1. Giriş
İş yaşamı içerisindeki etkinlikleri etkinlikleri ve toplam ekonomik büyüklükleri dikkat çekici olmasına karşın aile işletmeleri konusunun 1990’lı yıllar itibarı ile ayrı bir akademik disiplin olarak kabul görmesi dikkat çekicidir. Bununla birlikte anılan dönemden sonra çok sayıda çalışma yapılmış olmasına rağmen, aile işletmesini neyin oluşturduğuna dair tam bir tanımın yapılamamış olması, belli bir dönem bu alanın ciddi bir araştırma konusu olmasını engelleyen bir sorun olarak karşımıza çıkmıştır (Klein vd., 2005: 321). Diğer taraftan aile ilişkileri, işletme içerisindeki yapısal sorunlar ve ikilemlerin çokluğu açısından bakıldığında aile işletmeleri, işletme türleri arasında zaten en karmaşığı olarak karşımıza çıkmaktadır. Özellikle işletme sahipliğinin, kontrolün ve yönetimin birbiri içine geçmiş oluşunun yarattığı operasyonel ve stratejik sorunlar aile işletmeleri açısından karmaşıklığı daha da derinleştirmektedir (Craig ve Moores, 2006: 2). Bu karmaşa içerisinde yaşamını sürdürmeye çalışan aile işletmeleri için çok sayıda ve farklı niteliklere sahip parametre bulunmaktadır. Bunlar içerisinde sürdürülebilirlik ve kurumsallaşma öne çıkanlardan ikisidir. Sürdürülebilirlik ve kurumsallaşma hem önerilen birer çözüm unsuru hem de çözüm aranan birer sorun kaynağı olarak karşımıza çıkmaktadır. Bu iki unsur, aile işletmesinin adaptasyon ve devir planı ile aşılmaya çalışılırken, sağlanan başarı kurumun rekabet edebilirliği için de önem kazanmaktadır. Yapılan çalışmada öncelikle aile işletmeleri için kavramsal çerçeve belirlenmeye çalışılmıştır. Daha sonra aile işletmeleri için sürdürülebilirlik temelinde adaptasyon ve kurumsallaşmanın etkinliği tartışılmış olup, sürecin uygulama karşılığı araştırılmıştır. Bu bağlamda ele alınan örneklem ile aile işletmelerinin kurumsallaşma ve adapte olabilme yeteneklerinin, sürdürülebilirlik ve işletme performansı üzerindeki etkileri araştırılmıştır.
2. Teorik çerçeve
2.1. Aile İşletmelerinin Kavramsal Çerçevesi
Aile işletmeleri 20. yüzyılın ikinci yarısında dünya ekonomisinde önem kazanan örgütler olarak görülmektedir. Özellikle işletmecilik eğitimi veren üniversitelerin sayısındaki artış, girişimcilik konusuna duyulan ilginin artmasına neden olmuş ve sonuçta da girişimcilik uygulamalarının en önemli konularından birisini oluşturan aile işletmeleri konusu yükselen bir değer haline gelmiştir. (Güney, 2008: 96).
Aile işletmesi kavramının ABD’de 1960’lı yılların sonunda, Avrupa’da ise 1980’li yılların sonunda ortaya çıktığı görülmektedir (Neubauer ve Lank, 1998: 4).
Aile işletmesinin kurulma şekli, girişimci liderin kişilik özellikleri, ailenin kendisine has kültürel değerleri, ailenin genişliği, işletmenin içinde yer aldığı sektör gibi birçok faktör, aile işletmesinin yapısını, oluşumunu ve gelişimini etkilemektedir. Dolayısıyla aile işletmelerini bir standarda sokmak, bir tanım etrafında toplamak nispeten zordur. Bir anlamda ne kadar aile işletmesi var ise o kadar da tanım yapmak mümkündür (Taşkır ve Şimşek, 2008: 204).
Translation - English SUSTAINABILITY IN FAMILY-RUN BUSINESSES: AN ANALYSIS BASED ON STRUCTURAL EQUALITY
1. Introduction
While activities of family-run businesses in the business life and their total economic size are notable, the fact that as of 1990’s the topic of family-run businesses was treated as a separate academic discipline is worth mentioning. Even though a large number of studies have been conducted after the aforementioned period, a failure to come up with a precise definition of what constitutes a family-run business has for a certain period of time proved an obstacle to this field’s becoming a serious area of research (Klein et.al., 2005: 321). On the other hand, in view of family relations, structural problems in a business and a large number of dilemmas family-run businesses have proved to be the most complicated among business types. Especially operational and strategic problems arising from a situation when business ownership, control and management become closely intertwined further deepen the complexity exhibited by family-run businesses (Craig and Moores, 2006: 2). There are many parameters with different features on the basis of which to evaluate family-run businesses seeking to pursue their activities within this complex structure. Among these parameters sustainability and institutionalization stand out. Sustainability and institutionalization turn out to be at the same time both a solution offered and a source of problem for which solution is sought. While these two elements are sought to be solved through an adaption and transfer plan of a family-run business, success achieved becomes important for the competitiveness of an entity as well. First, in the present study a conceptual framework for family-run businesses has been tried to be defined. Second, for family-run businesses adaptation and the process of institutionalization has been dealt with. It has also been examined how the process find its reflection and unfolds in practice. It has also been explored through using a sample taken in this context how ability of family-run businesses to institutionalize and adapt affects sustainability and performance of a business.
2. Theoretical Framework
2.1. Conceptual Framework Related With Family-Run Businesses
Family-run businesses are institutions that acquired importance in the world economy in the second half of the 20th century. Especially a rise in the number of universities with departments of business administration has led to a situation when entrepreneurship began to attract more attention and as a consequence the subject of family-run businesses which constitutes one of the most important topics of entrepreneurship practices has become an asset of growing importance. (Güney, 2008: 96).
The concept of family-run business has been coined in the USA by the end of 1960’s and on the European continent by the end of 1980’s (Neubauer and Lank, 1998: 4).
A large number of factors such as the form in which a family-run business has been established, personality traits of a leader entrepreneur, cultural values peculiar to a family, family size, the sector in which a family-run business operates affects the structure of a family-run business, its formation and development. Hence, it is relatively difficult to subsume family-run businesses under one definition category and to apply a single standard to all family-run businesses. In a sense, it is possible to come up with as many definitions as there are family-run businesses (Taşkır ve Şimşek, 2008: 204).

