Source text - English AGREEMENTS
In consideration of the promises made by and between the parties hereto, the undersigned agree as follows:
1. Mr. XXX’s employment with XXX ended as of December 2012. Mr. XXX acknowledges and agrees that, upon receipt of all payments due under this Agreement, he will have received all wages and compensation due from XXX as the result of his employment.
2. Provided that (l) Mr. XXX signs this Agreement, (2) Mr. XXX does not revoke this Agreement pursuant to Paragraph 6.7, below, (3) Mr. XXX dismisses his individual claims in the Action, with prejudice, (4) Mr. XXX provides completed Internal Revenue Service Forms 1099 and W-4, (5) XXX provides a completed Internal Revenue Service Form 1099, and (4) the Court dismisses all claims brought on behalf of the putative class without prejudice and agrees that no penalties are to be paid under the Private Attorney's General Act, XXX will pay Mr. XXX the additional sum of $XXX. Payment will be made in the form of three checks: the first payable to XXX, in the gross amount of $XXX, less any taxes and other required withholdings, as compensation for allegedly past due wages; the second, in the amount of in the gross amount of $XXX, as compensation for allegedly due penalties and premium for representation of the class; and, the third, payable to XXX in the amount of in the gross amount of XXX, as compensation for allegedly due attorneys' fees. Payment will be delivered within 15 days after all conditions precedent to payment have been satisfied.
3. Mr. XXX will, and hereby does, forever release and discharge XXX from any and all causes of action, judgments, liens, indebtedness, damages, losses, claims, liabilities, and demands of whatsoever kind and character in any manner whatsoever attributable to his employment by XXX, or any other matter or event occurring before the date of this Agreement, including any claim for attorneys' fees and costs.
4. Mr. XXX represents and warrants that he has not suffered or sustained any injury or illness in the course of performing any services for XXX. 5. Mr. XXX expressly agrees that this Agreement extends to all claims of every nature and kind against XXX, known or unknown, suspected or unsuspected, vested or contingent, past, present, or future occurring before the execution of this Agreement, whether set forth in a pleading, charge, or complaint referred to herein or not, and that any and all rights granted under Section 1542 of the California Civil Code or any analogous state law or federal law or regulation ARE HEREBY EXPRESSLY WAIVED.

Considerando las promesas realizadas por y entre las partes del presente documento, los infrascritos acuerdan lo siguiente:
1. El empleo del Sr. XXX con XXX finalizó en diciembre de 2012. El Sr. XXX reconoce y acepta que, cuando cobre todos los pagos designados en este Acuerdo, ya habrá recibido todos los salarios y compensaciones que XXX adeude como resultado de su empleo.
2. El Sr. XXX se compromete, y por medio del presente lo concreta, a exonerar y absolver para siempre a XXX de todas y cada una de las causas de acción, juicios, derechos de retención, endeudamientos, daños, pérdidas, reclamos, responsabilidades y demandas de cualquier tipo y carácter que puedan atribuirse de alguna forma a su empleo en XXX, o cualquier otra cuestión o evento que suceda antes de la fecha de este Acuerdo, incluso cualquier reclamo por el pago de los costos y honorarios de los abogados.
4. El Sr. XXX declara y garantiza que no ha sufrido ni padecido ninguna lesión o enfermedad durante el período en que brindó sus servicios a XXX.
5.
