Source text - Polish 8.8 In the event that any Party breaches any of its obligations under this Agreement or any undertakings or warranties set out in this Agreement, provided that such breach amounts to fraud, Gross Negligence or Wilful Misconduct, then the defaulting Party must indemnify, defend and hold harmless the other Party for any ensuing liability and loss directly incurred by such other Party in connection with or as a result of such breach. It is not necessary for a Party to incur any expense or to make any payment before enforcing a right of indemnity under this clause. This indemnification does not cover any contractual claims of third parties. The Seller will indemnify and hold harmless the Buyer and its officers and employees from and against any and all liabilities, losses, damages (including, without limitation, reasonable legal fees and expenses and costs of investigation) of any kind or nature which are imposed on, incurred by or asserted against the Buyer by any third party demand, claim or action, including any claim alleging infringement of third party rights, which arise out of or in connection with the operation of the Project
Translation - English 8.8 W przypadku, gdy którakolwiek ze Stron naruszy jakikolwiek obowiązek wynikający z niniejszej Umowy lub jakiekolwiek zobowiązanie albo zapewnienie określone w niniejszej Umowie, pod warunkiem, że takie naruszenie stanowi nadużycie, Rażące Naruszenie lub Umyślne Zaniedbanie, wówczas Strona naruszająca Umowę zobowiązana jest zabezpieczyć, chronić oraz zwolnić z odpowiedzialności drugą Stronę z jakichkolwiek wynikających zobowiązań oraz strat bezpośrednio poniesionych przez tę drugą Stronę w związku z lub na skutek takiego naruszenia, Strona nie jest zobowiązana ponosić jakiekolwiek wydatki lub dokonywać żadnych płatności przed nadaniem prawa do odszkodowania, zgodnie z niniejszym paragrafem.