Source text - Turkish 2004 yılında, IMF/Dünya Bankası ikilisinin uzun yıllardır her fırsatta tekrarladıkları ve ısrarla gündemde tuttukları taleplere binaen, Yüksek Planlama Kurulu’nun 17.03.2004 tarih ve 2004/3 sayılı Kararı’nın eki olarak yayınlanan “Elektrik Enerjisi Sektörü Reformu ve Özelleştirme Strateji Belgesi” çerçevesinde, TEDAŞ Genel Müdürlüğü’ne bağlı elektrik dağıtım şirketlerinin özelleştirilmesi işlemlerine başlanması sürecinin bir uzantısı olarak; uzun, karışık ve yerine göre ciddi boyutlu hukuki aşamalar da içeren bir duraksamadan sonra; 2010 yılı içerisinde sözkonusu bölgeler için, ilgi gösteren özel teşebbüs firmalarından teklifler alınmış olup, daha sonrasında açık arttırma metoduyla sürecin tamamlanması yoluna gidilmiş ve son
aşama Kasım 2010’da nihayetlendirilmiştir.
Aslında bütün bu olaylar dizisi, “Türkiye Elektrik Kurumu Dışındaki Kuruluşların Elektrik Üretimi, İletimi, Dağıtımı ve Ticareti ile Görevlendirilmesi Hakkında Kanun”un, 4.Aralık 1984 tarihinde TBMM’de kabul edilip, 19.Aralık.1984 tarih, 18610 sayılı resmi gazetede yayımlanması ile, Türkiye gündemine girmiş olup; IMF, Dünya Bankası, Avrupa Birliği gibi ulus aşırı organizasyonların, “Türkiye Enerji Sektörü’nün Liberalleştirilmesi/Özelleştirilmesi” amacıyla, müteakip Türkiye Cumhuriyeti Hükümetleri’yle imzaladıkları “Niyet Mektubu” gibi karşılıklı kabul edilmiş gibi görünen belgeler, “İlerleme Raporu” gibi tek taraflı metinler çerçevesinde ortaya koydukları, zorlayıcı politika transferi şeklinde tanımlanabilecek, çeşitli baskıları sonucu alınan yeni kararlar ve çıkarılan yeni yasalar çerçevesinde; kimi zaman enerji sektörünün yeniden yapılandırılması adı altında, konuyla ilgisi olanları bile şaşırtan bir organizasyon karmaşasına neden olurken; kimi zaman da enerji yönetiminde kamusal bir anlayışı savunanların çabaları ve hukuki iptallerle, bir mücadele şeklinde
devam etmiştir.
Bu mücadele içerisinde, enerji sektöründe yapılan ve/veya yapılması istenen yeni yapılanma çerçevesinde özelleştirmeler; elektrik, doğalgaz ve petrol başta olmak üzere bütün alanlarda, sözkonusu tesislerin ve verdikleri hizmetin niteliğine bakılmaksızın, sadece ihale sonunda elde edilen ve bütçe açıklarının kapatılması için kullanılan özelleştirme gelirleri, kamuoyu nezdinde öne çıkarılarak gerçekleştirilmekte; ileride oluşabilecek ve belki de yıllar sürecek hukuki süreçler sonrasında bile çözümlenemeyecek ama öte yandan Türkiye Cumhuriyeti Vatandaşlarına ağır bedeller getirmesi muhtemel yapıların oluşmasına neden olabilecek zeminler yaratmaktadır.
Bu çalışmada Türkiye Enerji Sektöründe, sözkonusu gerçekleştirilen özelleştirmeler ve sonucunda ortaya çıkan/çıkacak yapı ile, oluşan ve/veya oluşması muhtemel riskler analiz edilecek olup; son bölümde ise, bütün bu faaliyetler sonucu, sektörün geldiği mevcut durum hakkında değerlendirmelerde bulunulacaktır.
TÜRKİYE’DE ENERJİ POLİTİKALARI
A.Dünya’da Devlet Yönetimi Politikalarında Değişim
1929 Büyük Dünya Buhranı’nı nihai olarak sonlandıran, İkinci Dünya Savaşı’nın hemen sonrasında başlayan soğuk savaşla birlikte, tehdit olarak algılanan sosyalist sisteme karşı, bir alternatif olarak sosyal devlet politikası uygulamaya sokulmuş; bu politik tercih, esas olarak Avrupa merkezli yürütülmesine rağmen, diğer çevre devletler de bu politikaya dahil edilmişlerdir.
Ancak sosyal tabanlı bu politikalar, 1970’li yıllarda sona ermiş; 1980’li yıllardan itibaren soğuk savaşın bitmesi ve kapitalist sistemin yaşadığı krizlere çözüm olarak önerilen Yeni Kamu İşletmeciliği çerçevesinde, özelleştirme amaçlı politikalarının, bütün dünya genelinde uygulanmaya başlamasıyla birlikte, devletin ekonomik ve sosyal sorumluluklarını ortadan kaldıracak bir tarzda yeniden yapılandırılması yolu tercih edilmiştir.
Bu yeniden yapılandırmada; devletin sosyal görevleri, sorumlulukları ve bağlantılı yönetim biçimleri terk edilerek(veya terk ettirilerek), bütünüyle ulus aşırı örgütler(IMF ve Dünya Bankası) ve yerel/yabancı çok uluslu şirketlerin istekleri doğrultusunda, devletlere biçilen role uygun yeni görevler ve yeni yönetsel organlar oluşturulmuştur.
Bu çerçevede, ulus aşırı kredi kuruluşları niteliğine sahip olmalarına rağmen, uluslararası sermaye gruplarının ideolojik bir aracı halinde faaliyet gösteren IMF ve Dünya Bankası tarafından uygulamaya konulan programlar şu şekildeydi; devletin politika belirleme, karar alma yetkileri BM gibi “küresel unsurlara”; ekonomik ve sosyal görevleri "Sivil Toplum Kuruluşlarına" bırakılacak; ülke içerisinde ise, ademi merkeziyet(yerelleşme) ön plana çıkarılacaktı.
Bütün bu yapılandırma sonrasında, devlete sadece genel güvenlik, genel yargı, genel denetim ve koordinasyon görevleri kalıyordu. Bu programların uygulaması, 1980'li yıllarda devletin yeniden yapılandırılması amaçlı olarak, tüm çevre ülkelerde(bağımlı ülkeler) Dünya Bankası eliyle, “Yapısal Uyarlama Kredileri”yle gerçekleştirildi.
