(or)
"We have discovered actions in progress in which a judgment on the merits has not yet been rendered (or is still pending)" ...
Better to transform "prolação" (rendering, but not "rendition") into a verb for clearer English.
Note that a judgment on the merits is not necessarily a final judgment (a dubious term) because, depending on the circumstances, it could be appealable. The concept of a final or unappealable judgment is not necessarily included in the meaning here.

A "final ruling" (read: "ruling") may be arrived at without necessarily making a judgment on the merits (ex. on a technical point of procedure, etc.)
