Source text - German § 8 Datenschutz und Datensicherheit
(1) Die Vertragsparteien beachten die einschlägigen datenschutzrechtlichen Vorschriften. Der Auftragnehmer wird insbesondere, sofern er in Kontakt mit personenbezogenen Daten kommt, diese Daten i.S.d. § 11 Abs. 3 BDSG nur im Rahmen der Weisung des Auftraggebers erheben, verarbeiten oder nutzen. Die Vertragsparteien verpflichten ihre Mitarbeiter gem. § 5 BDSG auf die Einhaltung des Datengeheimnisses, sofern nicht bereits eine solche Verpflichtung besteht.
(2) Der Auftragnehmer ist zu regelmäßiger Datensicherung im erforderlichen Umfang verpflichtet. Er hat zudem die technischen und organisatorischen Anforderungen gem. der Anlage zu § 9 BDSG zu erfüllen. Insbesondere hat er die seinem Zugriff unterliegenden Systeme gegen unbefugte Kenntnisnahme, Speicherung, Veränderung sowie sonstige nicht autorisierte Zugriffe oder Angriffe, gleich welcher Art, durch Mitarbeiter des Auftraggebers oder sonstige Dritte zu schützen. Hierzu ergreift er die nach dem neuesten Stand bewährter Technik geeigneten Maßnahmen in erforderlichem Umfang, insbesondere zum Schutz gegen Viren und sonstige schadhafte Programme oder Programmroutinen, außerdem sonstige Maßnahmen zum Schutz seiner Einrichtung, insbesondere zum Schutz gegen Einbruch. Bei Verwendung von nicht seinem Zugriff unterliegenden Systemen hat er seinen Vertragspartnern entsprechende Verpflichtungen aufzuerlegen und deren Einhaltung regelmäßig zu überwachen.
§ 9 Schlussbestimmungen
(1) Der Auftragnehmer ist zur Übertragung von Ansprüchen gegen den Auftraggeber auf Dritte nur nach schriftlicher Zustimmung des Auftraggebers berechtigt.
(2) Die Ausübung von Zurückbehaltungsrechten ist nur im Hinblick auf Ansprüche aus diesem Vertrag zulässig.
(3) Jede Vertragspartei darf nur gegenüber unbestrittenen oder rechtskräftig festgestellten Forderungen der anderen Vertragspartei aufrechnen.
(4) Mündliche Nebenabreden bestehen nicht. Änderungen oder Ergänzungen dieser Vereinbarung bedürfen der Schriftform. Dies gilt auch für jede Aufhebung dieses Schriftformerfordernisses selbst.
(5) Gerichtsstand für alle Streitigkeiten aus dem Vertragsverhältnis zwischen dem Auftraggeber und Auftragnehmer ist Erfurt, sofern jede Partei Kaufmann oder juristische Person des öffentlichen Rechts ist.
(6) Sollten einzelne Bestimmungen dieses Vertrags unwirksam sein, berührt dies die Gültigkeit der übrigen Bestimmungen nicht. Die Vertragsparteien werden sich bemühen, anstelle der unwirksamen Bestimmung eine solche zu finden, die dem Vertragsziel rechtlich und wirtschaftlich am besten gerecht wird.
(7) Sämtliche in diesem Vertrag genannten Anlagen sind verpflichtender Teil des Vertrags.
Translation - English § 8 Data protection and Data security
(1) The contractual parties respect the relevant data protection regulations. The contractor will especially, so far as he gets in contact with personal data, collect, process or use these data in terms of § 11 section 3 Federal Data Protection Act (BDSG) only within the scope of the clients directive. The contractual parties oblige their staff pursuant to § 5 Federal Data Protection Act (BDSG) to compliance with the data secrecy, so far as such obligation does not already exist.
(2) The contractor is obliged to conduct regular data backup to the required extent. Further he is to fulfill the technical and organizational requirements in accordance with the appendix to § 9 Federal Data Protection Act (BDSG). In particular, he is to protect the systems which he has access to against taking note, saving, alteration, as well as other unauthorized access or assaults, regardless of the kind, by the clients staff members or other third parties. For this purpose he is taking appropriate measures, following the latest proven technology to the required extend, especially for protection against viruses and other defective programs or program routines, moreover he is taking other measures for the protection of his establishment, particularly against intrusion. While using systems he does not have access to, he is to impose on his contractual partners the appropriate obligations and is to monitor their compliance on a regular basis.
§ 9 Final provisions
(1) The contractor has the right to transfer of claims against the client to a third party only after a written consent issued by the client.
(2) The practice of right to retention is only admissible with regard to claims arising from this contract.
(3) Each contracting party may set-off against the other party only with claims that are undisputed or legally defined.
(4) Additional oral agreements do not exist. Modifications or supplements of this agreement must be in writing. This also applies for each annulment of this written form requirement itself.
(5) Place of jurisdiction for all disputes arising from the contractual relationship between the client and the contractor is Erfurt, provided each party is a merchant or legal person subject to public law.
(6) Should individual terms of this agreement become ineffective, the validity of the other terms remain not affected. The contracting parties will make an effort to find instead such a term which legally and economically most suitably fulfills the contractual goal.
(7) All appendices mentioned in this contract are a binding part of the contract.

I hold a degree in Business Administration, but languages have always been my passion and a priority. After graduating from the University of Maryland USA in 1995, I immediately started working on my language certifications and on my translator career. My first employment as a full-time translator set the basis for my future endeavors in my language profession. A few years ago, I was presented with the opportunity to work at a renowned bilingual (German and English) Spanish pharmaceutical company in Frankfurt, Germany where I moved up to the position of a Drug Safety Manager.