B.Türkiye Enerji Sektörü’nün Yeniden Yapılandırılması
Türkiye’de de devletin yeniden yapılandırılması, 1979 yılında IMF ile yapılan Stand-by anlaşmasının hemen ardından, Dünya Bankası ile imzalanan 5 SAL(Yapısal Uyum Kredisi) anlaşması ile başlatılmıştır. Her biri, bir mali yıl için imzalanan bu anlaşmalar ile, toplam 1,6 milyar $ kredi Türkiye Cumhuriyeti’ne aktarılmış; buna karşılık KİT'lerin tasfiyesi, dış piyasalarla uyum ve bürokrasinin yeni organizasyonu için uygun zemin hazırlanmasına başlanmıştır. Sözkonusu bu SAL anlaşmaları 1984 yılında bitmiş, bunun yerine SECAL(Sektörel Yapısal Uyarlama Kredileri) kredileri devreye sokulmuştur. 1985 yılından itibaren Tarım SECAL5, 2 adet
Mali SECAL, Enerji SECAL imzalanmıştır.
Türkiye Enerji Sektörü’nde, sektörün üç yıllık yatırım ihtiyaçlarını karşılamayı hedefleyen 325 milyon dolar büyüklüğündeki Enerji SECAL kredi anlaşması ile Dünya Bankası;
-Sektör içindeki kuruluşların, kurumların ve diğer varlıkların işletme etkinlikleri, fiyat politikaları, akılcı yatırım planlaması ve koruma önlemleri açısından faaliyetlerini ve kurumsal çerçeveyi güçlendirecek bir programın gerçekleştirilmesini,
-Bütün bu çalışmalar için gerekecek olan, ivedi dışalımların siparişlerinin verilmesini talep etmiş, kredinin kesintiye uğramaması amacıyla tatminkar ilerlemeler kaydedilmesini koşul saymıştır.
Enerji SECAL kredi anlaşması ile ilk olarak, daha önceki dönemlerde merkezi planlamanın, dolayısıyla bütünlüklü bir yapının zorunlu olduğu ifade edilen alansal yapıların, yani farklı enerji konularında faaliyet gösteren ve çoğu geçmişte büyük önem içeren büyük enerji KİT’lerinin, daha ziyade özelleştirme amaçlı bir şekilde parçalanmasına başlanmıştır.
Bütün bu düzenlemeler yapılırken, dikkati çeken bir husus ise; bütün bu yapılandırmaların bir bedelinin olduğu ifade edilerek, bu bedelin Türkiye’deki tüketicilerden alınmasına dayanan bir “Enerji Fiyat Politikası” uygulanması gerektiğinin, Dünya Bankası raporlarında belirtilmiş olmasıdır.
Halen enerji sektöründeki ulusal ve uluslararası şartları ile gelişmeleri hiçbir şekilde dikkate almadan devam eden, ve yerine göre tekeller oluşmasına sebebiyet veren/verebilecek derecede ideolojik bir hale gelmiş olan liberalleştirme/özelleştirme politikaları ise; IMF, Dünya Bankası ve Avrupa Birliği gibi, profesyonellikten uzak, tecrübesiz kadrolara sahip olup, aslında Türkiye şartlarını tam olarak bilmeyen, daha ziyade teorik öngörülerle, Türkiye dışından sürekli müdahalede bulunan ve oluşacak menfi sonuçlardan, hiçbir şekilde etkilenmeyecek olan yabancı unsurların baskısıyla, ısrarla devam ettirilmektedir.
Enerji sektörü’nün üst yapısı ve sözkonusu kamu kuruluşlarının 1980 sonrası yeniden yapılandırılmalarını ve ortaya çıkan sonuçları, alansal olarak incelemek gerekirse;
i.Genel Durum
Türkiye Enerji Sektörü’nde mevcut yapının, üst kademesinde olan çok parçalı bir karar verici mekanizma bulunmaktadır. Enerji ve Tabii Kaynaklar Bakanlığı(ETKB- Enerji Politika ve Stratejileri), Kalkınma Bakanlığı(Eski DPT-Enerji Yatırımlarının Planlaması) ve Enerji Piyasası Düzenleme Kurulu(EPDK-Enerji Piyasalarının Düzenlenmesi) aslında birbirlerini tamamlayan unsurlar olarak belirlenmişse de, uygulama da bu kuruluşlar zaman zaman karşı karşıya gelebilmektedirler.
Bu kuruluşlara ilaveten Maliye Bakanlığı, Hazine Müsteşarlığı ile son yıllarda Özelleştirme İdaresi de, sektörde yön ve karar verici unsurlar haline gelmiş olup; özellikle Bakü-Ceyhan Boru Hattı ile ilgili yoğun faaliyetlerin başlamasıyla birlikte Dışişleri Bakanlığı’da, enerji sektörünün her türlü dış temasına, yerine göre sıkıntı yaratan boyutlara ulaşacak bir şekilde, dahil olmaya başlamıştır.
Ayrıca, her ne kadar halen gerçekleşememişse de, oluşacağı iddia edilen “liberal” enerji piyasalarında, gerçek anlamda rekabet şartlarının oluşması gerektiğinden, Rekabet Kurulu(RK)’da enerji sektöründe önemli bir karar merkezi haline gelmiştir.
Yapının alt tarafında ise; detayları aşağıdaki bölümde verilecek olan, farklı enerji konularında faaliyet gösteren ve çoğu geçmişteki büyük enerji KİT’lerinin, daha ziyade özelleştirme amaçlı bölünmesiyle ortaya çıkmış, merkezi idareye ve/veya yerel yönetimlere bağlı kuruluşlar ile, bunlardan sermaye ve yapı olarak daha küçük ancak sayıca fazla olan özel sektör şirketi bulunmaktadır.
Translation - English In 2004, in response to the demands put forward by both IMF and the World Bank reiterated on every occasion over a long period of time and persistently kept on the agenda, within the framework of ‘Strategic Paper on Electrical Energy Sector Reform and Privatization’ published as a supplement to the decision № 2004/3 of 17.03.2004 by the High Planning Council, as an extension of the process of launching operations on the privatization of electrical distribution companies subordinate to Turkish Electricity Distribution Corporation (TEDAŞ) Chief Directorate, after a long break involving long, complicated and at times serious judicial phases, in 2010 proposals with regard to relevant regions have been received from private enterprise companies interested, subsequently an auction has been held and the last stage has been concluded in November, 2010.
