying of distress for rent, or attachment of earnings > AmE : garnishment of wages etc.

L'exécution est poursuivie aux risques du créancier : execution is levied at the (judgment) creditor's risk.

or reword : Any enforcement sought vs. 'conducted' will be at ...

Better vary than 'modify' or alter the judgment.

Example sentence(s):
  • IATE: fr poursuivre l'exécution forcée en to proceed to enforcement
