French term

opposé le secret médical

French to English Medical Medical: Pharmaceuticals
This concerns regulatory procedures for a clinical trial. The sentence is "Tous les données et tous les documents pourront faire l'objet d'audits sans que puisse être opposé le secret médical"
I know we are talking about medical secrecy but I'm having problems with translating the word "opposé".

(in which case) medical secrecy cannot be invoked.

All data and documents can be audited in which case medical secrecy cannot be invoked.

Something along those lines.

Peer comment(s):

agree Kari Foster : I might have used "confidentiality" instead of "secrecy", but I think "invoked" is just right in this case.

with no exceptions on grounds of medical secrecy admissible

Medical secrecy cannot be invoked as an argument to refuse to supply data or documents. "Opposé" is being used in the sense of admissible grounds in law.

Thank you Lionel.
neutral David BUICK : beware confusion of "being bound" to secrecy (the doctor) and the "opposabilité" here (the principle of confidentiality)

I am well aware of that.