Actually all this chain of developments that became current issues on the agenda of Turkey unfolded in the following sequence: the adoption by Turkish Grand National Assembly (TBMM) on December 4, 1984 of the Law on Assigning Tasks of Electricity Production, Transmission, Distribution and Trade to the Bodies Outside of Turkish Electricity Administration (TEK) and the publication of this Law in the Official Gazette of Turkish Republic No: 18610 of December 19, 1984; the documents that appear to have been adopted on a mutual basis such as “Letter of Intent” signed between consecutive Turkish governments and such supranational organizations as IMF, the World Bank, the European Union with the purpose of “Liberalization/Privatization of the Turkish Energy Sector”; new decisions taken and new acts adopted as a result of various pressures, adopted as unilateral texts such as “Progress Report” and acts and decisions that can be defined as a binding policy transfer. At times this chain of events resulting from the steps taken under the proclaimed goal of the restructuring of energy sector has led to an organization confusion and disorder that perplexed even those closely involved in the relevant process and sometimes turned into struggle involving those who defended a public approach in energy governance and accompanied by judicial annulments.
In this struggle privatization within the framework of new restructuring implemented or intended to be implemented in the energy sector; in various fields, particularly in electricity, natural gas and petroleum sectors, irrespective of the relevant facilities and the nature of service they provide, privatization income earned only at the end of a tender and used to close the budget deficit is being implemented in the presence of public opinion and thus the way is paved for the emergence of conditions and structures that might prove to be a heavy burden on the citizens of the Republic of Turkey and defying any solution even in the event of judicial processes that could last for years.
This study analyzes the structure which has emerged or can emerge as a result of privatization implemented in the energy sector of Turkey and risks that emerged or are likely to emerge. The concluding part of the study gives an assessment of the current situation in which energy sector has found itself as a result of all these steps.
ENERGY POLICIES IN TURKEY
A.Change in the policies of state governance in the world
With the onset of the Cold War in the immediate aftermath of the World War II which drew a close to the 1929 Great Depression, social state policy has been introduced as an alternative to the socialist order perceived as a threat. Despite the fact that this political preference has been predominantly made by the European states, other countries in the neighbourhood have also been involved in this policy.
Yet, these society-based policies were abandoned in the 1970’s. Within the framework of New Public Management suggested in the 1980’s with the end of the Cold War as a solution to the crises experienced by the capitalist system, as policies aimed at public privatization policies were beginning to be carried out a new restructuring mode that would lift economic and social responsibilities of the state has been preferred.
Under this restructuring social tasks, responsibilities and corresponding to them ways of governance have been abandoned (or have been forced to be abandoned) and in line with the wishes of supranational organization (IMF and the World Bank) and local/foreign multinational corporations new tasks have been assigned and new administrative bodies established in conformity with a new role assigned to the state.
Within this system the programmes applied by IMF and the World Bank acting as an ideological tool of international capital groups despite possessing features of supranational loan-providing institutions entailed the following elements: the state’s prerogatives to define a policy and decision-making authorities were to be transferred to “global institutions”, such as the United Nations, economic and social responsibilities to be transferred to civil society organizations and decentralization (localization) was to rise to prominence and to be given priority.
As a result of this restructuring the state was to be left with general security, judicial authority, general inspection and coordination powers and tasks. The practical implementation of this programme has been realized in the 1980’s with the purpose of state restructuring in all neighboring countries (dependent countries) by the World Bank through the policy of Structural Adjustment Loans.
B.Restructuring of Turkey’s Energy Sector
State restructuring in Turkey has been launched with 5 Structural Adjustment Loan Agreements signed with the World Bank in the immediate aftermath of a Stand-by Agreement signed in 1979 with IMF. Thanks to these agreements, each covering one financial year, a loan of the total sum of 1.6 billion USD has been provided to the Turkish Republic, in return a ground conducive to the reorganization of bureaucracy, adjustment to foreign markets and a liquidation of public economic enterprises has begun to be established. These Structural Adjustment Loan Agreements expired in 1984 and were followed by Sectoral Adjustment Loans. Since 1985 one Agricultural Adjustment Loan Agreement, two Financial Adjustment Loan Agreements and one Energy Sector Adjustment Loan Agreement have been signed.
In Turkey’s energy sector Energy Sector Adjustment Loan Agreement signed with the World Bank with total value of 325 million USD aimed at meeting the need of financing a 3-year investment in the sector has been made conditional on the following:
-To develop an investment strategy in the energy sector,
-To work out a programme with the purpose of strengthening activities and corporate framework of bodies, institution and other actors in the sector in terms of their management activities, price policies, sound investment planning and protection measures.
-To comply with a requirement of placing orders for urgent foreign purchases needed for the realization of these programmes and to make satisfactory progress so that the load was not suspended and did not come to a halt.
With Energy Sector Adjustment Loan Agreement for the first time sectoral structures marked by an integrated profile and central planning in the previous periods and large energy public economic enterprises pursuing activities in various energy fields and being attached a great importance in the past began to be compartmentalized and dismembered to the end of privatization.
With all these regulations being undertaken one interesting aspect is worth being underscored: the World Bank reports acknowledge the fact that all these adjustment measures come at a price and this price consists in the necessity to implement Energy Price Policy based on exacting this price from consumers in Turkey.
At the present liberalization/privatization policies ideologized to the extent that they can allow for the emergence of monopolies in certain areas are persistently continued without taking into consideration national and international conditions and developments in the energy sector. These policies are continued under the circumstances when institutions without an in-depth knowledge on Turkish local conditions such as IMF, the World Bank and the European Union, far away from professionalism, having inexperienced personnel and adopting approaches based on theorical assumptions and forecasts, making continuous intrusions into Turkey from outside. These policies are continued in an environment when Turkey constantly feels under pressure of foreign actors which are immune against negative consequences that are likely to emerge.
The next section investigates in sectoral terms post-1980 restructuring of superstructure of energy sector and relevant public bodies and the resultant conditions
Overall state of affairs
The existing structure of Turkish energy sector is characterized by the presence of a multi-compartmentalized decision taking mechanism at the top executive level. Even though such bodies as Ministry of Energy and Natural Resources (responsible for Energy Policies and Strategies), Ministry of Development (former State Planning Organization, responsible for Energy Investment Planning) and Energy Market Regulatory Board (responsible for regulating energy markets) are intended to be mutually complementary institutions, in practice from time to time these bodies can contradict each other.
Besides the aforementioned agencies, the Ministry of Finance, Undersecretariat of Treasury and in recent years Privatization Administration has become direction defining and decision-making elements in the scheme. Especially with the launch of intensive activity related with Baku-Ceyhan Pipeline the Ministry of Foreign Affairs has also begun to be involved in various contacts abroad related with the energy sector, sometimes to the extent of over-involvement with adverse effects.
Furthermore, addressing the need for the emergence of competitive conditions in a real sense, for the would-be “liberal” energy sectors which are supposed to emerge, even if they have not still emerged, Competition Board has become an important decision-making centre in the energy sector.
The bottom of the structure is composed of a great number of private companies smaller in terms of capital and structure, bodies subordinate to central administration and/or local authorities that emerged largely as a consequence of privatization-related compartmentalization and mostly previously large energy public economic enterprises pursuing activity in various energy subfields. The details on this structure are provided below.

As suggested in Sect. 3, the idea that unlawfulness does not bar admissibility is rooted in a
theory of the criminal trial that confines prosecutorial accountability to the issue of whether
the right person is being prosecuted for the right offence. This theory turns on a fragmented
view of the executive enforcement of the criminal law and on an understanding of the
separation of powers that stresses judicial self-restraint. Both premises will be challenged
in this Part. This sets the stage for the development a stronger theory of the criminal trial—
stronger in the accountability demanded of the executive.
What the fragmented view fails to acknowledge, and which will be highlighted in this Part,
is the collective dimension of important aspects of criminal law enforcement. The scope of
executive accountability must be wider than it is underRECif our interests in accountable and
limited government and in maintaining a robust rule of law are to be well-served. Section 4.1,
below, takes up the agency point and Sect. 4.2 addresses the rule of law.
4.1 Holistic View of the Executive Enforcement of Criminal Law
On the fragmented view, the apprehension, prosecution and punishment of criminals are
three distinct jobs and each is assigned to a separate department of the executive. The firstjob is for the Police, the second for the Prosecution and the third for the prison division.
Missing from this portrayal of discrete acts of enforcement executed independently by
different entities is recognition of integration in the areas of functional overlap. The Police
catches offenders not as an end in itself but with a view to their eventual prosecution;35
without the Police conducting investigation and collecting evidence, the Prosecution has no
case to bring to trial; the point of prosecuting those caught by the Police is to have them
convicted and sentenced for the offences that they have committed; but it is pointless to get
the Court to mete out punishment unless there is some entity to execute it. What we have
here is not a mere aggregate of units, each going about their own separate business. The
Police, Prosecution and the prison departments are wedded in inter-dependency in the
unified project of catching-criminals-and-having-them-convicted-and-punished.
Only a subset of this project is pertinent to this paper. This is the collaboration between
the Police and the Prosecution under an enforcement regime that involves apprehending
criminals, finding evidence of their guilt, and using it to get the Court to convict and
sentence them—these activities, it bears repeating, make up a single integrated enterprise.
Four features make this enterprise their joint act:36 (1) the Police and the Prosecution share
the goal of having criminals convicted and sentenced; (2) they each intentionally play their
part in promoting this common objective—the Police does its part by catching criminals so
that they may be charged and collecting evidence for use at their trial; the Prosecution does
its part by using the evidence collected by the Police to prosecute the offenders; (3) each
depends on the contribution of the other to achieve their shared end; and, (4) they are
mutually aware of the first three features.
This analysis is pegged at the level of group, and rather than individual, agency. The
Police and the Prosecution are group agents as the term is defined by List and Pettit. A
group agent is not a mere collection of individuals; it has an independent identity that
survives changes of membership. A group may be considered an agent where it functions
as an agent. An agent is ‘a system that forms representations and motivations about the
world and acts so as to realize its motivations according to its representations’.37 And it
must satisfy at some minimal level the attitude-to-fact, attitude-to-attitude and attitude-toaction
standards of rationality to count as an agent.38 What this means is that the Police and
the Prosecution are group agents to the extent that each organization is structured (by the
allocation of tasks and personnel, provision of operational rules, creation of communication
channels, establishment of decision-making processes and much else besides) such
that it is sufficiently (1) capable of looking for and processing evidence, and making
judgments and forming the relevant beliefs in a rational manner; (2) consistent in the
attitudes (beliefs and desires) that it holds; and (3) able to act as required by its representations
and motivations, beliefs and desires. The attitudes (beliefs and desires) of a
group agent do not necessarily track the personal attitudes of the members. For instance,
we can claim that the Police—as an organisation—shares with the Prosecution the goal of getting criminals convicted and sentenced and that the Police—again, as an organisation—
intentionally play its part in promoting this shared goal even where there are, at the
individual level, police officers who are interested only in closing their investigation files
and enhancing their promotion prospects.

Bölüm 3’te ileri sürüldüğü gibi, kanunsuzluğun kabul edilebilirliğin önünde bir engel oluşturmadığı yönünde bir görüş, savcılığın sorumluluğunu doğru bir kişinin aleyhine doğru bir suçtan dolayı dava açılıp açılmadığı konusu ile sınırlı tutan suç soruşturması teorisine dayanmaktadır. Bu teori ceza hukukunun yürütme tarafından uygulanmasını savunan parçalı (fragmented) görüşü ve yargı erkinin kendi kendini sınırlandırmasını vurgulayan güçler ayrılığı anlayışı üzerinde temellenmektedir. Her iki varsayım bu Kısımda eleştirilecektir. ÖZET
Bu araştırma Millî Eğitim Bakanlığı Hayat Boyu Öğrenme Genel Müdürlüğü tarafından yürütülmekte olan “Yetişkin Öğrenme Projesi” kapsamında düzenlenen “Aile İçi İletişim ve İnternet Bilinci Seminerine” katılan yetişkinlerin seminere ilişkin algı ve görüşlerinin belirlenmesi amacıyla yapılmıştır.
Araştırma verileri içeriğinde kapalı-uçlu ve açık-uçlu sorular içeren bir anket formu aracılığıyla toplanmıştır. Kapalı uçlu sorular nedeniyle nicel araştırma yöntemini, açık uçlu sorular nedeniyle nitel araştırma yöntemini içerisine aldığı için karma yöntemle yapılandırılmıştır. Araştırmada, nicel ve nitel veriler birlikte toplandığı için karma yöntem çeşitlerinden zenginleştirilmiş desen kullanılmıştır. İki araştırma yönteminin birlikte kullanılmasıyla konu ile ilgili daha kapsamlı ve derinlemesine bilgi edinilmesi, araştırma sonucunda daha güvenilir ve sağlıklı çıkarımlarda bulunulması amaçlanmaktadır.
Araştırmanın evrenini tüm Türkiye’de bulunan yetişkinler oluşturmaktadır. Araştırmanın nicel bölümünde seçkisiz örnekleme yöntemlerinden küme örnekleme yöntemi kullanılmıştır. Bu kapsamında her ilden 100 yetişkinin araştırma kapsamına alınması amaçlanmıştır. Araştırmanın nitel bölümünde amaçlı örnekleme yöntemlerinden ölçüt örnekleme yöntemi kullanılmıştır. Bu kapsamda illerden seminere katılacak yetişkinlerde belli ölçütler aranmıştır. Bu ölçütler ise mümkün olduğunca zorunlu eğitimden sonra (tamamen eğitim almayanlar da olabilir) herhangi bir eğitim faaliyetine katılmamış olmak ve katılımcıların çoğunluğunun kadınlardan seçilmesi olarak belirlenmiştir. Nicel bölümde örneklem grubunu 5531 katılımcı oluşturmaktadır. Nicel veriler için kullanılan ifadeleri 5531 katılımcı cevaplandırmasına rağmen aynı anket içerisinde yer alan “Lütfen bu konferansla ilgili görüş ve önerilerinizi aşağıdaki boşluğa yazınız” ifadesine katılımcıların 3448 tanesi yorum yazmış kalan 2083 katılımcı bu ifadeye ilişkin herhangi yorumda bulunmamıştır. Bu bağlamda nitel bulgular 3448 yorum üzerinden yapılandırılmıştır.
Veriler, araştırmacıların hazırladığı bir anket formu aracılığıyla toplanmıştır. Bu anket formu iki ayrı bölümden oluşmaktadır. Birinci bölümde, katılımcıların seminer faaliyetine ilişkin genel algılarını içeren 7 madde, seminer faaliyetinin içeriğine ve programına ilişkin algılarını içeren 3 madde ve seminer faaliyetinin yapıldığı mekana ilişkin algılarını içeren 2 madde olmak üzere toplam 12 yapılandırılmış kapalı uçlu ifade bulunmaktadır. İkinci bölümde “Lütfen bu konferansla ilgili görüş ve önerilerinizi aşağıdaki boşluğa yazınız” şeklinde yarı yapılandırılmış açık uçlu bir ifade kullanılmıştır.
Nicel yöntem kapsamına giren yapılandırılmış ifadeler 1-6 arasında 1’den 6’ya doğru olumlu yönde artan puanlarla değerlendirilmiştir. Katılımcıların değerlendirmeleri SPSS 17. programına aktarılmış ve söz konusu program ile betimleyici istatistikler kullanılarak aritmetik ortalama ve standart sapma değerleri hesaplanmıştır. Bu hesaplamalar illere ve coğrafi bölgelere göre ayrı ayrı yapılarak çalışmada sunulmuştur. Ayrıca katılımcıların illere göre dağılımlarını saptamak için frekans ve yüzde değerlerine yer verilmiştir. Katılımcıların “Aile İçi İletişim ve İnternet Bilinci Seminerine” ilişkin memnuniyet düzeylerini belirlemek için ankette yer alan her bir ifade için hesaplanan aritmetik ortalamaların hangi aralığa tekabül ettiğini belirtmek için SKPA (seçeneklere göre kodlanan puan aralığı) değerleri hesaplanmıştır. Nitel bölümde ise nitel yöntem kapsamına giren açık uçlu ifadeden elde edilen veriler kodlanmadan önce iki araştırmacı tarafından anket formu satır satır okunmuş, veriler numaralandırılarak Word belgesine aktarılmıştır. Verilerinin kodlanması sürecinde betimsel analiz, içerik analizi ve sürekli karşılaştırma tekniği kullanılmıştır.
Araştırmanın nicel bulgularına göre katılımcıların Millî Eğitim Bakanlığı Hayat Boyu Öğrenme Genel Müdürlüğü tarafından yürütülmekte olan “Yetişkin Öğrenme Projesi” kapsamında düzenlenen “Aile İçi İletişim ve İnternet Bilinci Seminerine” ilişkin Türkiye geneli memnuniyet düzeyleri (X ̅=4,94) ile yüksek düzeydedir. Araştırmanın nitel bulgularında ise katılımcıların “Aile İçi İletişim ve İnternet Bilinci Seminerine” ilişkin görüşlerinin %95 ile yüksek düzeyde olumlu olduğu görülmektedir. Bu sonuç aynı zamanda nicel bulgularla örtüşmektedir. Nicel bulgularda Türkiye genelinde katılımcıların “Aile İçi İletişim ve İnternet Bilinci Seminerine” ilişkin memnuniyet oranının (X ̅=4,94) aritmetik ortalama ile yüksek düzeyde olması nitel bulguları desteklemektedir ve açıklamaktadır.
Bir diğer nitel bulguda katılımcıların “Aile İçi İletişim ve İnternet Bilinci Seminerine” ilişkin önerilerinin % 16,4 oranında seminerin içeriğine ve programa ilişkin öneriler; % 22 oranında seminerin farklı gruplara verilmesine ilişkin öneriler; % 55 oranında seminerin devamına ilişkin öneriler; % 6 oranında seminerin yapıldığı mekâna ilişki öneriler; % 0,6 oranında bu tip seminerlerin zorunlu olmasına yönelik öneriler olmak üzere beş kategoride şekillendiği görülmektedir. Katılımcılar tarafından en çok ifade edilen öneri, seminerin devamına ilişkin olurken, en az ifade edilen öneri ise bu tip seminerlerin zorunlu olmasına ilişkin olmuştur. Katılımcıların % 55 gibi yüksek bir oranda seminerlerin devamına ilişkin öneride bulunması, katılımcıların gerek nicel bulgularda gerekse nitel bulgularda ortaya çıkan seminere ilişkin memnuniyet algısı ve olumlu tutumun yüksek düzeyde olmasını desteklerler niteliktedir. Yine % 22 oranında ifade edilen seminerin farklı gruplara da verilmesine yönelik öneri de seminere ilişkin oluşan yüksek memnuniyet algısına bağlı olarak anlam kazanmaktadır.
Araştırma bulgularına dayanılarak;
1-Katılımcıların seminer çalışmasından yüksek düzeyde memnuniyet duymalarından dolayı bu tip seminerlerin yaygınlaştırılması ve sürekli yapılması,
2- Bu tip seminerler aracılığıyla Hayat Boyu Öğrenme kavramı ve felsefesinin toplumun her kesiminde yayılmasının sağlanması ve toplumda “öğrenmenin yaşı yoktur” algısının oluşturulması,
3- Yetişkin öğrenme projesi gibi Hayat Boyu Öğrenme kavramının ülke genelinde daha işlevsel hale gelmesini sağlayan projelerin yapılması,
4- Seminer konularının çeşitlendirilerek toplumun farklı kesimlerine ulaştırılması,
5- Seminer çalışmalarına katılımın arttırılması için seminer çalışmalarının daha etkin bir şekilde duyurulması,
6- Seminerlerin içeriğinde, programında ve seminerin yapıldığı mekânda, katılımcıların özelliklerine ve ihtiyaçlarına göre düzenlemeler yapılması,
7-İllere göre memnuniyet oranlarına bakılarak, her ilin yetişkinlere seminer düzenleme kapasitesinin geliştirilmesi önerilebilir.
Translation - English Seminar-Related Perceptions and Views of Adults – Participants of Seminar on Intra-Family Communication and Internet Awareness Organized Within the Framework of Adult Learning Project
SUMMARY
This research has been conducted with the purpose of determining perceptions and views of the adults who participated in the Seminar on “Intra-Family Communication and Internet Awareness” held within the framework of “Adult Learning Project” implemented by the Ministry of National Education General Directorate of Lifelong Learning.
Research data have been gathered through using a questionnaire composed of open-ended and closed-ended questions. Data collection method is a combined one, with closed-ended questions representing a quantitative research method and open-ended questions representing a qualitative research method. Since research adopts a composite method bringing together qualitative and qualitative data, a combined research design enriched with various research methods has been used. The main goal behind the use of two research methods together is to obtain a more comprehensive and a more detailed information and to draw more reliable and more sound inferences at the end of the research.
The research target are adults throughout Turkey. In the quantitative part of the research cluster sampling method which is one of random sampling methods has been used. The research target is composed of 100 adults from each province. In the qualitative part of the research criterion sampling methods which is one of purposeful sampling methods has been employed. Within the scope of this method certain criteria have been advanced for the adults from various provinces who would participate in the seminar. The criteria are as follows: not to have attended any training course (activity) as far as possible after a compulsory education (including those who have not received any education) and choosing the most of participants among women. In the quantitative part a sample group consists of 5531 participants. Even though the number of participants-respondents who answered the expressions used for generating and collecting qualitative data is 5531, in the same questionnaire the question formulated as “Please provide your views and proposals about this conference in the blank below” has been commented upon by 3448 participants, while the remaining 2083 participants have not provided any comment. Hence, qualitative findings are based on an assessment of 3448 participants’ comments provided.
Data have been gathered through using a questionnaire developed by researchers. The questionnaire consists of two separate parts. The first part includes 12 structured closed-end expressions, out of which 7 items being related to general perceptions by participants on seminar activity, 3 items dealing with perceptions of the contents and the programme of seminar activity and 2 items being aimed at revealing perceptions of the venue (place) where a seminar activity is being conducted. The second part contains a semi-structured open-ended question, namely: “Please provide your views and proposals about this conference in the blank below”.
The structured expressions falling within the remit of a quantitative method have been given points in an ascending way from 1 to 6 within the range between 1 and 6. The questionnaire results have been entered in by using SPSS 17 software application and by employing descriptive statistics arithmetic means and standard deviation values have been calculated. These calculations have been made separately for each province and geographical region and have been presented in the research. Besides, in order to determine the distribution of participants on the province basis frequency and percentage values have also been provided.
In order to determine satisfaction level of the participants with regard to “Intra-Family Communication and Internet Awareness Seminar” to specify what range (interval) arithmetic means calculated for each expression in the questionnaire corresponds to, values of score interval coded on the basis of choises (SKPA) have been calculated. In the qualitative part the data obtained through the analysis of open-ended expressions falling within the scope of a qualitative method before being coded have been read line-by-line by two researchers and data have been transferred into a Word document after being designated corresponding numbers. In the encoding of data such techniques as descriptive analysis, content analysis and continuous comparison have been used.
According to the quantitative findings, an overall country-wide satisfaction level of participants for Turkey with regard to “Intra-Family Communication and Internet Awareness Seminar” organized within the framework of the “Lifelong Learning Project” implemented by the Ministry of National Education General Directorate of Lifelong Learning is X ̅=4,94 and to this extent can be considered high.
The qualitative findings of the research have revealed that the participants’ views on “Intra-Family Communication and Internet Awareness Seminar” is positive and at the level of 95 %. This finding is at the same time consistent with quantitative findings.
The fact that among quantitative findings an arithmetic mean of participants’ satisfaction with “Intra-Family Communication and Internet Awareness Seminar” (X ̅=4,94) all over Turkey is high supports and explains qualitative findings.
Another qualitative finding has been that participants’ suggestions related to “Intra-Family Communication and Internet Awareness Seminar” can be divided into 5 categories as follows: suggestions on the contents of the seminar and the programme - 16.4 %, suggestions on the seminar being given to different groups – 22 %, suggestions on the continuation of the seminar – 55 %, suggestions on the venue where the seminar is held – 6 %, suggestions that such seminars should be compulsory – 0.6 %.
Thus, the most widely held suggestion among the participants is the one concerning the continuity of the seminar, and the least supported suggestion is that such seminars should be compulsory. The fact that such a high ratio of participants as 55 % have put forward a suggestion on the continuity of the seminar supports the participants’ high satisfaction perception level and high positive stance level revealed both by quantitative and qualitative findings. Furthermore, a suggestion support at the level of 22 % in favour of the said seminar to be given different groups acquires a meaning in conjunction with a high satisfaction perception level related to the seminar.
Based on the findings of the research it can be recommended that:
1 - Such seminars be popularized and be held on a continuous basis taking into account a high level of participants’ satisfaction with seminar activities.
2 - Through the organization of such seminars the concept and philosophy of Lifelong Learning be spread to every segment of society and an approach that “it is never too late to learn” be adopted.
3 - Projects that ensure that the concept of Lifelong Learning be made more functional throughout the country be implemented (such as adult learning project).
4 - Seminar topics are diversified and be communicated to various segments of society.
5 - Seminar activities be announced in a more efficient way so that the level of participation in such activities increased.
6 - The necessary arrangements be made in the content of seminars, the programmes and their places depending upon the features and needs of the participants.
7 - An adult-oriented seminar organizing capacity of every province be enhanced based upon the satisfaction level indicators peculiar to the respective provinces.

Instances of vinyl siding distortion have been reported along with questions related to how it occurs. This bulletin provides information related to a study and analysis conducted by Cardinal Glass Industries along with general recommendations on how to avoid vinyl siding distortion.
Vinyl siding distortion can occur when radiated or reflected solar energy from various sources combine with ambient temperature and direct sunlight exposure to cause visible distortion of vinyl siding. According to a recent LBNL report, the heat deflection temperature of vinyl siding ranges from 142°-192°F with an average distortion temperature of 166°F1.
While the occurrence of vinyl siding distortion cannot be reliably predicted, awareness of its contributing factors may help to avoid it. The following variables should be considered when determining whether vinyl siding distortion may occur or has already occurred:
Color and solar absorption of the vinyl siding;
Heat distortion temperature of the vinyl siding;
Cumulative time and temperature effects on vinyl siding;
Molecular strains in the vinyl siding that were frozen in during the manufacturing process;
Installation strains on the vinyl siding that exacerbate any manufacturing related strains;
Ambient outdoor temperatures to which the vinyl siding is exposed;
Exposure of the vinyl siding to wind, which affects the cooling of the siding;
Architectural designs that block wind and trap heat (e.g, overhangs, alcoves, inside corners);
Proximity of the siding to other heat sources, such as air conditioning compressors, motors, and barbeque grills;
Reflections from building materials, including adjacent vinyl siding, windows, doors, shingles, nearby walls, asphalt, concrete, swimming pools, etc.;
Orientation of any reflective building product relative to the sun and the affected vinyl siding;
Distance of the involved reflective building product to the vinyl siding;
Excessive deflection of any involved glass product when manufactured. This may be exacerbated by changes in barometric pressure and temperature in the field.
The following sections describe how these variables may contribute to vinyl siding distortion, and offer considerations and recommendations for minimizing the risk of its occurrence. Because of the numerous variables involved, however, there is no single solution.
Vinyl Siding Considerations
Vinyl siding is often selected as an exterior cladding material because of its low maintenance and low cost qualities. However, there are several considerations that need to be taken into account when using vinyl siding products because vinyl siding will soften and visibly distort at approximately 165° F2
Role of Color / Absorptance
Vinyl siding is available in a variety of colors with related solar absorptance levels. In general, the darker the color, the more absorptive the siding. The absorptance values can range from 20% to 80%. The more absorptive the vinyl siding, the faster its temperature will increase when exposed to thermal energy or solar irradiance.
There is a direct correlation between vinyl siding solar absorptance and the heating of the vinyl siding above the ambient air temperature. Figure 1 shows surface temperature versus solar irradiance for four vinyl siding products at various solar absorptances. It assumes a clear, non-windy day, with an ambient air temperature of 95° F.
With no sun on the siding, the vinyl siding temperature is the same as the ambient air temperature. At 20% and 40% solar absorptance, vinyl siding is able to withstand greater exposure to solar irradiance before distorting, than darker vinyl siding at 60% and 80% solar absorptance.
The maximum direct solar irradiance normal to the sun for a given location, on a clear day, with the sun highest in sky, is approximately 1000 W/m2. This level of solar irradiance is often referred to as “one sun”. However, the orientation of the sun relative to the siding will lessen the intensity of the solar irradiance due to the sun’s angle of incidence. The solar irradiance experienced by the siding will vary with location, time of day and weather conditions, but a typical “corrected one sun” value for the irradiance on a vertical wall, is approximately 750 W/m2.
Role of Built-In Manufacturing Stresses
During the manufacturing process, vinyl siding is extruded, reheated, shaped, and cooled at least two times. This process quenches the polymer before the molecular structure reaches its lowest energy state, in essence “freezing in” strains of the vinyl siding. These strains are captured in the manufactured product, making it more susceptible to stress relaxation, which results in visible physical deformation of the siding when exposed to external stressors.
All plastics relax at their glass transition temperature. Vinyl siding tends to shrink above this temperature. Consequently, when vinyl siding is heated to its glass transition temperature after installation, the frozen-in strains relax, creating buckling and wrinkles as shown in Figure 2. The figure also demonstrates how white vinyl products (with a lower absorptance) perform better when exposed to the same solar energy. Notably, the white vinyl corner shown in Figure 2 has not distorted, while the adjacent darker siding has visibly distorted.

• Cephe kaplamanın motor, klima kompresörleri, barbekü ızgaraları gibi diğer ısı kaynaklarına yakın bir konumda bulunması;
• Bitişik vinil cephe kaplama, pencereler, kapılar, çatı padavrası, yakın duvarlar, asfalt, beton, yüzme havuzlar vs. dahil olmak üzere diğer inşaat malzemelerinden gelen yansımalar.
• Herhangi bir yansıtıcı inşaat malzemesinin güneşe ve etkilenen vinil cephe kaplamaya göre yönü.
• Etki eden yansıtıcı inşaat malzemesinin vinil cephe kaplamadan uzaklığı;
• İlgili herhangi bir cam ürününün üretim sırasında aşırı eğilmesi. Bu durum barometre basıncındaki ve arazideki sıcaklıktaki değişikliklerin etkisiyle daha şiddetli hale gelebilir.
Aşağıdaki bölümlerde bu değişkenlerin vinil cephe kaplama deformasyonunu ne şekilde etkileyebildiği anlatılmakta ve deformasyonun meydana gelme riskinin en aza indirilmesi için çözüm ve öneriler sunmaktadır. Ancak, devreye giren değişkenlerin çok sayıda olması nedeniyle tek ortak bir çözüm bulunmamaktadır.

Bu durum ise harici gerilme ajanlarına karşı maruz kaldığı durumlarda cephe kaplamada gözle görülür fiziksel bir deformasyonla sonuçlanır.
Tüm plastik ürünler camlaşma sıcaklıklarında gevşer. Vinil cephe kaplama bu sıcaklığın üzerindeki bir sıcaklıkta daralma eğilimi gösterir. Dolayısıyla vinil cephe kaplama kurulum işleminden sonra camlaşma sıcaklığına kadar ısıtıldığında “dondurulmuş” gerilmeler gevşer ve Şekil 2’de gösterildiği gibi bükülme ve kırışıklıkların meydana gelmesine neden olur. Şekilde ayrıca beyaz vinil cephe kaplamaların (daha düşük emme kapasitesine sahip) aynı değerdeki güneş enerjisine maruz kaldığı durumlarda daha iyi bir performans gösterdiği belirtilmektedir. Şekil 2’de gösterilen beyaz vinil köşe bozunum geçirmezken hemen bitişiğindeki daha koyu renkteki cephe kaplama gözle görülür bir şekilde deforme olmuştur.
